Most people would now acknowledge that Lord Scarman was the right man
for the inquiry into the Brixton riots of 1981. Most would also agree
that his report helped steady a nation that was in danger of descending
into sustained violent confrontation, and that it set our policing and
race relations on a better course. Lord Scarman's achievement is one of
the many reasons why he is so mourned this week. But his appointment
also reflected well on the home secretary who made it, William
Whitelaw. It was not easy for a Tory home secretary in a government
headed by a prime minister with powerful tabloid instincts on law and
order to appoint such a judge to carry out such a task. Lord Whitelaw
faced criticism from his party and his backbenches for doing it. But it
was the right thing to do. One can only wonder whether the current home
secretary would be as wise or as independent if he faced similar
circumstances today.
