A Marine officer is scheduled for arraignment today at Camp Pendleton,
California, and will be facing charges stemming from the so-called "Haditha
massacre" in Iraq.
Attorneys for Lt. Col. Jeffrey Chessani (USMC) say they do not understand
why the court-martial is moving forward in light of the fact that several
other Marines have already been exonerated of any wrongdoing in the
incident. Chessani has been charged with not fully investigating the events
at Haditha, Iraq, and for failing to report a "Law of War" violation in
connection with the November 19, 2005, incident that led to the unfortunate
death of 24 Iraqi civilians. If convicted, Chessani faces two-and-a-half
years of imprisonment, a dishonorable discharge from the Marine Corps, and
loss of all retirement benefits.
Brian Rooney with the Thomas More Law Center, is representing Chessani.
"It's very frustrating because out of the eight Marines originally charged,
five of them have been exonerated," the attorney explains. "So who the
government's charged in the case, who they've dropped charges against in
this case, why they haven't dropped charges against certain people and kept
them against others -- it's a head-scratcher, to tell you the truth. I can't
figure it out."
Rooney contends the government is making an example of Chessani to appease
an anti-war politician and the anti-war media.
"That's essentially what this is -- a railroad job to cover all the bases
that the Marine Corps thinks they need to cover to include anti-war
politicians like Jack Murtha, who controls military appropriations monies,
and his willing cohorts in the media," Rooney argues. But he says they are
still confident their client will eventually be exonerated at some point
during the court-martial proceedings.

1. American service members are subject to the Uniform Code of
Military Justice and the Laws of Land Warfare. Killing civilians is
prohibited by both of those bodies of law. It is also illegal to
knowingly make false statements in an official report, or to suborn
false statements.
2. This officer was in command. You seem to have an odd take on
responsibility, but let me explain. If you are in a position of
command in the US military, the actions of those under your command
while performing their duties are your responsibility. It doesn't
matter if the colonel was a hundred miles away, he is responsible.
