House arrest by ministerial order is an affront to the rule of law

On Monday, I and other Labour MPs will try to amend the most offensive
feature of the government's latest bill on terrorism. We will insist
that any decision to apply the new powers of house arrest must be taken
by the courts rather than by the home secretary. For us this issue of
principle is the sticking point. A decision to deprive a citizen of
liberty must be the result of judicial process and not the product of
political calculation.
