'It's Britain's Guant=E1namo'
Rick Scannell defended international terrorist suspects held in
Belmarsh. Now he's become the second special advocate to quit. Why?
Because, he tells Aida Edemariam, indefinite detention and secret
hearings with no jury make a mockery of justice

It's rush-hour in the City but the main sound in the courtyards of
Middle Temple is of a fountain. The trees around it, so old that they
have to be propped up, are overlooked by mullioned windows probably
older still. It's easy to see why there's a film unit parked outside;
these buildings are shorthand for centuries of privilege, rule of law,
power. They are also, at the moment, the location of a burgeoning
constitutional crisis. When the law lords ruled in December that
indefinite detention, without trial, of foreign nationals under the
Anti-Terrorism, Crime and Security Act 2001 was a breach of their human
rights, and thus illegal, Charles Clarke, then home secretary for all
of a day, responded that he would be seeking parliamentary permission
to renew the emergency provisions. Ian Macdonald QC, a special advocate
for the dozen or so men affected, resigned in disgust. This week, his
colleague Rick Scannell walked too.
