Justice Antonin Scalia's radical views on the death penalty
and the Constitution are timely reminders of why he would be
a disastrous choice for chief justice.
On the other hand, Antonin Scalia is already 69 years old. Bush could
nominate a 50-something individual to the bench as Chief Justice. If
he simply makes the new appointment an Associate Justice then picks
Scalia as Chief Justice, it just means the position of Chief Justice
will open up again all the sooner.
