Object: OT: UMCJ question.
Still fighting with the ditto heads in alt.fan.rush-limbaugh.
They say that if Rummy is responsible for the atrocities in the Iraqi
prison, then to them it stands to reason that President Clinton was
responsible for a Sergeant raping a 11 year old girl.
I am sarcastically arguing that there is no MOS for rape and therefore
no SOP, so Clinton could not be responsible for the rape of the little
girl.
Then I got to thinking. I was in the service and know that I was under
the UMCJ while on duty and on base. But was I when I was in a civilian
area and off duty.
My friend brained a Vietnamese with a brick. His trial and
incarceration where handle by the civilian Vietnamese courts.
This is all hearsay to me and may not be true.
Anyway where does the UMCJ have jurisdiction. Still remember all of
the guys who were arrested by the Sheriff and Police on Friday -
Saturday night.

Tell them that Rummy is responsible because he gave the orders that allowed
the
atrocities to happen in the first place. They weren't the random acts of a
few
soldiers, but the result of the official policy on how to treat prisoners
that was
set up with Rummy's approval. The only way Clinton could be
responsible in the same way is if he actually ordered that soldiers go out
and rape
children.

While you are in the military you are under the UCMJ. Doesn't matter
if you are on leave and have a two-week shadow that would bive your
Top Sergeant a coronary.
However, the difference is that the service members in the prison were
carrying out duties assigned by higher command when the abuses took
place.
Unless the NCO who raped a little girl was executing his duties, and
those duties placed the girl under his control, *with the knowledge of
his superiors,* they aren't culpable.
I'd like to see the entire chain of command get hung out to dry on
this one. The breakdown od command and control was unforgivable.
