Ping Elroy: You made HBO |
Tonight's (6/20) Six Feet Under episode starts with a woman seeing
helium filled sex dolls floating in the sky, set loose accidentally from a
truck, gets out of her car yelling "sweet Jesus!" Running into traffic,
she's hit by a car.
Sound familiar? <g>

Yeah, that's a good one. Gotta have somebody die in the story
so they can use it on the show. I think the one about the cross
falling off the church wall and killing the pastor might make for
another good one, and the one about the guy who slips on a bar
of soap in his bath tub while trying to walk on water. :)
Branch out.
Yes, I need to write some with no religion involved.

Histrionics? Now there's a word you don't see every day... I had to
look it up to see what it means. :)
When I was dealing with David Brenner, he offered me $300 or so for
full rights to the story, but I turned it down at the time. It would
have meant that he could use the story whenever he wanted
and sell it to anyone he wanted, and I wouldn't have made any more
off it from that point on. He told me that he was talking to his
lawyers about the whole thing, and I guess that's what
they told him to do. At the time, I was still making good money doing
computer programming, so $300 wasn't really enough for me to care
about at the time. I made more than that in one day, so holding on
to the rights to the story seemed more important to me at the time.
Even though I could use some income right now, I doubt $300 would
buy me off at this time. It's gotta be way more than that, or it's
just not worth the trouble fighting over.
At least I have a tape of HBO using the story idea, and so I have a
much better case against them, but even still, I'm not gonna get
my hopes up too high, lest they be shot down and result in some
kind of disappointment on my part.

You'll lose dude. The ever magical disclaimer at the end of the
credits should debunk your claim. I'd say that even if the show
presented a word for word projection of your story, you'd still lose.
Face the reality, don't let it get you down and carry on man!

Probably. I'd hazard they figured you were some hick from the sticks
that'd be oh-so-enthralled somebody with a "name" bothered to use
your stuff.
No writer should sell full rights. Ever.
Or at least not outside some very limited spheres. I did several
work-for-hires in the computer book publishing world, selling all rights.
But you know the speed at which things obsolete in computers. So it was
no big deal. In a year or two, the book was going to be worthless anyway.
Still, anything I thought significant, I always insisted on rights
reverting to me when the book was taken out of print. They had exclusive
worldwide but I wanted them back if for some reason they yanked the book
while it was still viable (never happened but you never know).
Hollywood and the music industry, by the way, are notorious for trying to
pull that on people. Get them to do "work for hire," sell all their
rights, then sell the material from the next century...

I've been dealing with a similar problem with the Discovery Channel.
I want to submit a short video clip of a squirrel protecting another
road-killed squirrel from a pack of crows, for display on the "Amazing
Animal Videos" show, but nobody will give me an actual address to send
the tape to. They say I have to be part of some DCI network, and have
to have an inside contact who will agree to accept the tape. It's
weird stuff. I figured I could just send it in like people do to
"America's Funniest Home Videos" where they post the address to
send tapes to at the end of the show.
Maybe I'm missing the address at the end of "Amazing Animal
Videos?" Does anyone around here watch Animal Planet and can
see an address to send in one's own amazing animal videos?

it's pretty upbeat. Like "America's Funniest Home Videos". Your tape, while
fascinating, is also sad.

I don't know myself. But it could be a closed shop where people are
submitting (via agent and contacts) for pay.
The home video game was rather unique in asking for outside submissions.
And, well, pretty slimy in my opinion. You waved *all rights for *no
compensation (except the small chance you might be one of the tiny few
that won their contest thing). They got an endless supply of material they
could do anything they want for as long as they want in any medium they
want and you got...
Um...
You got to watch the TV show and buy the products the sponsors were

Don't get angry by this, welcome it! Celebrate it!
Don't be foolish. Appeal to the better part of them.
Lawyers & threats only make sense if all your other work sucks

Myself, I tend to believe if they already like one thing you wrote,
there's an excellent chance that they'll like some other stuff.
But don't force. "Using something else, but give me credit this

Find out what they're looking for, then give it to them.
Anything less is betting against yourself.
Of course, if they tell you to ***** then you'd have to start thinking
about other approaches. But why would they? Apparently they like

Actually you're the one that doesn't know beans about this matter. The fact
that they used material not original to their writers and thus protection
for HBO makes them a major target. If Elroy keeps his cool and persists
they must pay him handsomely because he can prove 1. that it was published
by him and 2. they used it without his permission. They will try to buy him
off cheap like Brenner did but he should not go for it.

Nah...just ask for royalties. Who knows...that twisted mind of his
might get him a gig writing for quirky drama shows!
Exactly! :)
I'm in a bit of a quandary, to tell the truth. I want to make some
money off the story, but I don't want to ***** anyone off and burn any
possible bridges before they're even built... :)
I really think the show could use some of my previous stories and ones
I can come up with as the starting basis for future episodes, and the
rest of the episode can be handled by the other eight writers. I was
actually surprised to find out that a single show had so many writers.
I thought maybe two or three, but eight? So, I figure what's one more?
I don't talk about it much because it sounds like bragging to a lot of
people
I'd actually like to hear more about your experiences if you feel like
spending the time writing about them here. I wouldn't consider it
bragging in the least.
but I worked in TV for a couple of seasons. As an assistant to a writing
staff. Got to the point where I was about one degree away from ST:TNG
and had scripts. Looking back on it now, it's kind of funny because you
talk about my life would have been *very different if I hadn't walked
away.
(There is a writer out there now who is making, last I know, a quarter a
million a year who I got started in television. The irony is not lost on
me as I'm in bankruptcy now.)
I'm not doing too well myself in finding programming work right now.
It is, simply put, a *miserable place. I would not recommend it. Not
unless money means that much to you.
Right now it does mean a lot to me. I'd like to make an actual income off
of creative writing, and the thought of programming a computer for the
next 20 years doesn't really appeal to me, since I've grown bored of it
lately. Luckily, or actually intelligently, I stashed away some money
when I was doing well in the computer programming field, and I'm living
off that now, but it's running out slowly...
But television isn't about writing. It's about schmoozing and politics and
connections. Writing happens once in a while by accident when nobody's
looking (and it's often stomped out soon as noticed).
There's gotta be some other way to go. Hell, even WWN. No, really, they
pay *good (believe it or not).
You *can make unholy amounts of cash. Almost every single writer on the
staff had started only about three years before. They were all well into
six figures and there were BMWs and Mercedes far as the eye could see.
Not to mention everybody had the house in Santa Fe or where ever they
liked to escape to.
*But, you'd have to move to LA, start as a "grunt" (if you could get the
job,
But they've already used one of my story ideas, so couldn't I bypass the
grunt stage?
Unless you've been holding out on us and maybe are sleeping with a
producer... no.
Remember that thing about the writer's sitting around the table at the
show? Soon as you appear on the radar screen, you'll be threat. Not just
to them but any and all friends they have they're hoping to get an
assignment for.
Without the contacts, you'll be a "problem" that they have to make go away.
If you think I actually have a legal case, wouldn't that be
worth something in the negotiations?
To the extent that they'll want to throw money at you so you'll go away.
<snip>
I'm not sure you're mean enough to work in that industry. You've even
hesitated to swing a lawyer at them over this. Hell, *I would have had a
lawyer on them Monday morning...
What would your plan of legal attack be, if you were me?
Well, I'm no lawyer. But I'd be angling for a screen credit and may a few
thousand to go away. Definitely credit. Credit is everything in the
writing world...

Brilliant! I think the EAC should forge a new medal just for Elroy!
Indeed! However, I think he should also consider suing HBO! ;)
Might have a shot. Hollywood's seriously touchy about this kind of thing.
And I've seen some much weaker claims result in some beefy settlements.
I just *do *not believe they came up with their version independently.
It's too close and Elroy's story has been flying around so much, it had to
be debunked by Snopes! <g>

These folk are supposed to have someone in the office who takes care of

floating around the Internet, it's "public domain." Which just isn't true.
(Myself, I would have gone after the WWN, they paid someone--not the
author--serious cash for the story)
