CAIR SEEKS FBI PROBE OF ‘HATE CRIME’ AT TN MOSQUE
Political, religious leaders asked to repudiate growing Islamophobia
(WASHINGTON, D.C., 4/10/07) — A prominent national Islamic civil
rights and advocacy group today called on the FBI to investigated what
Tennessee law enforcement authorities are calling a “hate crime”
targeting a mosque in that state.
The Washington-based Council on American-Islamic Relations CAIR said
worshipers at the Islamic Center of Clarksville found a defaced copy of
the Quran, Islam’s revealed text, on the front steps of the mosque just
before communal prayers (Jummah) on Friday. Two strips of bacon, which
is prohibited for Muslims to eat, were smeared in the Quran. Local
police are investigating the incident as a hate crime.

But to ponder about the legalities:
Suppose I live opposite a mosque. Now I start burning a cross in my
garden, say five minutes before they start showing their asses to
allah. Would that be legal in the US?
In Holland this would be a hate crime for sure.

Just like if you deface your own quaran in your own home, it's not a
crime. But that's not what has happened in either case.

Burning a cross is no crime, unless one burns it in front of someone's house
or otherwise makes it plain that a particular person or specific group is
being threatened. Foe example, one may burn a cross on one's own lawn. But
to place it front of someone (presumably a black person in this case) is a
form of threat an may be prosecuted. I suppose the person who left the
Koran there could be charged with littering, but that's about it, unless an
intent to threaten the mosque or congregation can be shown.
BTW, does anyone else consider this "news" reporting when phrases like,
"Islam's revealed text" are included? Does the author have evidence that
the text is "revealed?" Of course not! Sounds a lot more like religious
cheerleading and editorializing to me.

to place it front of someone (presumably a black person in this case) is a
form of threat an may be prosecuted. I suppose the person who left the
Koran there could be charged with littering, but that's about it, unless an
intent to threaten the mosque or congregation can be shown.
So it's okay if someone leaves a copy of "Mein Kampf", "Protocal of
Elder of Zion", and a plate ful of lobsters, bacon and eel in font of
a synogouge right?

hate crime for Fred because technically no one got hurt.
Actually, for once he has a point. It can't be a hate crime if no
crime was committed. If the Quran was owned by he people who placed it
there, and they placed it on the front steps, no crime has been
committed. A burning cross at least amounts to trespass. Both acts,

I just had a thought (yeah yeah insert witty rejoiner here "miracles
do happen" etc) - they could probably be done for littering. and
possibly trespass - if the Mosque is regarded as private property.
Although I suspect littering is a misdemeanor rather than a crime

I believe that they can't charge somone with trespass on the front steps
of a building unless there is a locked gate. IANAL.
And I'm suspicious, too, of anything involving CAIR's victimology. I
wouldn't put it past them to have put the baconized quran there
themselves.
