The Newdow case caught the religious right off guard.
They didn't expect that anyone would challenge it beyond the District Court
and they sure didn't expect a Circuit court to overturn that District
Court. They also know that the USSC didn't address the merits meaning its
still ripe to be challenged again.
They are not going to be caught off guard again.
In every circuit they are going to be pushing hard to get as many religious
based things into the courts as they can while things are learning in their
direction. Expect an increasing number of cases being filed across the
country in all areas, Bible study & prayer in public schools, Creationism,
the whole list of things they have been fighting for since the 50-60s
They will want to get as many into the courts and as many into the higher
courts, even the USSC while it is favoring their positions. They will risk
losing on some so long as they know the odds are good they will win more
than they will lose especially as Bush appoints more and more federal
judges and Justices over the next four years.
The name of the game is gat as many thing as they can into the courts
because even they know this too will pass. Thus a different time period, a
different court will overturn some of the things they get upheld not.
Thus, the more things sent to courts the more things that might ultimately
survive that next time, that different court.
After all, look how long it has taken the other side to reverse the few
things from the Warren court that they have managed to get reversed so far.
They have made major progress so far only in the area of supporting
religion with vouchers, etc.
Now they are going to begin to focus on all the other areas.
