Well, I wrote three messages, two of which I wrote before the banned one. I
see (as myself I cannot even see the board now, but obviously I've got more
than one computer) that not one of them went on.
I made a point by point discussion of how the moderators ought to have been
bound by HDS' word to me (assuming he's not a fictional person, although
even a fictional person ought to be tied to his word) I made a point about
why these policies are substandard to the standard I myself have, where your
own comments criticising me are still up, paid for by me, on my forum in
perpetuity because I believe that Right of Reply is central. That is the
standard I set myself and live up to, and it is clearly higher than the
standard of the three mousequeteers who have taken over from HDS.
Had they had answers to them, they could have given them, especially as at
the end I said I was all done. As my arguments were convincing and blasted
their approach out of the water, they had no option but to proceed with
their Soviet style banning not just of that post, but of two other ones made
chronologically earlier which did not breach the rules.
I find it weak, quite frankly. They should be able to stand up for
themselves by force of argument. Instead of which one bunch of people wants
to ban me from posting and another bunch wants to come and fill my face in.
And all this proves me wrong how, exactly?
You say I deserve the banning, you say I deserve the threatened *****-kicking,
so how does this square with your idea that the way to deal with me is to
face my so-called false beliefs head on? By banning me, JCSM Watch has run
away from me, like bold Sir Robin. They will be able to talk about me, but
as long as I use this computer I won't even be able to see what they are
saying. And you call _me_ a coward and a phony. Well, you people are all the
same, as far as I can see. Which is scarcely surprising of course, as many
of you literally are the same person.
You say I am denying certain sections of society freedom of speech because I
don't want them parading around dressed up as transvestites in front of my
kids, but I have given absolute right of reply except for blasphemy and
holocaust denial in every forum I have managed, maintaining messages
critical of me at my own expense to perpetuity, whereas scratch one of you
liberal freedom of speech guys and up pops the Homo sovieticus with his pen
of censorship like a jack-in-the-box.

James's response was nothing more than a rehash of earlier complaints
that were already expressed and answered fully, as well as unjustified
and unevidenced allusions to David's personal integrity and that of the
moderators and members of the group. He did not make any new
arguments. He did not rebut David's comments about the recognized need
for an evolving and changing moderation policy. He simply reasserted
his same complaints and insisted that the "inheritors" of the group
were obligated to keep David's "promises," specifically those allegedly
expressed to James. Obviously, this isn't really a "free speech" issue
as much as James would like to represent.
On that subject, I think anyone who's been around Usenet or the old
BBSing echos knows that posting in a moderated group is a *privilege*,
not a right. No one has an unfettered "right of reply" in a moderated
group that has a stated focus, as well as stated rules as to what is
permitted for discussion. What James does on his own bulletin board
system is immaterial. While the JCSM_Watch group is yet small, there
has been considerably more traffic there, so it's really difficult to
make those kinds of comparisons. And even James has said that he will
moderate (or censor, whichever word you feel is most appropriate)
holocaust revisionists and those who express "blasphemy" on his boards.
Who decides if it's "blasphemy?" James does, of course, and he has
that right; but obviously he has his line and we have ours. Why we
are somehow obligated to live by his is a complete mystery to us.
I won't bother getting into the hypocrisy of the whole issue with
respect to James and Gastrich, except to note that James knows full
well that Gastrich was known to censor his "chat boards" far more
aggressively than one will ever see at JCSM_Watch, and any banning of
persons is not as arbitrary as we saw on boards that Gastrich managed,
nor does it or will it ever happen simply because a party holds
positions that disagree with those of the moderators or other members.
It won't happen if the moderators are challenged on topical issues.
Those are things that Gastrich was known to do. Gastrich was also know
to use any and all means he could to silence his critics in other
venues. James certainly never criticized him for that. In the remote
chance that he did and I simply never saw or don't recall it, he'd
never engage in such a public display as we've seen in these threads.
James's first banning was a mistake which I should not have made, in
part because he was not aware of the boundaries to which the moderators
and the founder agreed. There is nothing in an evolving, growing group
that requires that all "promises" made are immutable into perpetuity.
James was not posting when David agreed to the moderation changes, and
there was never any need to consult him in any case.
It's already been observed that James posted an offending message to
the group, almost certainly knowing that much of the content was
against moderation policy. He submitted it, anyway, and almost
certainly knew that there would be reprisal. That he ended his litany
of off-topic complaints with a claim that there would be no more from
him on the subject is irrelevant. It shouldn't surprise anyone that he
cannot reproduce this article and can only make claims to how "good" it
was. James is on record as claiming that he "writes to be read," as we
all do, and no doubt the basis for his complaints is mostly that his
self-assumed "pearls of wisdom" never saw the light of day--at least in
JCSM_Watch. The reasons for that are simple: It was mostly off-topic
and, as such, it violated the rules for posting about which James could
no longer claim ignorance. It was not posted in edited form because we
don't edit posts. Some off-topic meandering is expected and
permissible even in the most firmly moderated forums, but James went
well beyond that. Any reasonable person would know that posting in a
moderated group carries with it the tacit understanding of moderation
policies and the tacit agreement with those policies. Violating that
policy *again*, especially after the controversy that James created
over the whole thing the first time, was nothing more than an attempt
to disrupt the focus of the group. Again, there is no absolute "right
of reply" in a moderated group. There never has been.
Those things and James's obvious problems with communcation in the open
groups, as well as his attacks on David, were the reasons he was
banned. If he feels this was unjust, he is free to appeal to any of
the three moderators, and they (we) will take it up in private. If
there is a simple majority to lift the ban, it will be lifted. Those
are David's instructions. Outside of that, given James's frequently
revealed loathsome and underhanded character, I will read none of his
comments and I have nothing more to say on the matter in public.

I already gave the salient points.
Key concepts:
1. Sienkiewicz acquiescing in breach of his promise to me by inheritors, but
then I knew all along that promise would never be kept, which is why I
didn't post there at first and I don't know why I gave them the benefit of
the doubt later.
2. Right of reply is central if you are not going to be accused of just
libelling someone
3. When asking for the right of reply, and for non-censorship where no
personal attacks and bad language are there, I am asking for less right of
reply than I offered myself, and I quoted my own site where personal attacks
against me are up there uncensored over a year on and at my expence kept at
full view for anyone going to my site. I am only asking for the same
treatment as I give.

Well I've given you the gist of it.
I'm not even supposed to be on JCSM Watch now, and can only see it off other
computers, so it's not very convenient for me even to try and reconstruct
what I said fitting it around HDS words, which I quoted in full and laced my
answer around.
The moderation policies are aimed at keeping their victims mute. They are
craven. Utterly craven. They have no right to sit and judge Jason or me or
anyone else. And God will deal with them.

Watch is a huge plus. It is almost impossible to keep track of
Gastrich's and others transgression on usenet, even if google
is your friend. There is just too much noise. I endorse Dave's
efforts to keep the noise to a minimum in JCSM so lurkers can
find the meat of the arguments. Whinging (good British
word) just adds to the noise. Some of the post below seems to
be in that category.
It also seems a bit hypocritical for anyone from the
fundamentalist camp to complain of not being allowed to post.
They regularly edit and block users from their discussion groups
and guest books, although, I would not accuse Davey of this
practice, he does seem to hang all his dirty laundry out for others
to judge. For that I give him credit. However, it's not unusual to
see absolutely no critical posts in their groups? JCSM Watch has
not even come close to such blankets bans. Just stay on topic.

The moderation policies seem to say that
discussing moderation policies
in the group is not permitted
Which I say is a fundamental breach of free speech, and in the
forums I have I promised to allow much more freedom, even
though I'm the " " "fundy" " " around here, to which they
reply, it's not my group, it's their group, they can do what they
like. It seems that Saddam Hussein or that Pinnochio guy in
Chile could say the same words justifying the lack of free
speech in their countries "you don't own this country - I do. So
grow up."
It all comes down to RIGHT OF REPLY. I would be ashamed
not to grant it, and I defy anyone to show me a place where I
have denied someone right of reply to anything I have ever
said on the net

group, that's a standard policy, and
I defer to his expertise in that
matter. He and Dave have actually
moderated discussion areas before
Well that concerns me, since right of reply is central, and you
know as a lawyer as well that (well maybe this is not the case
in US law, I cannot say, but it is in our law) having given right
of reply is a major meliorating factor in any libel case

will find undoctored (by me anyway) criticisms of me by
Frank Pericope and Carson West, posting as a guest, slightly
more than a year ago
It was beneath me to censor their words, or even limit the time
that they are showed. I am even paying to have their criticisms
of me publically aired for all to see who visit my site
I don't see anything in the comments
that indicate that Davey will be
needlessly "censored" and Carson has
already exposed his hypocrisy in
that regard. Davey's bigoted comments
against the homosexual community
in his chosen home country are fine
cases in point. Such things make
it difficult to have much sympathy for
complaints about censorship and
how his "freedom of expression" has
been "oppressed."
I must admit that when I saw today that a number of the
people who came out and threw stones at them were neo-nazis
I did get a very bad feeling about it. At the end of the day I
never set out to make a special case about them, and I'm far
from sure it was even me that brought them up this time
I have discussed this in chat and
email with Dave, and I support his
decisions. Furthermore, let me say
that the reason I left three
managers in charge was that if one
makes a decision and the other two
don't agree with it, they can override
that decision

I respectfully suggest that the three
managers decide on a mechanism by
which a member of this group can grieve
a moderation decision, but I
still support that moderation policies
are not an open topic of
discussion

I just had to reject a lengthy message posted to the group. I'm
a moderator, not a babysitter, but when I say that moderation
policies are not fodder for discussion in the group, I mean
that.
And *certainly* messages that question the very existence of
another person in this group are not topical nor will they be
allowed. Nor will messages be posted that question the
integrity of the moderators, the founder, or the intent of the
group with respect to those things
Following David's lead, I do not edit posts. If they don't fit
the scheme of things as required for topicality and to stay
within the rules, they will be rejected out-of-hand
"Uncle Davey" may as well restart his "boycott," because he's
been banned.
I feel better about it now that at least my point has been made here.
I think having it so that you can talk away about me and me not even see it
isn't fair, but you'll have to make your own minds up about it.

Personally, i thought it was just a ban to post. I did not know it
also stopped you seeing the content. i have not been in contact with
Dave but I doubt the ban is permanent. Also, and you can check with
another google I.D., there is no talk of your ban or issues on the
group. I don't see the group as a chat group, more a depository for
information.
