A compromise could be made on the splitting of the 9th by
redistricting. (It happens every 10 years for electors, shows that it
needs to be done) If Kansas and Oklahoma were in the 8th, then Montana,
Idaho, Nevada, Arizona and Alaska could easily be added to the 10th
with only the addition of a few judges. Based on the number of filing
this would be very feasible. This could prevent the construction of a
new bureaucracy, ease the courts caseload, and prevent the complete
break up of the 9th.
Another redistricting idea would be to include Oklahoma and Arkansas
in the 5th, Kansas to the 8th, and Arizona, Nevada, Idaho Montana, and
Alaska to the 10th. Washington and Oregon could also be added to the
10th or left in the 9th dependant upon caseloads.
