Rhode Island's Supreme Court has disqualified the legal basis for a petition
asking that two women who were "married" in Massachusetts be granted a
same-sex divorce, ruling that the state's legal definition of marriage only
defines it as between a man and a woman.
The court's interpretation also means that lower state courts do not have
the authority to consider such a petition, which is the question that
brought the divorce suit Chambers v. Ormiston to Rhode Island's high court
in the first place. Rhode Island Supreme Court justices wrote that "the role
of the judicial branch is not to make policy, but simply to determine
legislative intent as expressed in the statues enacted by the General
Assembly."
The two parties filing, Margaret Chambers and Cassandra Ormiston, are each
unopposed by the other -- filing together, in essence, to request that the
divorce be granted. The two women were married in Massachusetts in May 2004.
In light of that, Christian public-interest law coalition Alliance Defense
Fund (ADF) has accused the couple of trying to create a test case as a
backdoor method to force state acceptance of same-sex marriage. Senior
counsel Austin Nimocks says ADF warned of that in its August
friend-of-the-court brief.
According to the attorney, except for some of the press coverage on the
matter and some efforts by ADF and other allies, "nobody ... was going to
oppose what they were asking for in the courts." Including Rhode Island's
attorney general, who alleged the divorce law did not prevent granting of
the petition and supported the women's suit.
"[But] that's absolutely false," asserts Nimocks. "The Supreme Court of
Rhode Island has made it clear that any divorce must be based on a valid
marriage."
The ADF attorney said Friday's ruling is a victory for marriage and step
forward against judicial activism. "Divorce is an important social remedy,
whether people want to admit that or not," he laments. "It's not a
fix-it-all for every relationship, and that's exactly what these women are
asking for: a divorce to fix something -- and they don't have a valid
marriage to begin with."

Besides, you shouldn't oppose to gay marriage since that's your only

It is merely a semantic problem. The two women are perfectly free to walk
away from each other, but they cannot "divorce" since they are not married.
There's an old saying, "What goes up must come down." Science has shown
that while it isn't always true, it is true often enough to make parables
out of it -- it cannot come down until it has gone up. This is not a
"problem" it is just a fact of life.
