SAN FRANCISCO, Nov 15 (OneWorld) - Human rights lawyers were joined by
two winners of the Nobel Peace prize in filing charges in Germany Tuesday,
accusing outgoing U.S. Secretary of Defense Donald Rumsfeld of committing
war crimes in Iraq and the U.S.-controlled Guantanamo Bay prison camp
in Cuba.
The criminal case is being brought under the legal doctrine of universal
jurisdiction, which says that crimes against humanity may be tried
anywhere in the world.
It is the second time human rights lawyers have filed charges against
Rumsfeld.
Last year, German courts dismissed a similar complaint against the Secretary
of Defense on the eve of his visit to the European nation.
Michael Ratner, president of the New York-based Center for Constitutional
Rights, says new conditions caused his organization to refile the suit.
He points to the recently passed Military Commissions Act, which exempts
from prosecution for torture or war crimes any U.S. government official
for activities beginning September 11, 2001.
