Sandra Day O'Connor, the first woman Supreme Court justice and a decisive
swing vote for a quarter-century on virtually all the major legal issues of
our time, announced her resignation today.
Because she is a moderate, her departure gives President Bush a major
opportunity to alter the direction of the court if he so chooses...

She's not just ``a moderate,'' she's the swing vote on the
court. Tally up all the 5-4 decisions and the overwhelming
majority of the time she's the fifth one.
This is not good news. Not good at /all./ I can only hope that the
impeachment starts before the confirmation hearings. Fat chance, I
know.

I agree. I wouldn't mind seeing another centrist. If he nominates a
neocon theocrat, the Democrats ought to dig in their heels and try to
hold out until next year when they have a slim chance of taking back the
Senate.

it consists in professing to believe what one does not believe. It is
impossible to calculate the moral mischief, if I may so express it, that
mental lying has produced in society. When man has so far corrupted and
prostituted the chastity of his mind, as to subscribe his professional

Teddy Kennedy was the most explicit. If Bush doesn't come begging the
Democrats for a nominee ahead of time he can expect a HUGE fight.
One of the commentators on the TV last night hit it right on the head:
every interest group with concerns about Court precedents has been
brewing up their talking points for eleven years (since the last justice
was appointed) and now they're going to trot them all out for the
cameras.

meaning "ask us for our short-list".

They never promised to "unite" so they're just holding up their end
of the bargain. It's all up to Bush to do all the "uniting" by
giving the losers their way on every issue. Such is what passes for
Liberal thought these days.

Yes, that's about the way I read it.
Oh well, Frist can always fire up the nuclear option again.

I think he screwed that one up. Who's gonna believe it if he tries it
again? (sigh)

I think he played it just right. If Frist hadn't been threatening to go
nuclear, the Democrats in the Gang of Fourteen would have never budged
and the five judges they approved would still be cooling their heels. As
it is, Frist didn't have to actually push the button, and now the
Democrats will look even more like obstructionists when they filibuster.

Ther worst part about today's fillibuster deal is that the party doesn't
need to fillibuster in the traditional sense. They just announce that
they're playing the fillibuster card. I think that drama has its uses in
politics and forcing Senators to man their posts 24x7 listening to the phone
book or whatever is a valuable way to attract public attention. It's one
thing for Mr Smith to constipate the government to save a boys' camp from
the corrupt pols, it's another for them to see it being done by corrupt pols
to prevent a President from appointing a qualified justice.

Sandra Day O'Connor, the first woman Supreme Court justice and a
decisive swing vote for a quarter-century on virtually all the major
legal issues of our time, announced her resignation today.

Because she is a moderate, her departure gives President Bush a major
opportunity to alter the direction of the court if he so chooses...

By, no doubt, appointing a religious fanatic who puts his dogma far
and above the Constitution. A second Scalia on the bench of the
highest court in the land... happy now, Fred?

Bush's recent appointments haven't been all that far out.

We will have to see how the Democrats' filibuster tactics play out,
won't we?

I predict that the Dems will filibuster ANY judge who isn't obviously and
blatantly liberal, activist and loudly pro-choice... at the same time they
are criticizing Bush for using Roe V Wade as a "litmus test".

(shaking head sadly) My disbelief wasn't in the idea that the 'opposition

anybody thinks they aren't being very oppositional. In fact, downright

Dayum, Stoney, that's the best thing you've done that I've seen! You got
the water, I love the trees...you have the dimensions in there. Like one of
your responses, I'd like to go there to read a book.
Then again, maybe not. Rocks that mossy tend to be a tad on the wet side.
