Separation of church and state protects abortion
With all the negative attention Roe v. Wade has been attracting, I thought
I would add my two cents, with some actual legislation to back me up. In
1942, the Supreme Court ruled that the sterilization of certain individuals
(such as criminals) violated a fundamental right to procreate. Therefore,
if Americans have a right to bear children, how is that not to say they
also have a fundamental right to not bear children? And if such a right
exists, how could that not cover the means to avoid procreation
(contraceptives and abortion)?
Even more important than the right to privacy that Roe v. Wade represents,
is the abortion issue's connection to the most important of all the Bill of
Rights, the First Amendment and the right to religious freedom. More often
than not, religious and spiritual practices dictate one's belief as to
whether or not a human fetus is a person. If we are guaranteed the right to
determine our faith and thereby decide when life begins, how can government
regulation overturn that belief? Such a regulation would be equivalent to
setting a national religion. And as much as the Christian right would like
to see this happen, as long as abortion is seen as a moral issue,
anti-abortion legislation determined by "inherently religious beliefs" is
unconstitutional.
Defending abortion may make some people feel uncomfortable, but there was a
time when defending desegregation and racial equality was just as a
sensitive subject.
Sitting back and going with the flow is not, and has never been, an option.
The fact of the matter is: who are you to say that someone else is wrong?
"Pro-life" is a choice you made, based off your own experiences, family,
and faith. Who are you to deny someone else the right to make their own
choice?
