"A woman who had sex with her boyfriend's brother in her darkened
room late one night claimed she was raped, saying the man tricked her
into the act by impersonating her boyfriend.
"But Massachusetts' Supreme Judicial Court disagreed Thursday,
citing a half-century-old state law that says it is not rape when
consent to sexual intercourse is obtained through fraud or deceit."
I guess this isn't surprising in a state where they used to hang
"witches".

The MA Superm Court was in error, since the consent was not to have sex
with that particular person; therefore there was no consent.

It looks like the MS Sperm Court's position is that she *did* consent
- I guess she didn't say "No!" at any time during the rape. Or is it
the court's posiiton that if you don't know you're being raped then
you're not being raped? It seems to me they've opened up a loophole
for all kinds of abuse - for example, if someone drugs you and rapes
you, then is that not rape?
I wonder what the makeup of the court is gender-wise? Would it have
made a difference to the decision if there had been a majority of
women, and what does it say about our society if it would have?

Actually it was probably an attempt to prosecute the imposter, and the Court
decided he acted under "color of law", so that the case against him was not
proveable. It is hard to know the legal issues without a good familiarity
with such a case. Not that I am particularly interested. I imagine the court
to be made up of fuddy-duddy stuffed short males, it being Massacussits.

I agree, but you got very close to an embarrassing Freudian slip at

Question: How many Freudian psychologists does it take to change a
lightbulb?
Answer: Two. One to hold the lightbulb and one to turn the penis.
Uh, I mean ladder.

Those two shrinks bump into each other in the hallway:

But they did apologise for it not long afterward.
