Sex victims to be protected from court

New laws protecting alleged victims of sexual assault
from courtroom trauma will go before the Victorian
parliament this week. Under the proposed bill, children
and people with cognitive impairment will only be
required to give evidence once and will not be cross
examined at pre-trial committal hearings.
If their case goes to trial, child sex victims would be
able to give their evidence and be cross-examined
beforehand.
A video recording of that evidence would then be
made available for the trial.
In other changes, accused sex offenders who represent
themselves in court will no longer be allowed to cross
examine their alleged victims.
As well, new laws will increase penalties for people
convicted of "grooming" or procuring and soliciting
children for sexual purposes.
Attorney-General Rob Hulls said he hoped the changes would encourage more victims of
sexual assault to come forward.
"They will realise that they will be treated with the utmost dignity and respect by
our justice system," he said.
"In the past victims of sexual assault, particularly kids, people with cognitive
impairment, have been further traumatised by the judicial proceedings."
But Mr Hulls also called for a "cultural change" in the way the judicial system and
defence lawyers treated alleged victims of sexual assault.
Child sex victim Charlene, now an adult, praised the proposed changes at a public
launch on Tuesday.
Charlene, who cannot be fully identified for legal reasons, said her experience
working with the state's sexual assault sentencing advisory committee had helped her
recover from her trauma.
She said she had been assaulted hundreds of times over a nine year period.
"One of the worst things about being a victim of sexual assault was how worthless it
made me feel," she said.
"At time the sense of worthlessness was overwhelming and paralysing.
"I hope that one day other victims of sexual assault feel listened to, understood and
valued as a result of their experience of the criminal justice system.
"We need to understand that for victims of sexual assault their experience of the
criminal justice system is but one step on their journey from victim to survivor,
from survivor to feeling like a whole, worthwhile person."
Current soliciting and procuring offences will be expanded to cover the activities of
paedophiles who prey on children on the internet, and the maximum penalties will be
increased to 10 years.

We show a film of a well dressed businessman who was "allegedly" robbed
being interrogated on the stand. His nice suit, flashy watch and the fact
that he was in a wealthy neighborhood are all brought into question as the
defense tries to prove he was asking for it because of the way he was
dressed.
We had a case where the woman was raped on a city street with people
walking by and it didn't go to trial.
