Understood, however there is legal precedent for demanding that a judge
recuse himself from cases when he/she has shown significant bias towards
the issues involved.
U.S. Code : Title 28 : Section 455
"Any justice, judge, or magistrate judge of the United States shall
disqualify himself in any proceeding in which his impartiality might
reasonably be questioned."
Scalia has said numerous things showing his bias, but I believe the most
telling is, "There is something wrong with the principle of neutrality."
He said that neutrality should not be considered, "neutrality between
religiousness and nonreligiousness; it is between denominations of
religion."
Those statements clearly illustrate he has no intention of being a fair
and neutral judge of this issue when it comes before him.
