NORRISTOWN -- A former Upper Dublin pastor remained stoic on his day of
judgment Friday when a judge determined he maliciously used a carpenter's
level to beat a 4-year-old boy to death in 1999.
Javan Morley McBurrows, 52, former pastor of the Third Christian Church in
Philadelphia, showed no emotion as Montgomery County Judge William J. Furber
Jr. convicted him of third-degree murder in connection with the Jan. 9,
1999, death of toddler Michael Davis, a parishioner's son who was living
with McBurrows' family at the pastor's Linden Avenue home.
Furber acquitted McBurrows of first-degree murder, an intentional killing,
which could have carried the prospect of a life prison sentence or the death
penalty.
Third-degree murder, which is punishable with a possible 20 to 40 years in
prison, is a killing committed with malice but without intent. The judge
determined McBurrows acted with a depraved heart, a wicked disposition or a
reckless disregard for the consequences of his actions when he beat and
killed Michael.
Erika Davis, Michael's mother, wept when the verdict was announced. She left
the courtroom without commenting to reporters.
McBurrows was also convicted of multiple counts of simple assault for
beating his wife, Jane, four of his own children and Michael's two siblings,
who were also staying in the McBurrows' one-bedroom, one bathroom home. He
was also convicted of six counts of endangering the welfare of children
between September 1998 and January 1999.
"To God be the glory. I can close this chapter now and my children and I can
go on with our lives," said Jane McBurrows, reacting to the verdict.
"Michael can rest now; Michael can rest. I'm rejoicing. I thank God."
Furber deferred sentencing so McBurrows could undergo a presentence
evaluation, which will help the judge fashion McBurrows' punishment. If the
judge gives McBurrows a lengthy sentence for the murder and consecutive sent
ences for the assault and child endangerment convictions, McBurrows could
find himself behind bars for the rest of his life.
Deputy District Attorney Christopher Maloney said he plans to seek the
maximum sentence possible.
"I anticipate we'll be asking for the statutory maximum sentence given the
nature and extent of his abuse, not only against Michael Davis but also
against the other members of the household," said Maloney, who was assisted
by prosecutor Barbara Ashcroft. Defense lawyer Garrett Page indicated it was
premature to discuss whether McBurrows will appeal the third-degree murder
verdict.
"The reverend has been faithful throughout this process. I'm not sure if
(the verdict) has registered totally with him yet," said Page, adding he
plans to discuss post-sentencing options with McBurrows at a later date.
"He is a man of faith and a man who will look upon his God to determine how
he goes on with the rest of his life. He's a man of prayer and faith and I'm
sure he'll get through this."
During the non-jury trial, McBurrows, with the deep, soothing voice
reminiscent of his vocation, denied that he killed Michael and denied
beating his wife and children. The fifth generation of a family of pastors,
theological professors and evangelists, McBurrows said he would not harm a
child and that "the vision" God gave him was to give underprivileged
children balanced meals. McBurrows implied that his wife caused Michael's
fatal injuries and he claimed to be napping when Michael was beaten.
However, prosecutors said all evidence pointed to Javan McBurrows as Michael
's killer. Jane McBurrows was not charged with any crimes.
Jane McBurrows, the prosecution's star witness, testified she saw her
husband strike Michael between five and 10 times on the buttocks and lower
legs with a 24-inch metal-encased carpenter's level. Prosecutors contend the
beating occurred because Michael entered a bathroom where McBurrows'
daughter was undressed for a bath without closing his eyes. Jane McBurrows
said the pastor also forced the injured boy to march in the snow and rubbed
snow in the boy's face after the beating.
"The pain and torment that the little boy must have suffered is just
immeasurable in my mind, as a mother and also as an assistant district
attorney," said Ashcroft.
The beating Michael endured essentially pulverized the child's fatty tissue
into a bloody, liquid mass, Maloney alleged. Michael bled internally,
ultimately leading to hemorrhagic shock and death.

posting here that Evilutionism causes all manner of bad things in our
society including acne and Paris Hilton. This is certainly as on topic as
every post claiming that evolutionary biology caused the rise of both
Communism and National Socialism. Including a reference that the pastor
had preached against teaching evolution on such grounds would bring it
squarely on topic.

I would hope that we can learn from the actions of some unknown number
of U.S. military and politicians and not use "well, they do it" as an
argument. (Yes, that was a gratuitous slam. I am very upset about what
has happened to my country and what my country is doing to the world.)
It is bad logic, bad rhetoric, and bad tactics, to make rebuttals to
some unnamed person. If a specific poster makes the claim that only
evolutionists do bad things then showing someone else doing a bad
thing is a valid rebuttal. Without such a specific claim it is
inappropriate.
