If a patient never left a record of their wishes, and is unable
to express them, the decision falls on their next of kin. In the
case of a married person -- like Terri Schiavo -- the legal
next of kin is their spouse.
The legal next of kin for that baby in Texas -- Sun Hudson --
was his mother. In both cases Bush was on the wrong side.
It was wrong for Texas to use Bush's "Futile Care" law to
kill a six month old baby against his mother's wishes, just
as it was wrong for Bush to support a different law, one
that crapped on the wishes of Terri Schiavo's husband
(and nobody else).
In both cases Bush took the choice away from the next of
kin, or at least tried to in the Terri Schiavo case.

Perhaps because he has said, in writing, that feeding tubes should not be
removed. Even if he doesn't have a living will, his feelings on the
subject are clear.
