To whom does the Constitution apply? |
There is a great debate in the United States over whether or not
terrorists have the same rights as American citizens, or even if
terrorists have any rights under the Constitution at all. President Bush
has maintained that captured terrorists are enemy combatants, and do not
have the rights an privileges guaranteed by the Constitution. Bush is so
adamant that terrorists do not have rights under US law that they are
imprisoned at Guantanamo Bay, where Cuba technically has sovereignty even
though the United States has effective legal control.
Another popular claim is that captured terrorists are actually prisoners
of war. Prisoners of war do not typically get to challenge their detention
and so captured terrorists must be held until hostilities have ceased.
Some even go as far as claiming that not even illegal immigrants have
rights under the Constitution, because the Constitution only applies to
American citizens.
I maintain that the Constitution applies to the federal government, and not
to any type of person at all.

On what do you base that assertion? Historically, full rights of

Constitutionally, the only right of citizenship is the right to
participate in the polical process.
Not at all. The rights enumerated in the Bill of Rights, although only
given implicitly, are still our rights. The Bill is part of the
constitution -- it was not ratified until they were included.
Historically, although I suspect you will deny this, the Bill of
rights was written specifically to address the concerns of those who
did not trust the government to allow the rights the Federalists
believed were inherent in the original document. The Anti-Federalists
insisted on a bill outlining our rights, and they won. The Bill was
written to enumerate our rights, despite the language that you think
only limits government conduct. Language and style change, but the
historical fact is that the Bill was meant to enumerate the rights I
claim.
The amendments protect our rights by telling the government what it cannot
do.

Which Bill of Rights were you reading???
The Bill of Rights is a list of things the federal government may not do.
1. Make no law abridging freedom of speech, press, religion, or
assembly.
2. Do not infringe on the right to keep and bear arms.
3. Don't quarter soldiers in peacetime.
4. Don't conduct unreasonable searches and seizures.
5. Don't commit double jeopardy or force people to testify against
themselves.
6. Don't deny an accused a speedy trial.
7. Don't deny an accused a trial by jury.
8. Do not impose excessive bail.
9. Just because certain rights of the people aren't mentioned in this
Constitution doesn't mean you're allowed to usurp them.
10. Don't exercise any power not authorized in this Constitution.
Many did not want a Bill of Rights because they assumed it was implied in
the rest of the constitution that the government had no power to infringe
on those rights.

What did they do wrong?
It's what they didn't do. They didn't finish the job. Many of you
cannot recognize an unfinished intellectual job because there are so
few "finished" jobs on the Earth today to compare it to.
The process involves perseverance, a sense of personal integrity, your
experience, and a certain ability to grab a new concept out of thin
air where previously everyone was "clueless". The founding fathers had
all this going for them ... yet they did not finish. They were lacking
in one item. They stopped short and called it quits. They did not
"persevere".
My personal estimate is that they stopped working on the constitution
2-6 months prematurely

Cuba should make it illegal to hold the prisoners in Guantanamo Bay
without trial. That would put Bush in the position of trying to claim
that Guantanamo Bay is not part of the US _and_ not part of Cuba.

The Constitution applies to all people, to the states, to the federal
government. It is an enabling act setting up a central government and
limiting it, while guaranteeing people and states the protections of
their rights.
After the 14th Amendment was passed many of the personal rights
guaranteed against the federal powers were also guaranteed against the
states' powers. And if you will look at the pertinent part of the
14th Amendment you will see that you are not required to be a citizen
to enjoy its protections. Note that the 14th makes a distinction
between citizens and persons (who may or may not be citizens. And by
this time every black person was a PERSON, not a fraction of a person
as the courts held before the Civil War):
1. All persons born or naturalized in the United States, and subject
to the jurisdiction thereof, are citizens of the United States and of
the State wherein they reside. No State shall make or enforce any law
which shall abridge the privileges or immunities of citizens of the
United States; nor shall any State deprive any person of life,
liberty, or property, without due process of law; nor deny to any
person within its jurisdiction the equal protection of the laws.

For Bush to redefine a person as an enemy combatant and deny him the
protections of due process of law, or of the Geneve Conventions is
something right out of George Orwell's _1984._ Which, if you haven't
read it, you should read it now.
