Trial begins over death of Christian who questioned homosexual
lifestyle choice
Mary Stachowicz was attacked with such ferocity the assailant's hunting
knife blade was bent, but a defense attorney for her alleged attacker
is painting her with the blame, saying it wasn't a "hate crime" and it
happened because her comments about his "gay" lifestyle assaulted the
man.
And since it was only a routine murder case, not a "hate crime," the
story is getting almost no coverage from mainstream media outlets,
several conservative groups have noted.
The murder trial for Nicholas Gutierrez, 23, in Stachowicz' 2002 death
has begun in Chicago, where prosecutor Jim McKay described the
viciousness of the attack on the 51-year-old mother of four and
faithful Catholic Church member.
She was stabbed, strangled, raped and beaten, and then her body was
stuffed in a crawl space under the floor of an apartment, he reported.
But the suspect's attorney, Crystal Marchigiani, alleged in her opening
remarks that it was Stachowicz who attacked Gutierrez, and her verbal
assault was what sparked his response.
"It happened because she could not leave him alone in his (homosexual)
lifestyle," she said, describing the apparent confrontation between the
two at the Sikorsky Funeral Home where Stochowicz worked and where
Gutierrez lived in an apartment with his partner, Ray.
"The Gutierrez defense team's Politically Correct courtroom ploy ought
to be called the 'Anti-homophobe Panic Defense,'" said Peter LaBarbera,
president of Americans for Truth, a pro-family organization.
"Marchigiani's is an ugly attempt to exploit the liberal caricature of
Christians who oppose homosexuality as crazed haters with a penchant
for aggression."
"So here we see a new defense tactic: stoking the flames of
anti-Christian bigotry to save a 'gay' murderer from the punishment he
deserves," he said.
According to a report from the Culture and Family Institute, weblog
postings after the murder were full of anti-Christian hate statements.
"I really don't feel sorry for her. She paid a very steep price for
being an arrogant religious fascist. Too bad for her," said "Iris" in a
posting on the ACLU Online Forum.
"Maybe this will give pause to other people who similarly try to 'help'
homosexuals," said "Silence Dogood" on the same forum.
"The mainstream media and homosexual advocacy organizations have
reacted to Mary Stachowicz's murder the same way they did to
13-year-old Jesse Dirkhising's torture-murder at the hands of two
homosexual men in 1999: by avoiding it," said Allyson Smith of the CFI.
She noted that there was no condemnation of the murder from Human
Rights Campaign, the National Gay and Lesbian Task Force, or the Gay
and Lesbian Alliance or the Lesbian Alliance Against Defamation.
One pro-homosexual group, Soulforce, which works in churches to oppose
traditional Christian views of the sexual lifestyle, did make a
statement to a newspaper, even though it did not release a press
statement.
"We condemn this murder, like we do all murders," said Laura Montgomery
Rutt, but "a hate crime needs to have an intent to intimidate a whole
class of people."
Chicago police reported that on Nov. 13, 2002, an argument broke out
between the two and when Stachowicz asked why Gutierrez had sex with
"boys instead of girls," he erupted in rage, punching, kicking,
stabbing and strangling her.
He later led police to the body and confessed.
National Review Online writer Rod Dreher has lamented that the media
buzz about the case has been deafening by its silence.
According to Dreher, "One cannot help wondering if the upright citizens
who report the news don't privately share the view of 'gay' blogger
James Wagner, who said of Stachowicz's strangling: 'The woman who did
such great evil is dead, but unfortunately the evil and the church and
the society which creates it is not, and it will continue to destroy
Nicholas Gutierrez and many others. I shake, safely sitting here at
home, fully understanding, and fully familiar with, the horrible impact
her words must have had for a man already so terribly damaged by his
society, and his own mother.'
"I believe many, and probably most, journalists share the unspoken
assumption that Christians bring such trouble on themselves," wrote
Dreher.
The Culture and Family Institute also quoted the victim's friend, May
Coleman, who said, "Those of us who knew her (could) hear her soft
voice saying something like, 'God wouldn't approve of the way you're
living your life.' That's how Mary did things."
Regional media outlets reported on the attack, but notably left out
words such as "gay" or "homosexual," the institute said.
Catholic League President William Donohue said the murder is not listed
as a hate crime, and won't be, even though she "was murdered for having
a Catholic-informed conscience."
"Mary Stachowicz will never be remembered the way Matthew Shepard is,
thus showing how politically corrupt the whole concept of hate crime
legislation really is."
LaBarbera said the woman "is a modern day martyr who died because she
told the truth to a man caught up in homosexuality. Her compelling
story is largely unknown to Americans, because the same media that
devoted millions of print column inches and broadcast minutes to
covering the Matthew Shepard murder case have largely ignored Mary's
story."
"The reality today is that growing secularist intolerance threatens to
redefine Judeo-Christian beliefs as 'prejudice, intolerance,' or worse,
'hatred.'"
Dreher wrote that the similarities in the cases couldn't be ignored.
"Where have we heard this sort of thing before? Why, when three redneck
men killed Matthew Shepard a few years ago, after the homosexual young
man propositioned them in a bar. Understandably, the men found
Shepard's words offensive," Dreher said.
He said there is no moral difference between Stachowicz' attack and the
one on Shepard.
"Both were heinous, and both deserve publicity, but the Stachowicz
case, like the case of Jesse Dirkhising earlier, is being largely
ignored," Dreher wrote. Dirkhising was a 13-year-old Arkansas boy
raped, tortured and strangled by a gang of "homosexuals" in 1999.
One researcher reported that in the month after Shepard's murder, Nexis
recorded 3,007 stories were available about the death. However, "in the
one month after Dirkhising's case, there were 46 stories."
"In Canada," Dreher noted, "Christians are having their freedom of
speech and worship taken away by hate-speech laws designed to protect
homosexuals from having their feelings hurt."

Wow. Some biblewonk spends her life going about disturbing people's
perfectly happy lives. Sooner or later, as is wont in a varied

New Details Emerge in Matthew Shepard Murder
Killers Talk About Crime That Shocked the Nation
Nov. 26, 2004 — - Six years ago, on a cold October night on the
outskirts of Laramie, Wyo., 21-year-old gay college student Matthew
Shepard was brutally beaten, tied to a fence and left for dead. He was
found 18 hours later and rushed to the hospital, where he lingered on
the edge of death for nearly five days before succumbing to his
injuries.
The story garnered national attention when the attack was
characterized as a hate crime. But Shepard's killers, in their first
interview since their convictions, tell "20/20's" Elizabeth Vargas
that money and drugs motivated their actions that night, not hatred of
gays.
While Shepard lay unconscious in a hospital, the national press
quickly arrived in Laramie. Cal Rerucha, who prosecuted the case, told
Vargas the media descended on Laramie "like locusts."
"We knew in the newsroom the day it happened, this is going to be a
huge story, this is going to attract international interest," said
Jason Marsden of "The Casper Star-Tribune."
"I remember one of my fellow reporters saying, 'this kid is going to
be the new poster child for gay rights," he added. News of Shepard's
death sparked reaction overseas and demonstrations across America.
"I think a lot of gay people, when they first heard of that horrifying
event, felt sort of punched in the stomach. I mean it kind of
encapsulated all our fears of being victimized," said writer Andrew
Sullivan, a prominent gay rights advocate.
But as the push for gay rights found new force, so did a corresponding
backlash from anti-gay opponents who came from out of state to grab a
piece of the media spotlight.
Tensions were so high that Shepard's father wore a bulletproof vest
under his suit when he spoke at his son's funeral service.
"The saddest part of this whole case was at Matthew's funeral, when
they, these people, refused to let Matthew be buried with dignity,"
said Rerucha. "I never saw people that could hate so much."
Killers Both Receive Two Consecutive Life Sentences
Local residents Aaron McKinney and Russell Henderson, both 21 at the
time, were charged with Shepard's murder. Henderson's case came before
the court first. To avoid the possibility of receiving the death
penalty, he pleaded guilty to murder and kidnapping and received two
consecutive life terms in prison.
McKinney's case went to trial a year after Shepard's death. He was
convicted of felony murder, aggravated robbery and kidnapping. Before
the jury was about to decide his sentence, he, too, reached a deal
that allowed him to avoid a possible death penalty. Both men are
serving double life sentences in prison.
Authorities asked "20/20" not to disclose the prison location.
While McKinney and Henderson admit to killing Shepard, both men -- and
the man who prosecuted the case -- now say the real story is not what
it seemed.
Many area residents were shocked that the crime was committed by two
young men from their community. But both McKinney and Henderson came
from classically troubled backgrounds.
Henderson was born to a teenage alcoholic and raised without a father.
He says he saw his mother being beaten up by a series of boyfriends,
some of whom also assaulted Henderson.
McKinney's childhood, too, was less than picture-perfect. His father,
a long-haul trucker, was rarely home and eventually divorced
McKinney's mother, a nurse who later died as a result of a botched
surgery. McKinney received a malpractice settlement of nearly $100,000
after his mother's death. He says he spent most of that money on
things like cars and drugs.
McKinney admits to Vargas that by the time he was 18 he had a serious
methamphetamine habit.
Shepard Haunted by Own Difficulties
Despite his strong family life, Shepard had troubles of his own. His
mother, Judy Shepard, says her son's problems had started three years
earlier during a high school trip to Morocco, where he was beaten and
raped.
"It made him pull within himself. He became withdrawn, depression,
panic attacks," she said.
Some of Shepard's friends say he was still a troubled young man when
he enrolled at the University of Wyoming in the fall of 1998.
Tom O'Connor, known as "Doc," who ran a limousine service and
sometimes drove Shepard, said just days before Shepard's death, Matt
told him he was HIV-positive and was considering suicide.
One of Shepard's college friends, Tina LaBrie, was concerned that
Shepard's depression might be somehow connected to involvement with
drugs. "He said 'Everywhere I move, it seems like I get sucked into
the drug scene,'" LaBrie told Vargas.
Laramie's Dangerous World of Methamphetamine
As a heavy user and a dealer, McKinney was well-known with the
methamphetamine crowd, according to Ryan Bopp, who was one of
McKinney's friends and drug associates at the time. By the fall of
1998, McKinney had blown through his inheritance and was now the
parent of a new baby with his girlfriend, Kristen Price.
"I think he was really torn because it is the desperation of getting
your fix or taking care of your family," Price said. In the days
leading up to the attack on Shepard, she said, McKinney was using
methamphetamine every day.
Bopp, who says he left Laramie and the drug world behind six years
ago, told "20/20" that he and McKinney had been on a drug binge in the
week leading up to the attack on Shepard.
"Aaron and I had been awake for about a week or so prior to this whole
thing happening ," Bopp said. "We were on a hard-core bender that
week."
Bopp also admits that a week before the murder he was so desperate for
methamphetamine, that he traded McKinney a .357-Magnum pistol in
exchange for one gram of methamphetamine. McKinney would later use
that weapon to beat Shepard.
The Night of the Crime
McKinney told Vargas he set out the night of Oct. 6, 1998, to rob a
drug dealer of $10,000 worth of methamphetamine. But after several
attempts, McKinney was not able to carry out his plan.
Henderson said he thought if he could keep McKinney drinking, he'd
forget the robbery plan.
But according to McKinney, when he encountered Shepard at the Fireside
Lounge, he saw an easy mark.
McKinney told "20/20" Shepard was well-dressed and assumed he had a
lot of cash.
Shepard was sitting at the bar, McKinney recalls. "He said he was too
drunk to go home. And then he asked me if I'd give him a ride. So I
thought, yeah, sure, what the hell," according to McKinney.
All three got in the front seat of McKinney's pickup, and Henderson
took the wheel. McKinney told police that at some point Shepard
reached over and grabbed his leg. In response, McKinney said, he hit
him with his pistol. "I was getting ready to pull it on him anyway,"
he said.
McKinney says he asked for, and got, Shepard's wallet, which had only
$30 in it. But even though Shepard handed over his money, McKinney
continued beating him.
When pressed by Vargas as to why he continued beating Shepard after he
had already taken his wallet, McKinney said, "Sometimes when you have
that kind of rage going through you, there's no stopping it. I've
attacked my best friends coming off of meth binges."
McKinney says he directed Henderson to drive the truck to a secluded
spot on the outskirts of Laramie so they could leave Shepard and have
time to get away. They stopped at a wooden buck fence and took Shepard
from the truck.
On McKinney's instructions, Henderson got a rope from the truck and
tied Shepard to a fence post. Henderson claims at some point he tried,
but failed, to stop McKinney from beating Shepard further.
In a statement to the court, Henderson said McKinney struck him across
the face with the gun when he tried to stop the continued beating of
Shepard.
Henderson retreated to the truck, leaving McKinney alone with Shepard
at the fence. McKinney tells "20/20" he fears these last blows he
dealt Shepard at the fence were the fatal blows.
New Fracas Leads to Arrest
McKinney took Shepard's wallet and his shoes, got back in the truck
and told Henderson to drive to town. He says his plan was to
burglarize Shepard's apartment. But when they parked the truck they
encountered two young men who police say were vandalizing cars.
Hostile words led to a fight and for the second time that night,
McKinney went on the attack.
One of the men was struck so hard his skull was fractured. The injured
man's friend retaliated, slamming McKinney in the head with a small
bat. Everyone fled, just before a police car happened on the scene.
Sgt. Flint Waters gave chase and grabbed Henderson. Then he discovered
some key evidence that would later be used to link Henderson and
McKinney to the attack on Shepard.
"I looked in the back of the truck and laying in the back of the truck
was a large-frame revolver. The thing was huge, like an 8-inch barrel
that had blood all over it. And there was some rope and a coat in the
truck; there was I believe a shoe sitting in the front. ... Seeing
that the gun covered in blood, I assumed that there was a lot more
going on than what we'd stumbled onto so far," he said.
With that much evidence and McKinney's later confession, the attack on
Shepard was not a hard case to solve. McKinney and Henderson were
charged with murder. The mystery in this story was not who did it, but
why?
Shepard's Friends Suspect Attack Was Hate-Motivated
Just hours after Shepard's battered body was discovered, and before
anyone knew who had beaten him, Shepard's friends Walt Boulden and
Alex Trout began spreading the word that Shepard was openly gay and
that they were concerned the attack may have been a gay-bashing.
Boulden told "20/20" in an interview shortly after the attack in 1998,
"I know in the core of my heart it happened because he revealed he was
gay. And it's chilling. They targeted him because he was gay."
Prosecutor Rerucha recalls that Shepard's friends also contacted his
office. Rerucha told "20/20," "They were calling the County Attorney's
office, they were calling the media and indicating Matthew Shepard is
gay and we don't want the fact that he is gay to go unnoticed."
Helping fuel the gay hate crime theory were statements made to police
and the media by Kristen Price, McKinney's girlfriend. (Price was
charged with felony accessory after-the-fact to first-degree murder.
She later pleaded guilty to a reduced charge of misdemeanor
interference with police officers.)
Price now says that at the time of the crime she thought things would
go easier for McKinney if his violence were seen as a panic reaction
to an unwanted gay sexual advance.
But today, Price tells Vargas the initial statements she made were not
true and tells Vargas that McKinney's motive was money and drugs. "I
don't think it was a hate crime at all. I never did," she said.
Former Laramie Police Detective Ben Fritzen, one of the lead
investigators in the case, also believed robbery was the primary
motive. "Matthew Shepard's sexual preference or sexual orientation
certainly wasn't the motive in the homicide," he said.
"If it wasn't Shepard, they would have found another easy target. What
it came down to really is drugs and money and two punks that were out
looking for it," Fritzen said.
'All I Wanted to Do Was Beat Him Up and Rob Him'
Asked directly whether he targeted and attacked Shepard because he was
gay, McKinney told Vargas, "No. I did not. ... I would say it wasn't a
hate crime. All I wanted to do was beat him up and rob him."
But if the attackers were just trying to rob someone to get a drug
fix, why did they beat Shepard so savagely?
Rerucha attributes McKinney's rage and his savage beating of Shepard
to his drug abuse. "The methamphetamine just fueled to this point
where there was no control. It was a horrible, horrible, horrible
murder. It was a murder that was once again driven by drugs," Rerucha
said.
Dr. Rick Rawson, a professor at UCLA who has studied the link between
methamphetamine and violence, tells "20/20" the drug can trigger
episodes of violent behavior.
"In the first weeks after you've stopped using it, the kinds of
triggers that can set off an episode are completely unpredictable. It
can be: you say a word with the wrong inflection, you touch someone on
the shoulder. It's completely unpredictable as to what will set
somebody off" Rawson said.
"If Aaron McKinney had not become involved with methamphetamine,
Matthew Shepard would be alive today," Rerucha said.
Did Matthew Shepard Know His Killers?
Another widely held belief about the case is that McKinney and Shepard
had never met before their fateful encounter at the Fireside Lounge.
But a number of sources tell "20/20" the two were not strangers.
"Everybody knew Matt Shepard was a partier just like Aaron, just like
the rest of us," said Bopp.
In fact, Bopp said he had seen Shepard and McKinney together at
parties. "Aaron was selling [drugs] and him and Matt would go off to
the side and they'd come back. And Matt would be doing some meth
then," he said.
Though they frequented the same party scene, McKinney maintains he had
never met Shepard before the night of the crime and wonders why people
might say he had. "I've never met him. ... Maybe they seen us
somewhere in the same spot or something. I don't know," McKinney said.
A bartender familiar with the local drug scene, who asked to be
identified only as "Jean," says she was friendly with Shepard. She
also says McKinney and Shepard knew each other.
When she learned of the beating, she said, she recalls thinking, "It's
either money or dope, yeah. He'd be the perfect target especially
because Aaron knew him."
Another Laramie resident, Elaine Baker, says she also saw McKinney and
Shepard together in a social situation. Several weeks before the
murder, she spent a night on the town in Doc O'Connor's limousine with
a group that included both McKinney and Shepard.
"In the back of the limo, there was me, Stephanie, Doc, Aaron, Matthew
Shepard," she said.
As word spread of the attack on Shepard, other people who knew him
also suspected the drug scene might somehow be involved.
In fact, former Laramie police Cmdr. Dave O'Malley got a call from a
friend of Shepard suggesting that. Nevertheless, O'Malley doesn't
believe drug use motivated the attackers.
"I really don't think he was in a methamphetamine-induced rage when
this happened. I don't buy it at all," O'Malley said. "I feel
comfortable in my own heart that they did what they did to Matt
because they [had] hatred toward him for being gay," he said.
Shepard's mother, Judy, also said she doesn't buy into theories that
the attack was primarily driven by drugs and money rather than hatred
of her son's homosexuality.
"I'm just not buying into that. There were a lot of things going on
that night, and hate was one of them, and they murdered my son
ultimately. Anything else we find out just doesn't, just doesn't
change that fact," she said.
Did McKinney Have a Secret Sex Life?
O'Connor had known Aaron McKinney for years. In flush times, McKinney
partied in O'Connor's limos, and, in fact, McKinney and his girlfriend
lived for a while in an apartment on O'Connor's property.
O'Connor says he never heard McKinney express any anti-gay attitudes.
In his interview with Vargas, O'Connor reveals his belief that
McKinney is bisexual. "I know of an instance where he had a three-way,
two guys and one gal," he said. "Because he did it with me."
O'Connor added, "I know he's bisexual. There ain't no doubt in my
mind. He is bisexual."
McKinney's former girlfriend Price says she now believes that as well.
"He was always into trying to talk me into having a three-way with one
of his guy friends," she said.
In her prison interview with McKinney, Vargas asked McKinney directly
whether he had had any sexual encounters with men. McKinney said no.
Displaying a strong aversion to homosexual sex was a tactic McKinney
tried at his trial. His lawyers developed a so-called "gay panic
defense," claiming homosexual abuse McKinney suffered as a child
caused him to overreact to a sexual advance by Shepard and triggered
the violent attack.
Hoping a Wyoming jury would be sympathetic to gay panic did not pay
off. McKinney was found guilty and wound up with two life sentences,
assuring he'll spend the rest of his life in prison, the same sentence
received by his accomplice Russell Henderson.

Carpenter seemed very upset and repeatedly said, “He’s not breathing”.
Carpenter let the officers into the apartment and to the northwest
bedroom. Another male subject, Joshua (Josh) Brown, 22 years of age,
was standing in the hallway, completely naked, holding a flashlight
and a telephone. The officers observed a young, naked male subject,
later identified as Jesse Dirkhising (aka: Jesse Yates), thirteen
years of age (DOB: 5-24-86), on the floor in the middle of the room,
next to a mattress. Dirkhising’s genitals and abdomen were covered
with what appeared to be feces. Dirkhising’s mouth was blue, he had a
weak pulse, but he did not appear to be breathing. Patrolman Smith
also observed that Dirkhising had masking or duct tape wrapped around
his right hand. When Josh Brown was asked about the tape, he replied
that they were just playing a game. An empty prescription bottle was
observed on the mattress. In addition, Patrolman Smith observed some
pills and a razor blade on a mirror at the front entrance, which
appeared to be controlled substances and drug paraphernalia.
Rogers Fire Department Paramedics transported Dirkhising to St.
Mary’s Hospital emergency room, where he was pronounced dead at 0532
hours.
During preliminary questioning at the scene, Josh Brown assaulted
Corporal Rick Simmons, and was placed under arrest. While being
questioned by Detective Martha Armstrong after being Mirandized, Josh
Brown stated that he was Davis Carpenter’s lover. Brown also said
that he (Brown) and Dirkhising frequently tie each other up, although
not for sexual purposes. Brown stated that on this occasion he snuck
up on Dirkhising, tied his hands behind his back, placed a pair of
underwear in Dirkhising’s mouth and secured them with a bandana and
duct tape. He placed a bandana over Dirkhising’s eyes and secured it
in place with duct tape. He then placed a tee shirt over Dirkhising’s
head, and checked to ensure that Dirkhising’s nostrils were not
covered. He placed belts around Dirkhising’s knees and ankles to hold
his legs together. Brown then untied Dirkhising’s wrists and secured
them to opposite sides of the mattress. He positioned Dirkhising on
his stomach, placing pillows under his stomach. Brown then proceeded
to penetrate Dirkhising’s ***** with various items, including three (3)
fingers of his hand, his penis, a cucumber, a sausage, a banana and a
douche bottle. Brown stated at one point he prepared and administered
an enema for the victim, using his own urine as the liquid. Brown
then positioned a cucumber so that it was slightly penetrating
Dirkhising’s *****, and secured it with tape. He then went to the
kitchen, where he ate a sandwich before returning to the bedroom. Upon
his return, he found that Dirkhising was apparently not breathing.
Brown pulled the tee shirt off Dirkhising’s head, cut the tape and
bandanas away, removed the underwear from Dirkhising’s mouth and
contacted Carpenter. Brown also guessed Dirkhising to be thirteen or
fourteen years old.
Carpenter told officers that Brown woke him up and told him there
was a problem with Dirkhising. Carpenter found Dirkhising lying on
the bedroom floor with his hands bound with tape. He cut the tape and
attempted to administer CPR before calling 9-1-1.
Det. Jarod Mason interviewed Paula McVey, the grandmother of Jesse
Dirkhising (aka: Jesse Yates). Ms. McVey stated that Davis Carpenter
was a friend of Jesse Dirkhising’s mother and stepfather, who live in
Prairie Grove. She stated that for the last two or three months,
Dirkhising had been coming from Prairie Grove to Rogers to stay with
Carpenter on the weekends. She related that she was under the
impression that Dirkhising had been earning money during those
weekends by working for Carpenter at the hairstyling shop where
Carpenter worked. She stated that Carpenter had a younger male lover
who lived with him.
A search warrant for 1207 West Sunset Drive, Davis Carpenter’s
residence, was executed by detectives of the Rogers Police Department.
During the search of the residence, Detectives recovered numerous
small green pills, from the living room and bedroom, various bottles
of prescription medicine, including the controlled substance
amitryptiline, a known heavy sedative commonly used to treat
depression. Also located in the living room, were a mirror with
several of the green pills, and a small quantity of off white colored
powder suspected to be methamphetaminc. Numerous items of evidence
were recovered from the bedroom, including two cucumbers, one of which
was covered with what appeared to be petroleum jelly, the other having
what appeared to be fecal matter on it. Also located in the bedroom
was a tube-shaped sausage, as well as a crushed banana. A plastic
disposable douche bottle with the applicator secured in place with
duct tape was found amongst numerous items used in bondage. The
bondage items included numerous belts, large quantities of duct tape
and strapping tape, handcuffs, nylon rope, what appeared to be a
rubber jumprope, and electrical cord. Detectives located a mass of
items which included used duct tape, what appeared to be a shirt, a
pair of men’s brief underwear, and a bandana, which, according to a
statement by Defendant Josh Brown, were used to gag and blindfold the
victim during the rape. Numerous containers of petroleum jelly were
found throughout the residence.
In the living room, detectives discovered a computer and related
equipment that was still running. When the monitor was turned on, a
program entitled “Medical Drug Reference 4.0” was running on the
computer.
The search also revealed a piece of paper on which a note was
written to “Baby.” (Investigation has revealed that Carpenter refers
to Brown as “Baby.”) In the upper right hand of the note are listed
three types of prescription pills. The text of the note refers to
making a male (“him”) take “those pills.” It then refers to
positioning pillows beneath the male in a certain way. A different
portion of the same piece of paper says to tell “him” not to fight or
else for the next “14 hours” he will be sexually assaulted.
The search also revealed another note, addressed to an unnamed
person, which refers to a piece of meat being inserted in that
person’s *****. The note also refers to “Davis” engaging in sexual
intercourse with “you blindfolded on pills.” There is also a note
addressed to “Baby” that refers to “duct tape in place.”
The search further revealed a hand-drawn diagram depicting a
person on a bed. There are notations that refer to pillows, “tape all
the way around,” “face down,” the buttocks of the person “raised app.
2 feet.” Another note was found in the kitchen area addressed to
“baby”, and states “could cause serious damage-back to 3” sticking out
and duct tape in place.”
The search also revealed a five-page letter addressed “Hey Baby.”
The letter is signed by “Davie.” In the letter, “Davie” describes
seeing “Baby’s” “little 10 year old blond *****” at her bus stop in
the morning. “Davie” graphically describes how he can envision “Baby”
engaging in various sexual acts with her.
The search also revealed handwritten texts on a legal pad. In those
texts, the writer describes a man making a “fine crushed white powder”
from “the small oddly purple colored pill.” The writer describes him
cutting the pill in Ľ sections so that he would have “enough to do
this again in 4 hours or so, if he needed (or wanted!).” He then
describes the man giving a nine year old girl a glass of milk with the
pill powder mixed in. The writer then writes of the man laughing out
loud “knowing in 20 minutes the pill dust he’d added would render her
helpless and drunk…” He then describes in detail the man having the
girl first masturbate and then perform oral sex on him.
Also found on the kitchen table was a receipt from the Price
Cutter Food Warehouse dated September 26, 1999, at ‘0307’ hours. Items
purchased on the receipt included tape for $3.18, “Eckrich” for $2.50,
two cucumbers for $1.00 and “meat dept.” for $2.61. A package
containing one sausage was found in the refrigerator and was labeled
“Eckrich.” The sausage found in the package was consistent in
appearance with the sausage found in the bedroom.
A detailed interview was conducted at the Rogers Police Department
with defendant Josh Brown on September 27th, 1999 by Detective
Sergeant Hayes Minor. Brown told Sgt. Minor that he and the victim
had been sexually involved for approximately two months. Brown
described the sexual acts as “games” and “playing: with the victim. He
said that the morning of the victim’s death, he had performed anal sex
on the victim for the first time. In sex acts up until this point,
Brown said his penis had never penetrated the victim’s *****. Brown
told Sgt. Minor that on this occasion he used his fingers, his penis,
a cucumber, a sausage, a banana and a douche bottle to anally
penetrate the victim while the victim was immobile due to the
bindings.
Brown was questioned about Carpenter’s involvement during the rape
and told Sgt. Minor that Carpenter stood in the doorway of the
bedroom, naked, and watched Brown and the victim while he (Carpenter)
masturbated. Brown was also asked about the notes that were found in
the residence. When asked about the note found in the kitchen
addressed to “Baby” and stating “Could cause serious damage-back to 3”
sticking out and duct tape in place”, Brown stated that as he was
using the cucumber to penetrate the victim’s *****, Carpenter stood in
the doorway trying to get his (Brown’s) attention without having to
speak. When Brown walked to Carpenter, Carpenter showed him the note
indicating that he should not put the entire cucumber in the victim’s
***** as it may harm him. Brown stated he returned to the victim and
duct taped the cucumber in place as it penetrated the victim’s *****
approximately one half inch.
Brown was also shown the diagram that depicts a person bound to a
bed, much the same way Brown described the victim. He stated that the
drawing was completed by Carpenter on a much earlier date. When asked
about Carpenter’s knowledge of Brown’s and the victim’s sexual
activities, Brown stated that Carpenter had walked in on the two in
the past. After that occasion, Brown stated that he and Carpenter
talked about Carpenter watching as the victim and Brown participated
in sexual acts.
Brown was also questioned about the receipt he found in the
residence from the Price Cutter Food Warehouse dated September 26th,
1999, at 0307 hours. Brown told Sgt. Minor that Carpenter had gone to
the store alone and purchased the items, some of which were used
during the rape of the victim.
On September 27th, 1999, an autopsy was conducted on the victim by
the Arkansas State Medical Examiner. Preliminary results of the
autopsy indicate the victim died of “positional asphyxia.”
A check of Davis Carpenter’s prior record shows no known prior
convictions at this time. During conversations held with Det. Sgt.
Minor, Carpenter stated that he had lived in 26 different states, and
knew people in all 50 states. Carpenter apparently has limited family
in Springdale, Arkansas, but has lived out of state on numerous
occasions. Further investigation revealed that in the past two years,
Carpenter and Brown have lived in at least three different states,
including Florida. A records check of Joshua Brown reveals no known
prior convictions. Joshua Brown also has no known ties to the
Northwest Arkansas area.
Based on the seriousness of the offense, the substantial
likelihood of conviction, the nature of the penalty that may be
imposed, and the substantial risk of flight, the State joins me in
requesting that the Defendants, Davis Don Carpenter, DOB:08-02-61, and
Joshua Macave Brown, DOB: 6-7-77, be held without bond for the
offenses of Capital Murder, Class Y Felony, Arkansas Code Annotated
5-10-101; and Rape, Class Y Felony (6 COUNTS), Arkansas Code Annotated
5-14-103.
