PHOENIX (Reuters) - The Roman Catholic Diocese of Tucson, faced with
possible multimillion-dollar legal verdicts from sex abuse cases
against its clergy, filed for bankruptcy protection on Monday, a
church official said.
Bankruptcy was the best option, Tucson Bishop Gerald Kicanas said,
as church attorneys filed for Chapter 11 reorganization in U.S.
Bankruptcy Court in Tucson, Arizona.
The filing by the 350,000-member institution follows a July bankruptcy
declaration by the Archdiocese of Portland. Critics have challenged
the Chapter 11 filings as a ploy by the church to hide assets and
avoid liability for decades of abuse by priests.
Kicanas said in a letter released on Monday that the decision offers
the church "the best opportunity for healing and for the just and fair
compensation of those who suffered sexual abuse by workers for the
Church in our Diocese."
The bishop said the bankruptcy would enable the diocese and its 75
parishes to continue its work in the face of the lawsuits that could
be financially devastating in the future.
But Lynne Cadigan, a Tucson attorney who is helping represent most of
the plaintiffs suing the diocese, called the bankruptcy filing "a
public relations ploy" used to court sympathy and not justly settle
claims.
"For 30 years they were running a criminal conspiracy of concealing
sex crimes against children," Cadigan said. "Now, instead of being
held accountable, they are hiding behind a corporate policy of
bankruptcy."
The Tucson diocese, which has already paid out roughly $20 million in
legal claims, faces 22 additional lawsuits by victims alleging sex
abuse by Catholic clergy. A lawsuit that goes to trial on Sept. 29 is
believed to have forced the filing.
The decision to seek court-ordered protection had been expected since
June, when Kicanas began publicly discussing the possible bankruptcy
filing. He has maintained the diocese has made a good-faith effort to
try to settle abuse cases, but was unable to reach agreements.
Cadigan won the largest settlements paid by the Tucson diocese, a
reported $14 million, reached with 10 men and their families for abuse
by priests over three decades. Church officials have said it was
forced to sell its Tucson headquarters to cover a financial obligation
generated by the large settlement.
Churches across the United States have sold property to help stave off
bankruptcy, including Boston's archdiocese, which sold $100 million in
land and buildings to pay for settlements to hundreds of abuse
victims.

tiny few of it's fabulous treasures to pay the debt?
Any other corporation would be forced to.
Bankruptcy protection should only be granted to those entities who pay
taxes, in any case.

I saw in a recent documentary about Ben Franklin that after he
invented the lightning rod, the theists were actually debating whether
they should be put on churches since lightning came from god it would
be sinful to try to defy 'gods will'.

Roman Catholic Church, through the person of the Vatican, is recognized as
a nation by the UN and has reciprocal diplomatic ties with the United
States. As "embassies" of the Vatican have been engaging in terrorist
activities against children for decades, it seems reasonable to invoke the
Patriot Act against the Church.

I'm inclined to agree. At the very least, organizations being investigated
under the RICO laws should not be allowed to reorganize their financial
structure.
