New York City.
Dear Mr. Gilbert:
I am sending you herewith two photographs of my sketch models and two
plaster casts of the same, for the East and West wall friezes for the
Supreme Court Room.
The titles of these friezes, as indicated on beck of photographs are, East
wall "Majesty of the Law and the power of Government", showing the figure
of Law, resting on the tablet of the ten amendments to the Constitution
known as the "Bill of Rights: (bold by mh) and Government with the faces,
symbol of executive power. Besides these figures are the Genii of Wisdom
and of Statecraft.
The group at left represents the Defense of Human Rights.
The group at right represents the Safeguard of Liberty.

West wall frieze: The central group shows Justice resting upon her sword
with the winged figure of Divine Inspiration balancing the scales. Seated
at right and left of this group is Truth with mirror and rose and Wisdom
with owl.
The group at left represents 'The Power of Good" with the Defense of
Virtue, Charity, Peace, Harmony and Security.
The group at right represents "The Power of Evil with the Bondage of Evil,
Corruption, Falsehood, Deception and Despotic Power.
l am proceeding with the enlargement of these sketches and will prepare
sketches for South and North walls as soon m l have completed my search for
necessary data.

The U.S. Supreme Court Curataors’ October 31, 1932 typed, unsigned letter,
purportedly from Adolph A. Weinman, sculptor of the four friezes in the
U.S. Supreme Court Room, is fictitious, as proven by the attached letters,
dated and signed by the sculptor, and stamped officially “RECEIVED”:
1) His June 20, 1932 Contract No.AC.sc-11 with the United States
government for furnishing services in connection with the modeling and
carving of the sculptured panels for the Supreme Court Room in the building
for the United States Supreme Court, Washington, D.C., called for all
official correspondence between the sculptor, Adolph A. Weinman, 234,
Greenway South, Forest Hills, Long Island, N.Y., and the firm of
architects, Messrs.Cass Gilbert, Cass Gilbert, Jr. and John R. Rockart,
244, Madison Avenue, New York City, to have a copy sent to Mr. David Lynn,
Architect of the Capitol, Washington, D.C., who oversaw this Contract; and
vice versa.
2) Such correspondence called for the official received stamp of the
architect, “CASS GILBERT, RECEIVED (and date)” as borne out by the attached
official letters, signed by the sculptor, A.A. Weinman.
3) The Sculptor, Adolph A. Weinman’s, October 10, 1932; April 15, 1933;
and April 17, 1933 official, stamped “RECEIVED” letters show clearly that
both the sculptor’s sketch models (3/4”) and his subsequent scale models (2
¼”) were ready for the Architect’s inspection, at the site of Weinman’s
place of business, on Long Island; which refutes the unsigned, fictitious
October 31, 1932 letter’s statement that the sculptor’s plaster casts of
his sketch models were physically sent to the Architect’s firm.
4) The attached official Contract ACsc-11 Requisition No. 8, Schedule
of Payment addressed to sculptor Adolph A. Weinman, amounting to
$120,000.00, with amounts due under terms of Article 10 of said Contract,
is APPROVED by the ARCHITECT OF THE CAPITOL, overseer of this U.S.
government Contract, and signed by the Architectural firm of Cass Gilbert,
Cass Gilbert Jr., and John R. Rockart, as well as by the sculptor, Adolph
A. Weinman.
5) With an official U.S. Government Contract of this magnitude,
importance and cost, an unsigned, October 31, 1932 letter, lacking the
sculptor’s signature, name and official “CASS GILBERT, RECEIVED (and date)
stamp” and/or letterhead of
the sculptor, is clearly proven to be fictitious.
A typed letter, with neither the sculptor’s letterhead, nor his
signed/typed name, nor his customary formal address to the recipient, as
proof given by the U.S. Supreme Court curators that Adolph A. Weinman’s
sculpture above William Rehnquist’s head, featuring The Ten Commandments’
traditional Roman numerals I-V to the left and VI-X to the right, is
actually the first ten amendments to the Bill of Rights, appears to be
inadequate evidence in a court of law.
In Adolph Alexander Weinman’s U.S. Supreme Court Building Description
of Sculpture Courtroom, no mention is made there, nor in any other original
by A.A. Weinman, of the first ten amendments to the Bill of Rights in the
East Wall Frieze above the Bench.
Also of note is page 27 from a Library of Congress book depicting
church symbolism, showing the Ten Commandments traditionally depicted by
Roman numerals, I-V to the left and VI-X to the right. (Exhibit 13).

I would say that the first mistake in trying to make sense of all this
is to rely on Catherine Millard for information. For instance, look
how sloppy she is with her links. This one says:
June 20, 1932 Contract No.AC.sc-11
But the June 20, 1932 contract is nowhere to be found. There is August
25, 1934, there is January 17, 1933, and there is a letter signed
"this tenth day of March, A.D., 1933." Within the text of the August
letter, the June 20, 1932 contract is mentioned, but absolutely
nothing is said about contractual obligations regarding the flow of
correspondences as Millard claims. If the actual contract says it,
Millard should provide it.
Then there's this link:
October 10, 1932; April 15, 1933; and April 17, 1933 official, stamped
"RECEIVED" letters
Both April letters are there, but the first letter is not dated
October 10, 1932, it's dated January 17, 1933.
Twice Millard indicates she is linking to documents dated 1932; twice
she fails.
Then, there is this stupendous error:

Now, I say "stupendous error" because the accompanying fax clearly
says, "Transcript of letter sent to Cass Gilbert." A TRANSCRIPT? How
could she possibly have missed this? Why would a transcript
necessarily have a letterhead of any type, let alone the original? It
wouldn't have an official CASS GILBERT, RECEIVED stamp on it, would
it? It certainly wouldn't have a signature penned by Weinman's own hand.
We further know it's a transcript since "bold by mh" was added because
"mh" -- Geez, that wouldn't happen to be Matt Hofstedt of the SCOTUS
Office of the Curator who sent the transcript to Millard, would it? --
bolded the phrase "resting on the tablet of the ten amendments to the
Constitution known as the `Bill of Rights'"
This transcript also contains a typeface not seen in any of Weinman's
other letters because it was done on mh's typewriter, not Weinman's.
The typeface in this particular transcript comes in three fonts:
standard, bold, and italicized; the nearest match I could find for the
Weinman typeface was that of an Underwood Portable typewriter,
available in the 30's, and without the use of bold or italics in his
letters. All I'm affirming here is that the letter she received is
indeed a TRANSCRIPT done by the Curator's Office and NOT A PHOTOCOPY
of the original letter itself. So why is Millard criticizing a
transcript when she has never laid eyes on the original? The original
very well could have a letterhead, a stamp, and a signature.
Nevertheless, the evidence in her possession is sufficient to
invalidate her own criticism. What a blunder!
After all this, the part I like best is that on her expose page , the
first thing she criticizes is:

No kidding, Dr. Millard. Why do you suppose that is? Hey, Dr. Millard,
I have a transcript of the Declaration of Independence I'll sell you
for $10,000 and it's a lot more legible than that old ratty 1776
original everyone has to stand in line to see. Did it on my computer
this morning, so you know it's fresh.
I've done a lot of work and a lecture that include this Weinman
letter. I've considered writing a published article, but I need to
make a trip to DC sometime to get to the archives. It's going to take
me a while due to personal circumstances. BTW, I haven't been on the
forums much in the past year since Glen died, but I got a chance to
share my findings with him on a couple of Weinman's letters. I still
get teary-eyed thinking of my friend, but Glen was great at
encouragement, and he is the reason I began lecturing. Glen demanded
fidelity to the historical record and following the evidence wherever
it led. He hated the notion of "our side" versus "their side." He was
on one side: the side of accuracy and an honest accounting of history.
I'll add more when I get a chance.
