They're also suing Al Franken for his latest book's title:
Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at
the Right.
(While having Bill O'Reilly's picture under the word "Lies".)
FOX has "Fair and Balanced" trademarked. But this is just a bullying
tactic since a trademark is just to keep consumers from being confused
into thinking a product belongs to someone else. I doubt that any
consumer would be confused into thinking that Franken's book is really
from FOX when the book is obviously attacking one of their
"journalists".

Fox screwed the pooch bigtime. Franken's book shot up the Amazon list
after they filed suit. The big dummies should have just kept quiet and
parodied him right back.

Fox only screwed the pooch if they wanted Franken ignored. But
controversy is good business. Franken and Fox have a mutual
interest in the big stink now surrounding this book -- money.
Call me cynical, but it looks like cheap publicity for both

FOX is a network: they can make all the publicity they want.
This got them covered on quite a few networks other than thier
own. Free advertising on CNN, NPR, CBS, NBC, BBCx, ABC etc. Do
you *really* think that they were otherwise motivated? C'mon,
the lawsuit is ridiculous on its face, unless viewed in the
context of drawing attention to themselves and the book.

Fox is a mouthpiece for the RRR. It recently fought a lawsuit to
defend its "right" to lie, distort and mislead the public on a
matter of public health (widespread overuse of genetically
engineered growth hormones in dairy cattle.)

And it is Al Franken's and anybody else's legal and moral right to
use "fair and balanced" or ANY other phrase they want and to say
whatever THEY want about FOX news. Liberals never gave FOX news
permission to talk about them, so they do not need FOX's permission

If FOX does not want to read Al Franken's book, then they can choose

Fox pressured the reporters to air a report which it knew to

refused. Pretty typical of Fox's idea of journalistic standards.

Given the level of hysteria about the subject of bovine growth hormone
on the site there, I don't blame FOX one bit for wanting these reporters
to tone it down. "False and misleading" would be a good description of
the *original* report.

Either you have *****-poor reading comprehension skills or you're
as big a liar as Fox. Both the lower court and the appeals court
found that the story Fox wanted to air was false, distorted and
misleading. The appeals court just said that it wasn't technically
illegal.

that there was retaliation for threatening to report bogus news stories

There was one claim of retaliation for one incident of actually

thrown out of court, so basically there is nothing left except that FOX
bullied them when Wilson and Aker made such a fuss over having their

# is no law against Faux "news" making up bogus
# news stories. They never said "This story isn't bogus."
BTW, Walter Cronkite testified in the original trial as
an expert witness to refute Fox claims that the two
reporters acted unethically. Also, the Society of Professional
Journalists gave the reporters an award for ethics for standing
up to Fox's pressure to air a false story. I mention this in
response to Fred Flintstone's typical religious-right tactics
of smearing and character-assassinating anyone who dares
to stand up to the RRR monolith.

Oh, so Walter Cronkite is just another evil liberal?
# I find it laugable that anybody could read the BGH material
# linked from that website and imagine for one moment that this is a "fair
# and balanced" treatment about it.
I find it laughable that you are growing increasingly demented
in your frenzy to smear anyone who doesn't march in lockstep
with the dictates of the religious right.

The only thing the two reporters won was on the retaliation claim.
Retaliation for.... ????
For having snipped the whole context including the citation of
exactly what claim.
Nobody said there was retaliation for a "Claim." What was said is
that there was retaliation for threatening to report bogus news stories
to the FCC, if Faux "news" should insist on reporting the bogus stories.
There was one claim of retaliation for one incident of actually
reporting their own ***** to the FCC. Said ***** has all been
thrown out of court, so basically there is nothing left except that FOX
bullied them when Wilson and Aker made such a fuss over having their
precious pile of hype edited to correspond with the evidence.
It was "thrown out of court" because they sued under a provision
of Florida law, the whistleblowers protection act, that states that the act
committed that caused the whistle blowwer to act had to be illegal under
Florida law.
Faux Nooz got a smart lawyer to point out that lying to teh public by a
news organization isn't technically illlegal.
Such a victory, Faux 'won' because it was not illegal for them to lie.
Their official spokes creature crowed afterwards that "fox has been
vindicated".
No, Faux news lied, and slid through on a technicality.
Amazingly, no top Faux news managment types showed any remorse,
shame, or recognition lying to the public is bad or unacceptable.
So I have contempt for Fox and consider it about on par with the National
Inquirer.
And amazingly, no right winger ***** types who I have seen this issue
faced before seem to care that Faux lied, got caught, sued, lost, skated
on a technicality, and showed no public reconition that having been caught
trying to force two reporters to falsify news . And declared that skating
on a technicality is "vinidcation".
You can thus see why I have no regard for anybody on the hard
right who accepts such ***** as acceptable behavior for a supposed
news organization.
I have seen not the slightest trace of intellectual honesty on the right
over this disgusting contempt for accuracy, truth and honor.
The right does not care about truth and honor.

Well said! I agree !
That is because the right is nothing but a bunch of unpatriotic
cowards who are disloyal to their country (whatever country they live in:
the US, the UK, Germany 1930-1945, hell even super-right-winger Saddam Hussein
in Iraq).

I've read the case, and the documents posted on that website, including
the "FOX Mandated Version" of the scripts with all their comments.
http://www.foxbghsuit.com/exhibit%20q.htm
Wilson & Akre even admit that they have taken pains to emphasize (ie,
hype) the danger because so many other similar "cancer scare" claims
have been made that people are desensitized. So, by making them *not*
hype things, FOX is "lying".
If FOX managed to weasel out of a hack job of a lawsuit like that, more
power to 'em.

Hey! Trademark infringement! You'll be hearing from Fox's lawyers!
I must say the "fair and balanced" channel is getting increasingly
mentally unbalanced. In the court papers in which they filed the
Franken lawsuit, they describe Franken as "neither a journalist nor
a television news personality... shrill and unstable... intoxicated
or deranged... increasingly unfunny."

Thereby proving that Fox is, in fact, "fair and balanced." In a Republican
sort of way.
