Abuse of Teri Schiavo! |
Evidence of Physical Abuse Haunts Michael Schiavo
Fractures in wife's ribs, pelvis, spine and ankle point to prolonged
violent abuse
To: National Desk
Contact: Gary McCullough for the Schindler Family, 202-546-0054
CLEARWATER, Fl., Feb.10 /Christian Wire Service/ -- On May 6, 1990,
two months after the mysterious incident that left Terri Schindler
Schiavo severely mentally disabled, Dr. Hamilton, an Orthopedic
Surgeon, examined her. A year later Terri was demonstrating painful
reactions to physical therapy treatment, so on March 5, 1991, the
Mediplex therapist director ordered a bone scan.
This bone scan revealed a healed broken right femur bone and healed
bone fractures in Terri Schindler Schiavo's ribs, pelvis, spine and
ankle.
Dr. W. Campbell Walker concluded that Terri has a history of trauma
and presumed that the other multiple areas of abnormal activity also
relate to previous trauma.
As Terri's lone guardian, Michael Schiavo has been able to conceal the
bone scan and examinations from her parents, brother, and sister for
over ten years. To date, Michael Schiavo has not allowed the family
to see the results of the May 6 examination, the emergency room
records from the day of the incident, nor any of the accompanying
x-rays.
Michael Schiavo's inability to be forthright over the bone scan brings
into question his lone description of Terri's activity at the time of
the incident. His choice to have his wife terminated rather than
rehabilitated may not be in pursuit of her interests, but to continue
to conceal the level of physical violence he displayed toward Terri.
The bone scan evaluation is available online at
www.earnedmedia.org/bonescan.htm

A Family's Torment - Terri Schiavo
The following items are among many very frustrating circumstances that
Terri Schiavo's parents, brother, and sister consider to be abuses of
Terri on the part of Michael Schiavo. As a parent, can you imagine
having to just be a bystander while these abuses are inflicted on your
child? All of these have been condoned by Judge Greer and the Pinellas
County officials.
Denial of Therapy, Rehabilitation and Necessary Services
FS 744.3215 Rights of persons determined incapacitated
FS 837.021 Perjury by contradictory statements
Records show that in 1992 Michael Schiavo, Terri Schiavo's legal
guardian, sued Terri's gynecologist for negligent care. During this
weeklong trial, Michael testified, assuring the judge and jury that he
needed millions of dollars to properly care for Terri, bring her home,
and provide Terri with proper therapy and care for the rest of his
life.
Contrary to Michael Schiavo's testimony, medical records indicate
that after receiving the proceeds of the 1992 Medical Malpractice Trial
totaling close to one million dollars not a single day of proper
therapy or rehabilitation has been administered to Terri Schiavo, and
Terri has been confined to a bed.
In fact, the spring of 1993, just several months after Michael Schiavo
promised to provide life-long therapy and care for his wife, Michael
revealed his first attempt to end Terri's life testifying that he
instructing caregivers not to treat Terri's life-threatening
infection. In 1995, Michael Schiavo again attempted to end Terri's
life in this manner by refusing Terri proper medical treatment.
In 1998, with close to eight hundred thousand dollars in Terri's
fund, Michael Schiavo petitioned the court to remove Terri's feeding
and hydration tube so that she would die.
Michael Schiavo is the inheritor of Terri's Medical Trust.
Visitation Lists and Violation of Court Orders
In March 2000, Michael Schiavo, Terri Schiavo's legal guardian,
requested an emergency hearing in front of Judge George Greer, asking
the court to severely restrict all family members and friends of the
Schindler's from visiting Terri.
The court agreed to restrict those that could visit Terri, and granted
the Schindler family a fifteen minutes recess to create a visitors
list. The court then allowed Michael Schiavo to deny/accept the
visitors listed by the Schindler's before any anyone could visit with
Terri.
Further Visitation Restrictions
Subsequent to this, in a separate hearing, Michael Schiavo asked the
court to again restrict visitations asking that the court to only allow
those on the approved visitors list to visit Terri while in the company
of Terri's family.
This would take the place of the previous court order in which those on
the approved visitation list could visit Terri, on their own schedule,
without Terri's family present.
The court approved this request.
Without Court Order
Additionally, Michael Schiavo has added and deleted visitors from the
approved list without seeking court permission.
Recently, Michael Schiavo arbitrarily decided to remove several of
Terri's family members from the list because he felt they did not
visit Terri regularly.
Many of Terri's family members live out of the state of Florida and
can only make occasionally trips to visit Terri.
On several occasions, the family has asked permission from Michael
Schiavo to add individual friends and family members to visit with
Terri. Michael Schiavo has denied this request each time.
Refusal to Fix or Replace Wheelchair
FS 744.3215 Right of persons determined incapacitated.
Records indicate that since 2000, and regardless of the requests by
Terri Schiavo's parents, Bob and Mary Schindler, to have Terri's
wheelchair repaired, Michael Schiavo, Terri Schiavo's legal guardian,
has refused to repair her wheelchair.
If Terri was permitted by Michael to leave her Hospice bedroom and go
outside, the fact that Terri does not have a properly working
wheelchair makes it very difficult to transport Terri in anything other
than the bed, which is where her guardian instructs for Terri to spend
most of her day.
Subsequently, for over four years, Terri's family has been refused by
Michael Schiavo the permission for Terri to be taken outside, or leave
her room for any reason.
Denied Swallow Therapy
FS 744.3215 Rights of persons determined incapacitated
Contrary to what is reported by Michael Schiavo, Terri Schiavo's
legal guardian, and his attorney's, records indicate that Terri
Schiavo has not received a swallowing test to determine if she could
swallow since sometime in 1992.
Terri's parents, Bob and Mary Schindler, have the testimony of
several physicians and have submitted additional affidavits to the
court since the original January 2000 trial stating that, with proper
therapy, Terri could be taught to not only eat food again, but also
speak.
Furthermore, a speech therapist from the University of Chicago, Ms.
Sara Green Mele, MS, CCC-SLP, submitted an affidavit in 2002 stating
that after thoroughly studying tapes and reading Terri's medical
files strongly believes that Terri can be taught to once again swallow
food, and also be taught to speak again. In fact, Ms. Mele believes
that Terri is
communicating right now. Additionally, Ms. Mele stated the she has
treated patients in worse condition than Terri that have been
successfully re-taught to swallow and consume food.
Michael Schiavo has brought contradictory testimony from doctors to the
court stating that Terri cannot swallow food. They claim that it would
be very dangerous to see if Terri is able to eat and could cause her to
aspirate, which could then lead to a painful death by choking.
The Judge in this case, George Greer, has sided with Michael
Schiavo's doctors believing that Terri cannot be taught to eat again
and therefore has refused to grant even a test to see if this in fact
would be true.
Therefore, Judge Greer has denied any swallowing therapy believing that
a potential death by aspiration and choking is more agonizing than his
order to have Terri die by starvation and dehydration.
Note: In the January 2000 trial, Michael Schiavo was asked by his
attorney if there was some type of therapy that could possibly help
Terri would he provide it for her.
Michael's answer was that he would be there in a heartbeat.
Confining Terri to a Single Room
FS 744.3215 Right of persons determined incapacitated
When Terri Schiavo's family, the Schindler's, visit with Terri at
Hospice and would like to take her outside, the nursing staff must
first ask Terri's legal guardian, Michael Schiavo for permission.
For the past four years, Michael Schiavo has repeatedly denied the
request by Terri's parents and siblings for permission to take Terri
outside. Subsequently, Terri has been confined to her Hospice room, not
permitted to leave her room for any reason, for over four years, and is
confined to her bed where she spends most of her time.
Additionally, prior to 2000 when Michael Schiavo began his orders for
Terri not to leave her room, it is impossible to know the frequency in
which Terri was taken outside other than when her parents requested to
do so.
Denial of Medical Treatment for Life Threatening Infection
FS 825.102 Abuse, Neglect and Exploitation of Elderly Persons and
Disabled Adults
According to the testimony of Michael Schiavo, he assured a judge and
jury in November 1992 that his wife, Terri Schiavo, would be given
proper therapy and care for the rest of his life.
However, medical records indicate that after receiving the proceeds of
the 1992 Medical Malpractice Trial totaling close to one million
dollars not a single day of proper rehabilitation or therapy has been
given to Terri.
And in the spring of 1993, just a few months after this Medical
Malpractice was awarded to Terri, Michael Schiavo, Terri's legal
guardian, instructed caregivers not to treat Terri who had acquired a
common but life threatening infection. This happened again in 1995.
Note: Michael is the inheritor of this Medical Trust.
Michael Schiavo's testimony - November 1993.
Q=2E What was her bladder condition?
Michael Schiavo: She had a UTI.
Q=2E What is that?
Michael Schiavo: Urinary tract infection.
Q=2E What did the doctor tell you treatment for that would be?
Michael Schiavo: Antibiotic usually.
Q=2E And did he tell you what would occur if you failed to treat that
infection? What did he tell you?
Michael Schiavo: That sometimes urinary tract infection will turn to
sepsis.
Q=2E And sepsis is what?
Michael Schiavo: An infection throughout the body.
Q=2E And what would the result of untreated sepsis be to the patient?
Michael Schiavo: The patient would pass on.
Denial of Personal Items, Gifts
FS 744.3215 Right of persons determined incapacitated.
Terri Schiavo resides is at a Hospice facility and is confined to a
small room. Therefore, Terri's family, the Schindler's, will try and
personalize and warm her room by adding family photos. Michael Schiavo,
Terri's legal guardian, has removed family pictures from Terri's
room not to be returned.
Additionally, on several occasions, family and friends of Terri have
sent flowers and cards of support to be given to her and placed in her
room. Michael Schiavo has refused any cards to be displayed or for
flowers to be to be delivered and placed in Terri's room. He
instructs the nurses to place the flowers at the nurse's station.
Denial of Stimulation
In Terri Schiavo's room, there is a small radio equipped with a CD
player that Terri is permitted to listen to.
On several occasions, Terri's family has brought some of Terri's
favorite music CD's for Terri so that she can listen with earphones.
In order to play Terri these CD's, the Hospice nurses must first
phone Michael Schiavo to ask permission. Without any reason given,
Michael Schiavo refuses to allow Terri's family to play her these
CD's.
One occasion in particular, Terri's mother, Mary Schindler, played
Terri a CD in the portable CD player. Mrs. Schindler was reprimanded by
Michael Schiavo when this incident prompted the nurses to phone him
inquiring what Mrs. Schindler was doing.
This restriction continues, and Terri is not permitted to listen to
music via headphones.
Denial of Interaction with Parent
Terri Schiavo's feeding tube was removed in October 2003. During one
of the visits by Terri's mother, Mary, attempted to apply lip-gloss
to Terri's lips. A security policeman stationed outside Terri's
door informed Mrs. Schindler that she was not permitted to apply any
lip-gloss to Terri's lips.
During a family visit with Terri in February 2004, Terri's brother,
Bobby Schindler, attempted to move Terri's Geri chair that she was
sitting in to the front of the window so that she could receive some
fresh air. The nurse stopped Terri from being moved and informed
Terri's brother that he was not permitted to move Terri without the
permission of the nursing staff. This information was given to Michael
and Bobby was warned not to be a disruptive visitor.
Michael Schiavo Refuses to Dissolve Marriage
FS 798.01 Living in Open Adultery
Since 1995, Michael Schiavo, Terri's legal guardian, has been engaged
to and living with Jodi Centzone. Michael Schiavo has fathered two
children with this woman.
Michael Schiavo is currently married to Terri Schiavo. The two were
married in a Catholic Nuptial Mass, November 1984.
Incidentally, in order to be married in a Catholic ceremony, and at the
insistence of Terri because Michael was not Catholic, Michael agreed to
get a special dispensation. One stipulation to receive a special
dispensation was that Michael agreed to raise any children that Terri
and he may have as Roman Catholics.
Incidentally, the manner in which the Schindler family was made aware
that Michael was engaged to another woman while still married to Terri
was receiving the obituary of Michael's mother, Claire Schiavo, when
she died in 1997.
In part of the obituary it was stated that Claire Schiavo is survived
by Michael Schiavo and his fianc=E9 Jodi Centzone. There was no mention
of Michael Schiavo's wife, Terri.
This happened once again in 2001 when Michael Schiavo's father passed
away. While Jodi Centzone was mentioned as Michael's fianc=E9, there
was no mentioning of Michael's current wife, Terri.
Note: Michael Schiavo did testify that he was in fact engaged to marry
Jodi Centzone once his wife has passed away.

13 So when the dragon saw that he had been thrown down to the earth, he
pursuedd the woman who had given birth to the male child. 14 But the
woman was given the two wings of the great eagle, so that she could fly
from the serpent into the wilderness, to her place where she is

mouth the serpent poured water like a river after the woman, to sweep
her away with the flood. 16 But the earth came to the help of the

Outside View: She's not dead or dying
By Frank Pavone
Outside View Commentator
Staten Island, NY, Feb. 15 (UPI) -- Terri Schiavo is not dying. She has
no terminal illness. She is not in a coma. She is not on life-support
equipment. She is not alone, but rather has loving parents and siblings
ready to care for her for the rest of her life. She has not requested
death.
A battle rages is raging over whether she should be starved to death.
Schiavo sustained brain injuries and cannot speak or eat normally.
Nevertheless, the only tube attached to her is a small, simple,
painless feeding tube that provides her nourishment directly to her
digestive system.
Her legal guardian is her husband, who already has another woman -- by
whom he also has children. He wants Terri Schiavo's feeding tube
removed. Of course, he could simply allow her to be cared for by her
parents and siblings and get on with his life, but he refuses.
I have had two opportunities to visit Terri Schiavo, most recently on
the first Sunday of February. I have been able to talk to her, to
listen to her struggle to speak, to watch her focus her eyes and smile
and attempt to kiss her parents. I have prayed with her, blessed her,
and assured her that she has many friends around the country and around
the world, who love her and want her to enjoy the same protections we
all enjoy, even when we're wounded.
News articles have recently characterized Terri's situation by saying
that some want to keep her alive against her husband's wishes. But
Terri Schiavo is not dying. What does keeping her alive mean, if not
the same thing as keeping you and me alive -- that is, by giving us
adequate food, shelter, and care?
Some say that Terri's family should let her go. But this is not a
matter of letting her go, because she isn't going anywhere. If,
however, she is deprived of nourishment, then she would slowly die in
the same way that any of us would slowly die if we were deprived of
nourishment. It is called starvation.
If the courts permit that to happen, then why should that permission
apply only in Terri Schiavo's case? There would be no way to limit it
to her case alone. Countless others would follow, and their deaths
would be described as letting them die instead of killing them. Where,
indeed, does the state get the authority to starve people? Court
decisions permitting this lack all authority, as Pope John Paul II
teaches in Section 72 of The Gospel of Life. These decisions cannot be
obeyed, because they are not binding on the conscience and are in fact
acts of violence.
At the present time, there are two simple things you can do. Educate
your neighbors about this situation. A section of the
PriestsforLife.org Web site is devoted to educating people about her
case. Second, contact anyone you know in Florida and ask them to
encourage Gov. Jeb Bush and members of the Florida Legislature to
continue doing everything possible to save Terri Schiavo's life.

| Title: Re: Abuse of Teri Schiavo! |
14 Feb 2005 02:55:54 PM |
|
|
This is the story of "Cindy," and the deposition that she had to be
forced to give, out of her fear of Michael Schiavo. Terri was also
afraid of Michael, but of course Michael has been hard at work to make
sure that she can't give a deposition as Cindy has!
In late 1991, 1=BD years after Terri's collapse, Michael Schiavo
became involved in an intimate relationship with Cindy Shook. The
romance continued for approximately one year. It can be documented that
the two spent a weekend at the Don Caesar hotel in St. Petersburg Beach
and they also contacted a Century 21 Realtor on the premise of
purchasing a home.
In May of 1992, at the apex of the romance, Schiavo had Terri's 2 pet
cats euthanized to clear the way for his moving in with Cindy and her
pet dog.
In the summer of 1992, Schiavo moved into his parent's home. We can
speculate with reasonable accuracy, it was at the instructions of his
attorney, since the living arrangement would be contrary to Schiavo's
"loving husband" image they were projecting for the upcoming November
1992 malpractice trial.
In April 2001, Cindy Shook (married name Brasher) was interviewed by an
investigator working in Terri's behalf. Unwilling to come forward
because of her immense fear of Schiavo, Cindy had to be subpoenaed and
was then subsequently deposed on May 8, 2001 to try and learn more
regarding her intimate knowledge of Michael Schiavo's character
traits.
Excerpts; May 8, 2001 Deposition:
Cindy Shook describing Schiavo's possessiveness.
"he's very jealous. He stalked me at my...at where I worked after I
stopped dating...when he would get mad at me he would tell me, I would
rather be laying in bed in the nursing home with her than with you. I
mean he can be the most incredibly mean person"
When asked if she were afraid that Michael would physically harm her or
if he would harm children.
"I am concerned about retaliation because I have a child -I have
children and a husband. I know him, I know what he told me I said he
could be a very mean person."
She spoke of how Schiavo stalked her for close to a year after the
breakup and that she received repeated phone calls.
"He came on the floor looking for me several times. I felt it was out
of character for him to get a job as an orderly at the hospital That
was concerning to me. When he would come up to the floor looking for
her she was not scared the first time but later was scared.
In town I would look up when I was driving...not at my work- she would
look up in the rear view mirror and there would be Michael Schiavo. I
would look up and he would be behind me in traffic. It continued for
several months after he didn't work at the hospital. She would change
lanes, try to make a turn and he would do the same. He did this about
ten times.
One time he was behind me in traffic he got next to me in a two-lane
going the same way, and he changed lanes basically right on top of
where I was at, and I had to swerve not to be hit. I had to swerve off
the road. Michael ran me off the road. I considered it as stalking,
dangerous and guessed potentially life threatening."
Cindy thought about getting a restraining order. She talked to an off
duty police officer in her building
They discussed marriage. She said Schiavo asked what would you do if I
asked you to marry me. He never discussed getting a divorce.
Cindy said Schiavo got angry when asked questions about Terri saying:
"this had destroyed his life and he was being robed of a normal life."
Regarding Terri's care, according to Cindy Shook, Michael Schiavo
said,
"How the hell should I know we never spoke about this, my God I was
only 25 years old. How the hell should I know? We were young. We never
spoke of this."
THEY NEVER SPOKE OF THIS! Yet now Michael claims that Terri's wish was
to die of starvation and dehydration, and the infamous Judge George
Greer rubber stamps it. Why?
A case for Criminal Investigation of Michael Schiavo:
1) Nurses' testimony: Heidi Law, Carla Sauer-Iyer, Carolyn Johnson
have been ignored and dismissed without hearing; each testified that
Michael was abusive to Terri and may have attempted to kill her by
insulin injection and attempts to induce pneumonia by turning the
thermostat in her room to 64 degrees.
2) Michael Baden, top forensic pathologist in country and interviewed
on Fox News National Television broadcast October 25, 2003 on Terri's
bone scan and injuries states that:
a) Terri's injuries are not consistent with a heart
attack; no cardiac evidence to support it
b) Extremely rare for potassium imbalance on woman her age and in her
good health
c) Injuries are consistent with severe trauma possibly caused by a
beating
d) The injuries in medical records warrant an immediate
investigation
3) Dr. William Hammesfahr, Nobel prize nominee and neurologist
testified that Terri's neck injuries are consistent with only one
type of injury: that of strangulation.
4) Terri's doctor, Dr. Gambone resigned; he had previously testified
Terri would die within a few days of starvation/dehydration. Terri has
an obvious will to live.
5) Michael has enlisted the services of a new doctor, Stanton Tripodis,
who has 5 malpractice suits against him. Clearly, Michael is
attempting to provide sub-standard care for his wife.
Case no. 97007946C1 filed 11-25-97
Case no. 94003739C1 filed 6-27-94
Case no. 95000873C1 filed 2-14-95
Case no. 96001434C1 filed 3-6-96
Case no. 98002289C1 filed 4-7-98
6) Michael is committing adultery by living with another woman who has
already born one child with another on the way, thereby creating an
obvious conflict of interest as guardian.
7) Michael has committed both perjury (2 counts) and insurance fraud by
promising to provide care and therapy for his wife in exchange for the
court award of 1.2 million dollars in 1993. No care has ever been
provided to Terri.
8) Michael Schiavo has also prevented Terri from undergoing a barium
swallow test, a procedure necessary to ascertain the consistency of
foods able to be taken by mouth.
9) Co-conspirator George J. Felos combined and conspired with Michael
Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part
of an "exit protocol" designed to advance Felos' self-perceived
messianic mission of "helping" incapacitated people to die by
categorizing them as "terminal," warehousing them, and depriving them
of therapy and rehabilitation services. (Attorney Felos is Director of
Florida Right to Die and has testified that he can ascertain a
person's desire to die by "looking into their eyes and letting
their spirit speak directly to him")
10) Investigate Insurance company established in Jan 2001 at the home
of Michael Schiavo and his girlfriend/fiancee Jody Centonze. (Jerger
and Centonze Insurnace Agency Inc.) Michael is listed on the Board of
Directors for the corporation. Note: Insurance is deliberately
misspelled in the State of Florida Corporate filing, possibly to avoid
investigation.
11) Michael continues to deny Terri the right to receive Holy Communion
as part of her Catholic and civil right.

NURSES ASSERT THAT SCHIAVO WOMAN, SET TO HAVE FEEDING STOPPED, HAS
SPOKEN WORDS SUCH AS 'HI,' 'MOMMA,' AND 'HELP ME'
Nurses who tended to Terri Schiavo -- the Florida woman whose feeding
and water tubes may soon be removed -- have stated in affidavits
provided by her family that the 41-year-old has exhibited clear-cut
behavior indicating she is conscious and aware of her surroundings.
In stunning testimony, one nurse, Heidi Law, a certified nursing
assistant who took care of Terri when she was at Palm Gardens Nursing
Home in Largo, Florida, in 1997, said that the severely disabled woman
formed words such as "mommy, "momma," and most hauntingly, "help me."
"While it is true that those patients will flinch or make sounds
occasionally, they don't do it as a reaction to someone on a constant
basis who is taking care of them, the way I saw Terri do," claimed Law
in a formal deposition. "I witnessed a priest visiting Terri a couple
of times. Terri would become quiet when he prayed with her. She
couldn't bow her head because of her stiff neck, but she would still
try. During the prayer, she would keep her eyes closed, opening them
afterward. She laughed at jokes he told her. I definitely know that
Terri 'is in there.'"
The testimony, contained in affidavits provided to Spirit Daily by her
family, the Schindlers, who are desperately attempting to prevent her
death, contradicts widespread perceptions that Terri is a nearly
brain-dead or comatose woman living in a vegetative state. In fact, by
some indications the woman may have greatly improved had she been
provided adequate therapy.
"I have heard her say 'mommy' from time to time, and 'momma,' and she
also said 'help me' a number of times. She would frequently make noises
like she was trying to talk," said Law.
That the disabled woman acknowledges the presence of her parents,
responds to music, and follows the movement of objects such as a
balloon has long been known and documented by videos [click here]; and
the affidavits have appeared on advocacy websites. Indeed, the
caretakers have testified that Terri seemed to stare out her window as
if waiting for her mother -- not only denied therapy, but also in a
small room with a radio that her husband allowed to be left on only a
single station.
But that she actually formed words is attested by a second caretaker,
Carla Sauer Iyer, a registered nurse who was at Palm Garden from 1995
to 1997.
"Terri's medical condition was systematically distorted and
misrepresented," stated Iyer in her own affidavit for the family --
testimony that was not allowed into court by a judge who has
consistently ruled against the Schindlers. "When I worked with her, she
was alert and oriented. Terri spoke on a regular basis while in my
presence, saying such things as 'mommy' and 'help me.' 'Help me' was,
in fact, one of her most frequent utterances. I heard her say it
hundreds of times. Terri would try to say the word 'pain' when she was
in discomfort, but it came out more like 'pay.' When I came into her
room and said 'Hi, Terri,' she would always recognize my voice and her
name, and would turn her head all the way toward me, saying,
'Haaaiiiii,' sort of, as she did. I recognized this as a 'hi,' which is
very close to what it sounded like, the whole sound being only a second
or two long. When I told her stories about my life, or something I read
in the paper, Terri would sometimes chuckle, sometimes more a giggle or
laugh."
The nurses said the Schiavo woman was often silent for hours and in a
"cold sweat" after her husband visited. It was her husband Michael --
now living with a woman by whom he has had two children -- who the
nurses said limited her rehabilitation and allegedly "intimidated"
staff at the nursing home -- charges that, if true, warrant a major
investigation. (Let us emphasize that thus far they are just that:
allegations.)
"I made numerous entries into the nursing notes in her chart, stating
verbatim what she said and her various behaviors, but by my next
on-duty shift, the notes would be deleted from her chart," claimed Iyer
in potentially devastating detail. "Every time I made a positive entry
about any responsiveness of Terri's, someone would remove it after my
shift ended. Michael always demanded to see her chart as soon as he
arrived, and would take it in her room with him."
Schiavo, they assert, was denied rehabilitation even though there was
evidence that at times she could swallow on her own. "I personally saw
her swallow the ice water and never saw her gag," said Law. "On three
or four occasions I personally fed Terri mouthfuls of Jello, which she
was able to swallow and enjoyed immensely. I did not do it more often
only because I was afraid of being caught by Michael."
The affidavits, it must be underscored, were conducted in 2003 on
behalf of the Schindlers, and as such are in the category of advocacy
for their position. Moreover, other nurses who tended to Terri have not
yet been fully debriefed in public. Some experts have asserted that
Terri's responses are not coordinated ones but nearly instinctual or
reflex-like, indicating no real awareness.
But the facts as presented in the affidavits indicate quite differently
-- if the testimony is correct, shockingly so. The two nurses portray
Terri as a woman who adores baths, liked having her hair combed, and
enjoyed a sweet-smelling lotion and soft nightgowns her mother
provided.
"Every day, Terri was gotten up after lunch and sat in a chair all
afternoon," said Law. "When Terri was in bed, she very much preferred
to lie on her right side and look out the window. We always said that
she was watching for her mother. It was very obvious that her mother
was her favorite person in the whole world."
It is now her parents and siblings who are desperately fighting to
prevent her husband from "pulling the plug" on feeding and hydration
tubes, which could occur as soon as this month if the Schindlers do not
win court victories. So far, judicial decisions have been baffling,
with little consideration to Schiavo's state when an actual appearance
by the woman might be all that is necessary to display her true
condition. Thus far, only the actions of Governor Jeb Bush and the
Schindler lawyers have prevented her death. But last week a Pinellas
County judge turned down a request to set aside his order allowing
Terri's feeding tube be removed, closing yet another legal avenue to
her parents in their quest to keep her alive.
Instead of rehabilitation, a "do not resuscitate" sign has been hung on
her door. The woman has been denied Holy Communion and Mass attendance,
her father told Spirit Daily two weeks ago.
Iyer claims that she "became fearful for my personal safety" and was
terminated after she called police about comments and activities at the
nursing home relative to the Schiavo woman. "When Michael visited
Terri, he always came alone and always had the door closed and locked
while he was with Terri," the affidavit alleges. "He would typically be
there about twenty minutes or so. When he left Terri would be
trembling, crying hysterically, and would be very pale and have cold
sweats. It looked to me like Terri was having a hypoglycemic reaction,
so I'd check her blood sugar." The glucometer reading would be so low
it was below the range where it would register an actual number
reading. I would put dextrose in Terri's mouth to counteract it. This
happened about five times on my shift as I recall. Normally Terri's
blood-sugar levels were very stable due to the uniformity of her diet
through tube feeding."
Added Law, the nursing assistant, "When she was upset, which was
usually the case after Michael was there, she would withdraw for
hours... Several times when Michael visited during my shift, he went
into her room alone and closed the door. When he left, Terri was very
agitated, was extremely tense with tightened fists, and sometimes had a
cold sweat. She was much less responsive than usual and would just
stare out the window, her eyes kind of glassy."

HIGH NOON IN U.S.: IF SCHIAVO IS ALLOWED TO DIE, IT WILL BE TO OUR
EVERLASTING SHAME
By Michael H. Brown
It's high noon in America when it comes to that disabled Florida woman
whose feeding tubes could be removed as early as this week and it is
beyond comprehension that a nation could sit back and watch the slow,
painful death of a woman who can talk, who is aware, who expresses
laughter, who has swallowed on her own, who expresses fear, whose
parents love her.
This is not a woman who wants to die; this is a woman who, against all
odds, has battled for 14 years now to live -- and who has been
mysteriously prone to utter the words, "Help me."
It is a woman who prays when a priest is there, who watches out the
window for her mother, who some believe could become a functioning
human being, could even speak whole sentences, with proper therapy --
which, apparently, she has not received for years.
Never has it been truer that all it takes for evil to triumph is for
the good to do nothing.
We're going to do nothing as the torment of her parents reaches an
excruciating and unimaginable climax?
We're going to let them pull the plug on her?
If this happens we can say that the home of the brave is anything but
the home of the brave and that the brave new world is really just a
world of cowardice.
Terri Schiavo cannot be allowed to die -- period. If she does, so does
a big chunk of the soul of America.
Where are we, U.S. Attorney? Where are we, George Bush? And Governor
Jeb: you've done some great things. Now we need you to seriously review
whether judicial authorities have ruled competently.
For years, her husband Michael has fought tooth and nail to end her
life. Her parents have fought just as hard to save her. The reaction of
local authorities -- especially the judge in the case -- borders on the
incomprehensible.
This matter must be taken out of their hands.
It has been a twilight zone that begs for federal intervention.
Those are strong words, but consider that the judge has never allowed
certain key witnesses to testify in open court about Terri's awareness
or even to bring Terri in so everyone can at least see her.
Instead, she is hidden in a tiny room, under her husband's thumb, with
virtually no stimulation, no therapy, just about no visitors...
The Pope himself has said that a person in Terri's condition should be
kept alive. So has an association of Catholic medical doctors. So does
anyone with decency.
There are what one former attorney, Pat Anderson, who heroically kept
Terri alive for more than three years, calls "true mysteries."
To wit: in 1991, after Terri exhibited pain during physical therapy, a
bone scan was done, and it indicated -- after the records were finally
revealed more than ten years later -- that Terri had what the
radiologist, Dr. Campbell Walker, described as a "history of trauma."
In a report on nuclear imaging it was shown that there was "an
extensive number of focal abnormal areas of nucleide accumulation of
intense type" at the ribs, the thoracic vertebrae (at the throat), both
sacroiliac joints, both knees, and both ankles. There were healed bone
fractures in Terri's ribs, pelvis, spine, and ankle.
In common parlance, said the doctor (in an affidavit compiled by
Anderson), at some point in the 12 to 18 months before the 1991 scan
(which was 13 months after the incident), Terri's back had been broken.
Was it from the physical therapy? Was it "hypertrophic ossification"?
Could Terri have been injured after her hospitalization? That's
certainly possible. Right after the bone scan, the therapists "ratched
down" Terri's therapy, according to Anderson, who unearthed the medical
records. Perhaps they feared they had injured her.
Still, argues Anderson, there is cause for a probe. But it must be done
immediately. Accent the word "probe": no one is making incriminations.
But says Anderson, "if this was anyone but Terri Schiavo, investigators
would have been all over this."
She calls the judge's actions in the Schiavo case "the rarest of all
legal phenomena." Has he been objective, or an advocate for letting her
die?
The concern is whether husband Michael should remain as Terri's chief
and in fact sole "guardian." There are those who assert that he has a
history of intimidation, that he became physical on one occasion with
Terri's own brother, that Terri had been talking about divorcing him,
that he threatened her sister Suzanne, that he frightened staff at a
hospice that cared for Terri, and former girlfriends, and so forth.
We have no definitive evidence, at this point -- which is why an
investigation is urgent, an investigation that could clear his name or
indicate deeper problems.
Here is a fact: Terri Marie Schiavo, age 26, of St. Petersburg, was
found unconscious at the door of her bathroom around 5: 40 a.m. on
February 25, 1990. Police responded after Michael had summoned
paramedics. The actual course of events and how authorities were
summoned is another issue too elaborate for discussion here. The
salient point: police got to the residence at 12201 9th Street,
apartment 2210, at 6:33 a.m. and because of the age of the victim and
the circumstances -- there on the floor -- automatically routed the
case to the homicide division, but took no further action when there
were no overt signs of foul play.
According to George Kajtsa, a spokesman for the St. Petersburg police,
"our job is to look for external signs of trauma" and there were none
reported -- no visible bruises or anything else that would lead to
active police suspicion. Moreover, he told Spirit Daily, a cat-scan
showed "no midline shift to the brain." Nor were there any official
records of marital abuse, such as requests (as is common in abuse
cases) for an injunction. A physical exam found no apparent trauma to
the neck or head.
As for why it was routed to homicide, Kajtsa says that "homicide always
investigates any unusual circumstances -- because she was young and
halfway out of the bathroom." But foul play was not suspected, he
emphasizes. Meanwhile, Michael and his legal representation have
steadfastly denied there had been violence of any sort; thus far, there
is no proof otherwise.
But the police spokesman said that in his view the Schiavo woman should
be allowed to die, and end her suffering -- indicating possible police
bias; and the judge -- without admitting much of the testimony about
her true condition into open court (saying it was not credible) --
apparently holds the same view. "The judge has become an advocate for
her death," argues Anderson.
Meanwhile, the state attorney has not entered the case as he should,
and the U.S. attorney finds reasons to stay away from this "hot
potato."
It is time for the federal government and Jeb Bush to take this bull by
the horns -- removing, as they can, anyone who has not conducted an
objective and thorough investigation. Such an investigation must ensue
before any further action concerning Terri's life support is taken.
It is increasingly baffling why such an investigation was not launched
years ago by competent officials. One registered nurse, Carla Sauer
Iyer, who was at Palm Garden of Largo Convalescent Center, where Terri
stayed from 1995 to 1997, was so perturbed over the situation
(including Terri's reactions to her husband) that she called the police
-- and, she says, was fired from the facility after doing so. A manager
at Palm Garden refused requests from Spirit Daily for information
regarding the Schiavo case and hung up the phone.
Could it have been what some assert: that her collapse was simply a
biochemical problem, a potassium imbalance?
Some say that is possible. Others, including famed medical examiner
Michael Baden, call it unlikely. This is why we need an investigation.
Was there any abuse? Or was it just a series of unfortunate events? Has
Michael been maligned, or are there yet more facts that need to
surface?
We urge the U.S. government to urgently visit this perplexing
situation, which thus far has been dominated, to be kind, by reluctant
local officials. "It is a true mystery," says Anderson. "I've never had
any litigation experience like this. The judge has become an advocate
for her dying. I filed the affidavits in support of a motion, and he
denied the motion and said the affidavits were not credible -- without
live witnesses. He was so extreme that he decided a witness's
credibility without seeing the witness."
We're not here to incriminate; we're not even here to judge the judge,
or the police, or anyone.
We're here to plead for the life of Terri.
We are certainly disturbed by how the case has been handled. Anderson
mentions the Pope's recent view on such situations -- which prohibits
good Catholics (like her parents) from allowing feeding or water tubes
to be removed.
"When the Pope said that, he did everything but put Terri's name it,"
says the lawyer -- who recounted times during the case when she went to
bed believing she had run out of legal options, only to awaken the next
morning with a fresh idea on how to keep Terri alive. "I felt the
Presence of the Holy Spirit many times in this case," she says. "When
the Pope speaks up for you, you can't be wrong."
Let us hope and pray that the Holy Spirit intervenes in the coming
days! Let us hope America stands up with the goodness it once had.
Terri can swallow; she has eaten Jello, according to another caretaker.
She reacts in specific ways to specific people. Anderson's husband used
to make her laugh. The presence of a priest causes her to focus
intently. She is an aware, sentient human who must live and who must be
given the type of therapy that one day might allow her to talk and
perhaps recount just what has happened since and perhaps before
February 25, 1990.

Michael Schiavo is described in 2 Timothy 3:3. The legal system is
described in Isaiah 1:5.
Concerning Schiavo, 2 Timothy 3:3 says that in the last days men would
be "without natural affection." This English phrase is a translation of
the Greek word astorgoi. For this word, the Bauer, Danker, Arndt &
Gingrich Greek Lexicon has the following: "of one who is lacking in
good feelings for others, thereby jeopardizing the maintenance of
relationships (e.g. political and familial) that are essential to a
well-ordered society; hardhearted, unfeeling, without regard for others
in a catalogue of vices Ro 1:31; 2 Ti 3:3."
Concerning the legal system, Isaiah 1:5 says of our leaders: "the whole
head is sick."
