Essentially. With one exception no one would argue such a thing in most
crimes.
Rape is the exception and is the only crime where the survivor is put on
trial in the rare case where it actually goes to trial.
Some 20 years ago a woman was raped in a horrible manner. She still has the
physical and emotional scars.
Recently a man was convicted of raping that woman. He had found her journal,
read it, and duplicated what happened in the original.
He got six months. The judge wanted him to have anger management classes and
he could not get them in the state pen.

From what I saw on TV it's considered MURDER when the fetus is killed
*against* the mother's wishes. Laci wanted her baby, or fetus. That made
all the difference.
When a women/girl finds herself with an unwanted pregnancy and decides to
abort - that's not murder. SHE decided, not someone else. No one in the
USA is forced to abort their baby, wanted or unwanted.
Connor was a wanted fetus/baby,... whatever you choose to call it.

This is what happens when people don't know the law. The Peterson case
only supports Roe v. Wade. The law he was convicted under had a
specific exception for a fetus. Why? Because otherwise, killing a
fetus isn't murder.
187. (a) Murder is the unlawful killing of a human being, or a
fetus, with malice aforethought.
(b) This section shall not apply to any person who commits an act
that results in the death of a fetus if any of the following apply:
(1) The act complied with the Therapeutic Abortion Act, Article 2
(commencing with Section 123400) of Chapter 2 of Part 2 of Division
106 of the Health and Safety Code.
(2) The act was committed by a holder of a physician's and surgeon'
s certificate, as defined in the Business and Professions Code, in a
case where, to a medical certainty, the result of childbirth would be
death of the mother of the fetus or where her death from childbirth,
although not medically certain, would be substantially certain or
more likely than not.
(3) The act was solicited, aided, abetted, or consented to by the
mother of the fetus.
(c) Subdivision (b) shall not be construed to prohibit the
prosecution of any person under any other provision of law.

Untrue. California law makes an exception for a fetus and Peterson was
charged under that exception. It didn't matter whether the fetus could
live outside the womb or not.
