Supreme Court Rejects Gay Marriage Case
(Washington) The US Supreme Court Monday declined to hear a challenge to
the Massachusetts court ruling that opened the door to same-sex marriage.
The decision effectively sidesteps the gay marriage issue. The justices,
as is the tradition of the court, did not give a reason for declining to
hear the case.
The court had been asked by conservative groups to overturn the year-old
decision by the Massachusetts Supreme Court legalizing gay marriage.
The Florida-based Liberty Counsel said in its brief to the court that the
US Constitution should "protect the citizens of Massachusetts from their
own state supreme court's usurpation of power."
The suit was filed on behalf of Robert Largess, the vice president of the
Catholic Action League, and 11 state lawmakers.
In a brief filed by the city of Boston in opposition to Liberty Counsel
attorney Merita Hopkins argued that Liberty Counsel had not shown they
suffered an injury and could not bring a challenge to the Supreme Court.
Massachusetts Attorney General Tom Reilly told justices that voters can
overrule the Supreme Court by adopting a constitutional amendment.
It was the second setback for Liberty Counsel which had earlier asked to
court to block the the state from beginning gay marriages. In May the
group asked the court to intervene and block clerks from issuing marriage
licenses to gay couples in Massachusetts.(story)
Liberty Counsel is involved in a number of challenges in other states to
laws granting rights to same-sex couples.
After the Supreme Court decided in May not to become involved in the gay
marriage issue some 3,000 same-sex couples have wed in Massachusetts.
Lambda Legal said it was not surprised by today's decision not to take up
the case.
"This was a weak and misguided legal effort from right-wing antigay groups
that never really stood much chance of being heard at the Supreme Court,"
David Buckel, Lambda Legal Marriage Project Director said.
Today's decision does not end the gay marriage issue for the high court.
Legal challenges to bans on same-sex marriage are underway in a number of
states and it is considered likely that the Supreme Court will ultimately
wrap the case together.
A weekend poll shows that most Americans still disapprove of same-sex
marriage. The Associated Press survey found that by a margin of 61
percent to 35 percent, people thought marriage should be restricted to a
man and a woman. However, young adults between 18 and 29 were about evenly
split.
Recent polls have indicated people are about evenly divided on the
question of civil unions, which would provide many of the same legal
protections as gay marriage.
"It's a welcome action but not unexpected because the Goodrich
[Massachusetts marriage] decision was based 100 percent on the
Massachusetts state constitution not the US Constitution. Therefore it
would have been inappropriate and a violation of federalism for the US
Supreme court to have gotten involved," Matt Foreman, the executive
director of the National Gay and Lesbian Task Force told 365Gay.com.

marriage ruling.

Besides, that's not what the proposed case was about. The religionist kooks
in Massachusetts were not challenging full faith and credit, they were
trying to use 'irreparable harm' to get the USSC to overturn the
Massachusetts state Supreme Court decision.
Until a legally married couple from Massachusetts moves to one of the states
where same-sex marriage is banned, the USSC has no reason to get involved.

They don't have to make a federal law. The "full faith and credit
clause" already accounts for this possibility.
Different states already have different contract laws and different
marriage laws. That's why you see language in limited warranties
stating that you may have more rights in your state than are granted
by the warranty.
According to the constitution, you can't get out of a contract by
moving to another state. All states must recognize contracts made in
other states (although they may administer them differently). That's
why people used to go to Reno for 6 weeks to get divorced--and that
divorce was still good in the other 49. (48 or 47 at one point :)
Another example: your driver's license is good in all 50 states. But
(another case of administering differently), even a valid driver's
license from another state doesn't give you the right to drive in New
York if you're under 18. (Though in this case, some might argue that
this does violate "full faith and credit". IANAL, so there may be much
more to this than I know.)

Nope, and that's why some of the most economically depressed towns in
the Commonwealth (who tend to be fairly conservative--for MA) were
issuing marriage licenses to same-sex couples in defiance of the
Governor for a while--there's no incentive like $$$.
I heard that there were 3,000 same-sex marriages since the ruling went
into effect. That's over about 8 months, although it won't be so high
next year because of pent-up demand. It will probably be much lower.
Still, gays tend to marry later and have less dependents, which means
spending more on a wedding, which already rings in at an average cost
of $20,000 (several sources). If there are 800 gay unions a year at
$30,000 each, that's $24 million dollars in spending. If 1/4 of that
is out-of-state, that's $6 mill in "free money" to which you can add
OTHER tourism expenses since everyone is traveling -- let's say that's
really $8 mill. $8 million net into the Mass economy (mostly stolen
from Vermont, no doubt ... which they probably can't afford to lose,
poor dears). Nice.
I wonder how much money VA is losing between active boycotts and the
complete ineffectiveness of their tourism advertising budget these
days. (Their slogan is "Virginia is for Lovers" but everybody knows
that's not true. However pretty the state is, their people seem pretty
ugly, making it seem like a rather unappealing place to visit.) Of
course, where VA really stands to lose is in small businesses avoiding
the place because of the confusing and fucked up state of contract law
in VA since the "anti-gay-marriage" bill.

Actually, given the numbers, it wouldn't be *anything. We're talking a
minority. It's not like there are bazzillions lined up just waiting to be
married. I mean, what's that sound you hear coming out of Massachusetts?

In the long run, the bigots are going to be seriously hurt by the fact
that gay marriage *actually *exists and *right *now in the US. And the
effect is...

Hey, isn't it true Massachusetts has one of--if not *the--lowest divorce
rates in the country?
Wouldn't that imply if you want to protect marriage, you *should
legalize gay marriage?
What boggles my mind is that these morons that wants to make gay marriage
illegal don't realize what a boon it would be to the economy. Think of
all the money rolling in from wedding planners, florists, caterers,
wedding halls, etc. Shoot, if I recall correctly, the marriage license
wasn't free either.
Actually, given the numbers, it wouldn't be *anything. We're talking a
minority.
A very tiny minority. Still, it's a little extra change (especially
for some of the more cash-strapped towns). Vermont probably got more
benefit out of civil unions in dollar terms because it's considered a
prime place for a vacation but is more out of the way (so it provided
an incentive) and their population, and therefore tax base, is much,
much smaller than Massachusetts.
I mean, what's that sound you hear coming out of Massachusetts?
Nothing? Silence?
Aside from a few remaining whiners ... yeah, pretty much nothing. The
whiners are screaming because nobody hears them.
In the long run, the bigots are going to be seriously hurt by the fact
that gay marriage *actually *exists and *right *now in the US. And the
effect is...
...um... how many ways can you say "nothing?"
Ditto for DP benefits, which many F500 companies offer these days.
Benefit to gays: huge. Negative to everyone else: almost zilch. (A
little chump change for companies, but many of them justify it as
another way to attract the best workers. Many more glbt people see DP
benefits as a plus when looking at a company than actually file for
them.)

I worked for a very progressive high-tech company in the early '90s that was
one of the first in the U.S. to offer domestic partner benefits. In response
to whining from a few religious titty-wringers, they monitored the cost of
providing those benefits and found that it was consistently a fraction of 1%
of the total employee benefits expense.
The whiners didn't like it, but since the company was pretty conscientious
about enforcing its non-discrimination policies, the whiners pretty much
just STFU and did their teeth-gnashing someplace else.

I didn't compare gay marriage to outlawing slavery, I compared one
"autocratic" act of the SJC to another, to demonstrate how silly that

There was no "law" allowing gay marriage. I guess
being "guardian of the law" allows for changes, only
when you agree with them.
