Complaint filed against Tenet's former general counsel

The federal government has filed a complaint alleging that the former
general counsel of Tenet Healthcare Corp. violated the False Claims Act,
the Justice Department announced Wednesday.
The suit contends that in 1997 and 1998, Christi Sulzbach submitted
false certifications to the Department of Health and Human Services,
which allowed Tenet to bill Medicare for millions of dollars in claims
that it was not entitled to receive. The false certifications relate to
contracts between North Ridge Medical Center in Fort Lauderdale and
certain employee physicians.
The government's complaint states that Sulzbach certified to the
Department of Health and Human Services that Tenet was in compliance
with all federal program legal requirements despite knowing that certain
North Ridge contracts were illegal under a federal law known as the
Stark Statute.
That statute prohibits hospitals from billing Medicare for referrals
from physicians with which the hospitals have financial relationships
unless those relationships meet certain strict conditions. At the time
Sulzbach signed the certifications at issue, Tenet's outside counsel had
concluded that the contracts between the physicians and North Ridge
violated the Stark Statute.
Although the government entered into a settlement with Tenet relating to
these physician contracts in 2004, that agreement did not release
Sulzbach's liability. Tenet agreed at that time to pay the United States
$22.5 million to resolve allegations of improperly billing Medicare for
referrals provided by doctors with whom the hospital had prohibited
financial arrangements.
The case is to be litigated jointly by the Justice Department's Civil
Division and the U.S. Attorney's Office for the Southern District of
Florida.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.
