Former pastor, school employee pleads no contest to sexual battery

A former Watsonville pastor and school district employee convicted of
child molestation in December pleaded no contest Friday to sexual
battery.

In a plea agreement, Steven Montes Martinez, 49, pleaded no contest to
charges that he raped a 24-year-old woman in Sacramento County in
1998. Detectives working on the molestation case learned of the rape
during their investigation.

The woman, who is now in her early 30s, was an immigrant from El
Salvador who lived in his Watsonville home in the mid-1990s,
investigators say.

Martinez had been set to go to trial in that case Jan. 31.

Prosecutor Dave Sherman said, "We agreed that he would plead guilty to
sexual battery, which means he had to use force or restraint on the
victim. In exchange we dismissed the rape charge."

Though the victim lives in Sacramento, the case was prosecuted here
because it's "so similar to the cases we convicted him on Dec. 19,"
Sherman said.

Per the agreement, Martinez will receive concurrent prison sentences,
but when he registers as a sex offender, he will have to include the
latest conviction. He could appeal the jury verdict, but he can't
appeal the sexual battery charge, Sherman said.

The victim would have testified, but "she's very traumatized by what
happened.

"She has a long-standing interaction with him because of both family
and acquaintances," Sherman said.

When the victim was destitute, her brother a paraplegic, Martinez and
his wife let her live with them. And when her mother died, he flew her
to El Salvador for the funeral.

"But at the same time he was exploiting her for sex," Sherman said.

Martinez will be sentenced Friday and could receive probation or up to
five years in prison.

Martinez, who still lives in Watsonville, remains out of jail on
$50,000 bail. His attorney, Bill Weigel, said accepting the plea
agreement was a "no-brainer."

"The most obvious reason was a substantial reduction in charges.
Sexual battery is much less serious and is not a strike offense. When
you include in that the agreement that there would be no additional
jail time imposed ... it seemed very much like a no-brainer."

He entered a no contest plea citing case history that the potential
consequences of conviction on the original charges would be so serious
that you're accepting a plea agreement as opposed to pleading as an
admission of guilt, Weigel said.

"It was his intention to take it to trial and fight the allegation,"
said Weigel, who was appointed to represent Martinez.

Martinez maintains he is innocent.

In December, a jury found Martinez guilty of four counts of child
molestation.

He was arrested in November 2004 and charged with four incidents of
molesting a 14-year-old girl in late 1993 or early 1994, while she was
a freshman at Aptos High School.

Martinez had worked as a scheduling technician for the Pajaro Valley
Unified School District from 1989 to 2004, but the girl was sexually
abused while attending a now-defunct Watsonville Pentecostal church
Martinez founded called the New Jerusalem.

Martinez, a past president of the Pajaro Valley chapter of the
California School Employees Association, said during his trial he was
innocent and perhaps the women had conspired against him to obtain
money in a civil lawsuit or because of resentment over the strict
doctrine he had preached.

"My feeling is that the community has lost a popular, dedicated and
hard-working man who had devoted his life to helping and not hurting
kids," said defense attorney J.J. Hamlyn, who represented Martinez in
the jury trial. "But these cases are extremely challenging. ... There
is always a sort of a built-in assumption of credibility on behalf of
the person making the accusation in a case like this."
