THEOCRAT ALERT This will be the batle ground for the next few years |
They already have at least one, maybe two maybe three USSC justices
calling for removing the Establishment Clause from incorporation
against the states.
This is the goal the theocrats have wanted since 1947
Everywhere you turn now you see this theme in some form or fashion:
(1) remove religion from judicial review from the courts
(2) the BORs only referred to Congress
(3) the attacks on judges, justices the courts in general
You see it more and more on conservative websites
More and more the "talking heads," the bigwigs of the radical
religious right, the theocrats, are talking as one on this
You even see it more and more in UseNet and all the other various chat
and discussion forums
These recent attacks on judges and justices and courts in general all
have the same outcome in mind. That out come is to take religion away
from the courts and end the application of the Establishment Clause
against the states.
That would in effect kill the rule of law given in Everson and every
strict separation of church and state ruling that has been handed down
since Everson.
Constitution Requires Separation Of Church And State

For years I have stated that "separation of church and state" does not
exist in the constitution. I was wrong. It does exist - in the
Constitution of the Union of Soviet Socialist Republics. In Article
52: Religion, it states, "In the USSR, the church is separated from
the state." Fortunately for us, we have the US Constitution to protect
us. Unfortunately for us, we have federal judges who interpret the
Constitution like the Episcopal bishops recently interpreted the
Scriptures.
Today in Alabama, because of an unconstitutional ruling by a federal
judge, Eleventh Circuit Judge Myron Thompson, we face a constitutional
crisis. Constitutional attorney Douglas W. Phillips, founder of the
Witherspoon School of Law and Public Policy, defines a constitutional
crisis as "...a showdown between competing governmental
jurisdictions," in his article supporting Justice Moore's stand. He
continues, "This showdown is all the more likely if the Governor of
Alabama sticks to his principles and supports Chief Justice Moore
against the unconstitutional order of the 11th Circuit Court."
The order is unconstitutional because under the United States
Constitution, each state has the right to govern its own affairs. The
Preamble to the Alabama State Constitution reads, "We, the people of
the State of Alabama, in order to establish justice, insure domestic
tranquility, and secure the blessings of liberty to ourselves and our
posterity, invoking the favor and guidance of Almighty God, do ordain
and establish the following Constitution and form of government for
the State of Alabama." Justice Moore would violate his oath to defend
the Constitution of Alabama were he to fail to acknowledge God.
More important, the order is unconstitutional because the federal
government (specifically the Congress) is prohibited from regulating
religion in any way. The First Amendment reads, "Congress shall make
no law respecting an establishment of religion, nor prohibiting the
free exercise therof." As Moore has pointed out, he is not Congress,
and no law has been passed. He is simply acknowledging the source of
law, God Almighty. That is what has many judges all across the land
red-faced with anger. They consider themselves the ultimate authority.
How dare anyone - even God - claim to be a higher authority than they?

What you say is totally irrelevant.
I see no evidence at all in anything you post or have posted that leads me
to conclude you are any kind of informed person that anyone should lend any
credibility or credence to on the topics you post on.
Your use of Keyes as your authority speaks volumes about where you are

Your Jefferson quoties do not impress me, in many ways Jefferson was
brilliant but in other ways he was as human and as incorrect as any other

I said it was modified, not revoked. The 1st reads, "Congress shall
make no law ...". The 14th reads "No State shall make ... any law ..."
The 14th modifies the 1st to effectively read, "Congress and the
States shall make no law ..."

How many times do you have to be told that basic reading skills and
some self-honesty will tell you that the establishment clause only
applies to the laws that Congress makes? The only reason that you're
upset that the USSC is going to "tamper" with the establishment clause
is because you continue to deny how section 1 of the 14th Amendment,
not the establishment clause, protects your personal federal rights
from abuse by state governments.

The courts need to protect our personal federal rights from abuse by
state governments.

The federal government has the federal BOR and the state governments
have their BOR's. See how the Gideon v Wainwright opinion, for
example, refers to the BOR as the federal BOR.

Judges who are swearing to defend the Constitution are turning around
and ignoring the Constitution. These judges have no business on the
bench. Thomas Jefferson warned about such judges:
