Mother lost custody despite lack of molestation charges

Frajhelle Stone hasn't seen her son for two years, ever since Child
Protective Services notified her that Arizona's child welfare agency was
placing the 5-year-old with his father.
A July 18, 2005, dependency petition filed in Superior Court here states
that the boy made detailed, credible accusations of sexual abuse by his
mother and her boyfriend.
"The child would be at imminent risk of harm if left with the mother,"
the document states.
The boy was made a temporary ward of the court.
Two years later, no one has been charged with molesting the boy, and he
continues to live with his father and paternal grandparents, where he's
been since summer 2005.
The parents divorced in 2005, and who has legal custody of him now -
Arizona or the boy's father - is unclear.
CPS spokeswoman Liz Barker Alvarez wouldn't say because such records are
sealed by state law, she said.
Frajhelle, 28, and Paul Stone, 49, provided the Tucson Citizen with
dozens of pages of documents in the dependency case in an attempt to
clear their names, they said. The couple are an example of a CPS case
involving parents who struggle to follow the CPS case plan and remain
separated from their children even though criminal charges are never filed.
Frajhelle Stone said it's been a year since she heard anything about the
boy.
The child welfare agency began investigating the boy's parents in 2001
after receiving complaints that he was being abused and neglected.
Between 2001 and 2005, law enforcement officers and CPS investigators
looked into multiple allegations that the boy was being neglected and
abused by his mother, father, the mother's boyfriend and other
relatives. No criminal charges have been filed against any of them.
In one instance, emergency room doctors called the CPS hot line to
report a fractured elbow. The type of break doctors found usually
results from an inflicted blow to the arm, they said, according to a CPS
report. The allegation of abuse was "unsubstantiated," according to the
report.
The boy's parents divorced in 2005. In 2006, Frajhelle Stone married
Paul Stone, who has been accused of molesting her son. A CPS caseworker
noted in the file that the marriage was a mistake on Frajhelle's part.
CPS concluded that all the allegations of sexual abuse were the result
of a "highly dysfunctional relationship" between his biological parents
and suggested each had coached the boy to report detailed incidents of
sexual abuse at the hands of the other.
A forensic examiner did not find evidence the boy had been molested. A
police report in the CPS file said the boy had been interviewed so many
times about the allegations that they could not proceed with a criminal
case because it was difficult to determine whether he was telling the truth.
Frajhelle and Paul Stone said in an interview with the Citizen that they
never touched the boy inappropriately.
"I have nothing to hide," Paul Stone said. "I want to clear my name."
The records include a psychologist's report to CPS that said the child
was doing well in school and at home under his father's care. His asthma
symptoms had disappeared, and he was receiving proper medical and dental
care.
Frajhelle Stone had smoked around the child, and she admitted she
accidentally burned him with a cigarette.
The records show that Frajhelle did not do all that was recommended in a
CPS "family intervention plan," which aimed at "family reunification by
(February) 2006."
She is disabled by bipolar disorder and has struggled with an addiction
to pain pills, she said.
She was to complete an outpatient addiction treatment program and "learn
more appropriate behavior at home." She also was to complete a sex
offender treatment program and finish classes on parenting skills and
child development.
Frajhelle said her ability to access these services has been complicated
by a lack of transportation since 2005.
She lives in Catalina, about 10 miles from a bus line, and the Stones'
vehicle is often sidelined for repairs, she said.
She plans to enroll in an intensive outpatient addiction treatment
program, she said, and has been trying to reach her CPS case manager in
recent weeks but hasn't received a call back.
Alvarez said the CPS case is "no longer open."
Frajhelle said her income level shouldn't have been an issue in the
custody case.
"CPS told me I wasn't a good mother," she said. Frajhelle said CPS
workers told her that because she lives on disability payments, she
"couldn't afford to raise my child."
"There's a lot of people on disability that raise children," she said.
