NOBLESVILLE -- The mother of a child-molestation victim has filed a
civil lawsuit against the former employers of Cory Heinzman, a Child
Protective Services caseworker who was found guilty in June of 17
sex-related charges.

The lawsuit, which alleges negligence in hiring, was filed Monday in
federal district court against two former employees of the Hamilton
County Department of Family and Children, the former secretary of the
Indiana Family and Social Services Administration (FSSA) and the current
FSSA secretary.
According to attorney Ronald W. Frazier, an identical suit was filed in
2005 by the family of a teenager who said he was molested by Heinzman.
That family also has another civil case pending in a Marion Superior
Court, but that one names Heinzman as a defendant. Frazier is
representing the plaintiffs in all three cases.
In 2005, the two boys who had met Heinzman in his role as a caseworker
accused him of sexual misconduct. The boys were 13 and 15 at the time.
During Heinzman's trial, which involved seven days of testimony and 13
hours of jury deliberation, the boys, now 16 and 18, testified that
Heinzman touched them inappropriately numerous times in 2004 and 2005.
Heinzman, 38, Arcadia, was sentenced Sept. 5 to 106.5 years in prison.
Named in the civil suit are Karen Beaumont, former executive director,
and Nicole Sparling, former child welfare supervisor, at the Hamilton
County Department of Family and Children; Cheryl Sullivan, former FSSA
secretary; and Mitch Roob, current FSSA secretary.
The lawsuit claims that those four were negligent when they hired
Heinzman, failed to notice that he was a pedophile and allowed him to
have access to the teenage boys.
Hamilton County Deputy Prosecutor Stephanie Smith prosecuted the case
against Heinzman. She said Wednesday that the former caseworker had no
previous criminal history prior to the report made by the boys.
Marcus Barlow, the FSSA director of communications and media, said he
couldn't comment about the agency's hiring procedures because the
Indiana Department of Child Services (DCS), which was formed in 2005,
now hires caseworkers.
"We don't hire anymore," Barlow said.
According to the DCS Web site, Gov. Mitch Daniels established DCS "to
better care for children by providing more direct attention and
oversight in two critical areas: protection of children and
child-support enforcement."
Plaintiff's attorney Frazier said the mother who filed the lawsuit
Monday wanted to wait until Heinzman's criminal case was decided before
filing a civil suit. Frazier hopes that both federal lawsuits will be
folded into one case for a jury.

Imagine that, 6.4 children die at the hands of the very agencies that

and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.
