Object: THE JUDICIAL SYSTEM
The American Judicial system is in a critical
state of affairs because it no longer is able
to respond to the desire of the people for
justice .
The Attorneys General are nothing more
than a bunch of political hacks for the President .
The Grand and Petit Juries have been all but
emasculated by prosecutors . Judges are not
appointed by the people , but by politicians to
serve a political purpose . Prosecutors have been
given enormous powers whereby they are free to
suborn perjury without penalty . To abuse the
Grand Jury and to withhold information from the
defense without sufficient penalty to themselves
personally . The abuses do not end there but
I must for now .

To Everyone :
In order for mankind to progress and function in any
form in a secure society which honors the rule of
law , provides justice for the people who go before
it , and instills confidence in the people under it
and
that it exists only to serve them and not the
powerful ,
the wealthy , or the corrupt ; That system must be
able and willing to respond to the wishes of the people .
If the people come to the final judgement that
their judicial system no longer either involves or
serves
them , then that society is doomed and deserves to be .
In the words of our Declaration it would become our
right and ,indeed , our duty to abolish it .
This may be done by either one of the two means
used by mankind from the beginning . By agreement or
by violence . I do not advocate violence because these
problems are easily solved non-violently . But any
student
of history understands the consequences of extended delay
in such matters . We shall pray that those who love
freedom and justice and the powers and rights of mankind
shall be sufficient to turn the tide of history before
it
overtakes us .

Ok...translated...'The system stinks...let's change it'.
What are your specific ideas for that change?
BTW...your font and formatting mess up on my reader. Is anyone else having
this problem with
Ledraychere's postings? It is a different font from everyone elses though.

To Tooly :
I'm sorry about the font . I'm new
at this .
The place to start is the Grand Jury .
It must have restored to it what it originally
had . It was conceived as a means
whereby the citizens could decide at the
beginning of a case , whether or not it
would be prosecuted . It's decisions were
supposed to be a final disposition as to
whether their would be a trial . Today , no
Grand Jury , in fact , has this exclusive
power . The purpose was to establish the will
of the people at the beginning of a criminal
proceeding so they would be a gatekeeper
at the beginning of our system . Just as the
Petit Jury is supposed to serve the same
purpose at the end . Today , even the Petit
Jury has only that authority which the judge
permits it to have .
By doing what prosecutors do at the
beginning and what judges do at the end
they now have total control over our courts .
I make the following proposals :
1. All criminal cases under investigation by
the law enforcement officials are to be
submitted directly to the Grand Jury and
the Grand Jury shall have the power to
hear all evidence with respect to each case
before it . The Grand Jury may also decide
and make all judgements with respect to
the gathering of evidence in each case .
2. The Grand Jury shall have the following
options with respect to the disposition of
each case before it .
A . It may decide to issue an indictment .
B. It may decide to make a public declaration
of "innocence" with respect to an individual
under investigation .
C. It may decide to "set aside" a case until
further evidence is obtained .
D, It may decide to pass the case to a
succeeding Grand Jury
E. It may decide to create a "special " Grand
Jury to pursue extraordinary cases of
corruption and conspiracy engaged in by
public and private officials holding positions
of power and authority . Such panels
would continue until the Grand Jury had
disposed of the case by returning it to
a regular Grand Jury for disposition .
There are other things as well but this is a good start .

We are all innocent until proven guilty. Your comments implies that
the person would be guilty. By dismissing charges against a person, a
grand jury in effect has confirmed that person innocence.

We are all innocent until proven guilty. Your comments implies that
the person would be guilty. By dismissing charges against a person, a
grand jury in effect has confirmed that person innocence.

To Michae :
I wish that were true Michae , but under the present
circumstances in which we function both as a society
with our media and public perceptions the power is
and will be , in the future more than now , a critical
element in our judicial system . We might as well
give the Grand Jury that power now , it will need
it from time to time . And what a great power that
would be for a man unjustly accused and thought
or assumed to be guilty .
