Nearly nine years after he sneaked into a Southeast Portland (Oregon)
woman's apartment and raped her, 35-year-old Armando Duran-Maya was
sentenced to nearly a decade in prison.
Duran-Maya was unapologetic at hearing, saying through an interpreter
that the case against him was "false."
A jury, however, unanimously found Duran-Maya guilty last month of
first-degree rape, partly based on DNA evidence linking him to the
crime.
Prosecutor Don Rees successfully argued that Duran-Maya was the masked
stranger who crept into the woman's Powell Boulevard apartment through
an open door on an August 1998 night. Duran-Maya grabbed a kitchen
knife, awoke the woman and told her to comply or he'd kill her, Rees
said.
Police collected DNA from the victim, but it didn't match any known
felons at the time.
In 2000, Duran-Maya was convicted of felony attempted arson, and his DNA
was entered into the criminal database. In late 2002, authorities
received word that his DNA was a match to the 1998 rape. A grand jury
indicted him in early 2003.
It would still be years, however, before Duran-Maya would be brought to
justice.
As Duran-Maya awaited trial, he was transferred to Clark County to face
charges of assaulting his girlfriend. The case was later dropped.
Simultaneously, an INS hold on Duran-Maya also was dropped. Duran-Maya
walked out of jail, but was ordered to report to Multnomah County's
pretrial supervision program. He never showed up.
United States marshals, who tried to track him down, learned he might
have fled back to Mexico.
Then in fall 2006, police in Washington received a tip that Duran-Maya
was in Puyallup. When Duran-Maya saw them coming, he ran. Trapped by a
river, police found Duran-Maya cowering in the bushes.
During sentencing, prosecutor Rees argued for a stiff sentence because
Duran-Maya has tried to do everything within his power to "beat the
system."
Rees also said the 1998 rape victim is still so traumatized she backed
out of today's hearing because she couldn't bear being in Duran-Maya's
presence again.
Judge Cheryl Albrecht sentenced Duran-Maya to more than 9 1/2 years in
prison, at the top end of the sentencing range. He will have no ability
to earn time off for good behavior, and he will face deportation when
his sentence is complete.
"I don't think any lecture I'd give you Mr. Duran-Maya would do you any
good," Albrecht said.
The judge told Duran-Maya that not only has he devastated his victim,
but "you also ruined your own life in the process."

alien's nearly-homicidal arson, committed a year after his horrific rape of
the U.S. woman:

Fire investigators arrested a 28-year-old Hillsboro man Friday on
accusations he set a fire that threatened the lives of at least 11
people in a Southeast Portland apartment building last month.
If convicted, Armando Duran-Maya could face more than 80 years in jail
under Measure 11 sentencing guidelines, investigators said.
Witnesses told investigators they saw a man strike a match to a small
cooler full of gasoline in front of a second-story doorway of the four-
unit complex at Southeast 129th Powell Boulevard around 11 p.m. Sept.
20.
The fire forced people to jump from balconies to escape the flames,
and at least three children under the age of three were lowered or
thrown to people below. Although there were no serious injuries, fire
officials said it could have been much worse.
"There's no doubt in my mind that if this had happened two or three
hours later when everyone was asleep, we would have had a fire
death,'' said Detective Sgt. Bill Law, a Portland Police Bureau
detective assigned to the Portland Fire Bureau's arson detail.
Law said he and arson investigator Rick McGraw are looking for a
second suspect involved in the fire. Law said it appeared the fire was
set out of revenge or spite against a resident or residents who lived
there.
The fire displaced 14 people and caused an estimated $120,000 in
damage to the building and its contents.
Duran-Maya will be arraigned today on one count of first degree arson,
and 11 additional counts of arson for endangering the lives of the
people who lived in the residence. He also faces one count of criminal
mischief.
He was lodged in the Justice Center Jail with bail set at $605,000.
Law said the 11 counts of enhanced first-degree arson -- that is,
arson set in a place customarily used as a residence that threatens
injury or death to residents -- carry a minimum mandatory sentence of
90 months each.
