Just months after he declared that the principle of habeas corpus, or the
right to due process -- one of the most fundamental principles of our
republic -- is invalid, Attorney General Alberto Gonzalez (the Hispanic
Hitler?) has announced his support of a new law that would allow him and
all future attorneys general to nullify U.S. citizens' Second Amendment
rights without due process.
I hope the quotes of one of our nation's founding fathers which I have
inserted throughout the following report still make sense to some
Americans.

Gonzales Wants Arbitrary Power to Block Gun Purchases; SAF Says He Should
Resign

BELLEVUE, Wash., May 1 /PRNewswire-USNewswire/ -- Attorney General Alberto
Gonzales' troubling support of legislation that would allow him and future
attorneys general the arbitrary power to block firearms purchases without
due process is cause for him to step down as the nation's highest ranking
law enforcement officer, the Second Amendment Foundation said today.

The bill, S. 1237, was introduced last week at the Justice Department's
request by Sen. Frank Lautenberg (D-NJ), one of the most extreme
anti-gunners in Congress. Called the "Denying Firearms and Explosives to
Dangerous Terrorists Act
of 2007," this legislation would give the Attorney General discretionary
authority to deny the purchase of a firearm or the issuance of a firearm
license or permit because of some vague suspicion that an American citizen
may be up to no good.

bear arms is, as a last resort, to protect themselves against tyranny
in government.

"This bill," said SAF founder Alan Gottlieb, "raises serious concerns about
how someone becomes a 'suspected terrorist.' Nobody has explained how one
gets their name on such a list, and worse, nobody knows how to get one's
name off such a list.

"The process by which someone may appeal the Attorney General's arbitrary
denial seems weak at best," Gottlieb suggested, "and there is a greater
concern. When did we decide as a nation that it is a good idea to give a
cabinet member the power to deny someone's constitutional right simply on
suspicion, without a trial or anything approaching due process?

"We're not surprised that General Gonzales has found an agreeable sponsor
in Frank Lautenberg," Gottlieb observed. "The senator from New Jersey has
never seen a restrictive gun control scheme he did not immediately embrace,
and S. 1237 is loaded with red flags. It would allow an appointed
bureaucrat the authority to suspend or cancel someone's Second Amendment
right without even being charged with a crime.

over any tenet in the Bill of Rights," Gottlieb said. "He took an oath to

Attorney General Torquemada's dismissal of the hallowed Geneva Conventions:
The Quaint Mr. Gonzales

"Notwithstanding his mild-mannered appearance, Gonzales is the iron fist
in the velvet glove. Gonzales, whom Bush affectionately calls "mi abogado"
("my lawyer"), wrote one of the most outrageous torture memos. On January
25, 2002, Gonzales advised Bush that "the war on terrorism is a new kind of
war, a new paradigm [that] renders obsolete Geneva's strict limitation on
questioning of enemy prisoners and renders some of its provisions quaint."
Oh really? The "quaint" Geneva Conventions are treaties ratified by the
United States, and therefore part of the supreme law of the land under our
Constitution.
Gonzales also provided Bush with novel defenses against potential war
crimes prosecutions that might result from torturing prisoners captured in
Afghanistan. The 1996 War Crimes Act says that grave breaches of the Geneva
Conventions are war crimes. Thus, the definition of war crimes includes
torture, inhuman treatment, and willful killing, as well as outrages
against personal dignity. Gonzales advised Bush that he could avoid
allegations of war crimes by simply declaring that Geneva doesn't apply to
the war against the Taliban and Al Qaeda in Afghanistan.
When Colin Powell saw Gonzales's memo, he reportedly "hit the roof."
Powell wrote a counter-memo to Gonzales and Condoleezza Rice, warning of
the immense damage this could do to the United States - legally,
politically, militarily, diplomatically, and morally. To declare that the
Geneva Conventions did not apply, Powell wrote, "will reverse over a
century of U.S. policy and practice in supporting the Geneva conventions,
and undermine the protection of the law of war for our troops, both in this
specific conflict and in general."
