Rep. Blundell Pleads No Contest In Sex Assault Charge
Defense Asks For Conviction To Be Deferred
September 3, 2004
HONOLULU --
Republican state Rep. Brian Blundell pleaded no contest Friday to a
misdemeanor sex assault charge.
Police arrested Blundell in Kapiolani Park in July for allegedly
groping the crotch of an undercover officer.
Blundell, 63, is a first-term lawmaker from Maui.
Blundell was arrested July 15 for reportedly groping an undercover
police officer in a Kapiolani Park Restroom.
"You did knowingly subject another person to sexual conduct by
compulsion or cause another person to have sexual contact with you by
compulsion. That is sexual assault in the fourth degree. How do you
wish to plea?" Judge Lono Lee said.
"I want to plea no contest," Blundell said in court.
Blundell's attorney, Howard Luke, asked the judge to have Blundell's
conviction deferred.
If that's accepted, and Blundell follows the judge's terms for a year,
he could avoid a permanent criminal record.
The deputy prosecutor objected.
"The seriousness of sex assault in the fourth degree applies to
anybody whether it is a person on the street or a community leader
such as Mr. Blundell," deputy prosecutor Leilani Tan Ching said.
