A 9-year-old boy was charged yesterday with fatally beating an infant,
who suffered multiple skull fractures when he was struck on the head at
their Woodbridge day care center last week, authorities said.
Police also charged the center's owner, 64-year-old Beverly Bryant, with
child endangerment, contending she left 11-month-old Tahir Francis alone
with the 9-year-old, who attacked the infant after Bryant went upstairs
to do some chores.
The 9-year-old, one of the youngest people ever accused of homicide in
New Jersey, remained in his parents' custody after a Family Court judge
told them the boy faces a delinquency charge in Tahir's death last Thursday.
The Middlesex County Prosecutor's Office said the juvenile charge would
be equivalent to aggravated manslaughter if he were charged as an adult.
The boy, whose name was withheld by prosecutors, was placed under house
arrest and may not leave without a parental escort. He is expected to
undergo a psychological evaluation and counseling before he returns to
court next month.
Bryant, and the parents of the 9-year-old, surrendered to authorities
yesterday afternoon when informed of the charges. Bryant, owner of
Beverly Bryant Family Day Care, appeared in New Brunswick before
Superior Court Judge Joseph Rea, who released her without requiring
bail. If convicted, she faces a prison term of five to 10 years.
Her husband, Stanley Bryant, is a case worker for the state Division of
Youth and Family Services, which investigates child abuse and neglect in
New Jersey. Kate Bernyk, a DYFS spokeswoman, said the state Office of
the Public Advocate will investigate Tahir's death to avoid the
appearance of a conflict.
Beverly Bryant has operated the licensed day care center in the basement
of her home on Carver Street in the Iselin section of Woodbridge for the
past 12 years, and was caring for five children, including the
9-year-old and 11-month-old Tahir when he was killed, authorities said.
Three other children who were not identified were also left alone in the
basement at the time the attack occurred, authorities said. Middlesex
County Prosecutor Bruce Kaplan declined to say how long the children had
been left unsupervised. Bryant was the only adult working at the center,
Kaplan said.
Christian Fleming, an East Brunswick attorney representing Bryant, said
"she was incredibly shocked to hear that a complaint had been signed
against the 9-year-old. She has cared for the 9-year-old since he was 2
years old."
Fleming said Bryant quickly tried to revive the baby and called a
neighbor and 911 for help as soon as she realized Tahir was in distress.
"She was told by the 911 operator to put the child down and to put a
cold towel on his head and that's what she did," Fleming said. He said
Bryant has never been in trouble and has been a respected member of the
community. The judge took that into consideration when he released her
without bail on a serious criminal charge, the lawyer said. Before
opening the day care center, Bryant worked as a nurse's aide.
"She cooperated fully with the police investigation," Fleming said. "She
sat down with the police and gave them a statement and she wants to
assist in any way she can. Her heart goes out to Tahir's parents."
Kaplan said the 911 call was made at 12:54 p.m. on Aug. 23. Emergency
workers rushed Tahir to JFK Medical Center in Edison, where he was
pronounced dead at 7:34 p.m. An autopsy showed the infant sustained
multiple skull fractures. Kaplan said he could not disclose the number
of times the baby was struck and declined to say how the injuries were
inflicted.
Kaplan also declined to provide a motive for the attack. He said the
9-year-old and Tahir were not related. He also said the 9-year-old is
not related to Bryant.
As part of her release from custody, Bryant may not have any contact
with children under the age of 16 and may not reopen her day care
center, which was shuttered by DYFS.
The arrest of the 9-year-old is not the first time a youngster was
charged with a homicide in Middlesex County.
Aaron Kean was a troubled 10-year-old and prone to violence when he
fatally beat 3-year-old Amir Beeks in Woodbridge on March 27, 2003.
Aaron subsequently pleaded guilty and was sentenced to 18 years in
juvenile custody.
Another 9-year-old boy from Old Bridge was charged 20 years ago with
killing his baby sitter, who was stabbed in the chest with a pair of
scissors when she refused to let the youngster watch a favorite TV
cartoon show. The outcome of the case was never disclosed.

citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.
