We know the IRS is short on examiners, revenue agents, etc., but their
real problem seems to be a lack of intelligent "spin doctors" (a.k.a.
propagandists).
Psychological Warfare Rule #1: Don't make everyone on the planet hate your
guts.
There are limits on what outright thuggery (the IRS' main tool... maybe
their ONLY tool) can achieve. For example, if you steal 300 copies of a
video, you look like a fascist censor, and (golly gee) the issue spreads
further. But IRS counter-productive thuggery doesn't just happen to us
"radical extremists."
Recent stories show that the IRS, with the help of "the courts," have
frozen many millions of dollars' worth of assets of thousands of doctors
and dentists, in some plan (unrelated to the 861 evidence) which the IRS
is calling an "abusive tax shelter." In other news, the IRS has LOST
three recent "tax shelter" cases, one against GE, and one against Black &
Decker (as I recall). Now they are after KPMG, a "status quo" tax
preparation company, for another (surprise, surprise) "abusive tax
shelter."
That's just plain stupid (but I'm happy to see it). The feds are making
enemies left and right, including among people who play the game by the
rules (even if they disagree a bit about what counts as "by the rules").
This is akin to an occupation army indiscriminately killing civilians.
The peasant thinks: "Well duh, if you might kill me anyway while I'm
saying 'yes, massah,' I might as well take a few pot shots at you first."
The IRS already can only follow up on a small percentage of the
"delinquent" cases they KNOW about. So what do they do? Go out of their
way to start MORE fights with OTHER people. Brilliant. Just brilliant.
Oh, and there's one other thing to consider: "If you're going to be this
big of a pain when I DO file, well maybe I won't bother anymore." The IRS
is so desperate, and so eager to be seen as the big, bad menace, that it's
stumbling around shooting its ALLIES in the status quo tax preparation
industry. And guess where those former allies will turn. All I can say
to that is "go get 'em, feds!" The best way to drive people to look into
the 861 issue is AUDIT THEM.
