Foster Parents Can Remain Silent in Missing Child Case

A judge told the foster parents Monday they will not have to answer any
questions about the disappearence of two-year-old girl. That leaves some
people to wonder why not, and what happens next?
The foster parents have avoided police since the day after Everlyse
Cabrera disappeared from their home. It seems even the courts can't get
them to talk.
During recent civil depositions, Manny and Vhee Carrascal pleaded the
Fifth Amendment to the bulk of questions posed by attorneys for the
Cabrera family.
The Cabrera family is suing Clark County and the Carrascal's for the
loss of their daughter.
Hoping to force cooperation, the lawyers asked the court to compel the
couple to respond. But Judge Lawrence Leavitt found Manny and Vhee
Carrascal had the right to avoid self-incrimination and remain silent.
David Gibson, attorney for the Cabrera family, said, "It's very hard on
my clients. It's hard on us. We're personally and emotionally invested
in this. We've spent a lot of hours preparing for the opportunity to get
some answers. It's kind of a let down to not get some of the ones we're
looking for."
The Carrascal's will have to answer some questions the judge found did
not have the potential to incriminate them, like some personal
information and questions related to their foster care license application.
Also, Vhee Carrascal answered more questions during her deposition than
her husband did. So the judge has asked the attorneys for a list of
those to consider whether her husband will have to answer them as well.
The bottom line is a two-year-old child disappeared from their home and
she has not been found yet, and they don't have to say anything about it.
