Godaddy.com, and Internet Menace? |
I've received this email by John. T. Markham from a friend of mine,
asking to post it. I've had some bad experiences with godaddy.com
myself, so basically, I concur with the opinions, expressed below.
Sorry if the formatting is screwed, my news client does it a lot. It
was nice, when I received it.

An Open Letter and four questions to Bob Parsons, Godaddy.com Owner
and President
Mr. Parsons:
I'm truly shocked by the amount of negative information and
expressions of massive outrage, popping up everywhere on the Net,
about extremely immoral and illegal practices of godaddy.com. People
from all over the world are complaining about godaddy.com acting as a
sole King, Judge, Jury, Executioner and even as a rutless robber on
the Internet Superhighway.
Bluehost.com president Matt Heaton claims, that they are going to
terminate their corporate account with Godaddy and take their $70K per
month business elsewhere, due to your extremely poor service and
outrageous behaviour.
The reputable and influential CNet currently posted an article, which,
in essence, claims that godaddy.com is an enemy of free speech on the
Net.
There are numerous claims of domain theft by godaddy.com, of extreme
censorship, of taking their customers' money and terminating their
prepaid services for no justifiable reason, providing no venues to
remedy any harm, no ways to arbitration,
review, etc., etc., etc. I'm not sure any Internet business entity
would be proud of the attitude, expressed in your Terms of Service,
such as:
"IN NO EVENT SHALL GO DADDY BE LIABLE FOR ANY DIRECT, INDIRECT,
INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES
(INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR
SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS
INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER
IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING
NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE
SERVICES, EVEN IF GO DADDY IS AWARE OF OR HAS BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGE."
In other words, you have rights to harm, abuse, neglect, steal,
interphere, or do anthing you want, no exceptions, with your
customers' businesses, domain names, anything and everything within
your reach, and no one has the right to demand any responsibility, any
accountability from you. You have all the rights you choose to have,
at your sole discretion, but your customers have none whatsoever.
Wasn't this an attitude, fostered and practiced by Joseph Stalin,
Saddam Hussein? I admit,you're not killing your customers yet, but in
general, it's a similar state of mind, in my humble opinion.
And this is what follows in your mandatory TOS Agreement:
"Notwithstanding anything to the contrary in this Agreement, in
addition to any and all other remedies to which Go Daddy is entitled,
Go Daddy specifically reserves the right to (i) immediately suspend
any domain names that Go Daddy believes in its
sole discretion to be violating the terms of this Agreement, (ii)
charge You a Twenty Nine and No/100 Dollars ($29.00) administrative
fee for any and each domain name that Go Daddy believes in its sole
discretion to be violating the terms of this Agreement, (iii) require
the forfeiture of any previously earned revenue in connection with the
Services, which has yet to be paid, (iv) deactivate any and all
accounts and domains that Go Daddy believes in its sole discretion to
be violating the terms of this Agreement, and (v) provide advertising
partners with any and all domain names that Go Daddy believe in its
sole discretion to be violating the terms of this Agreement."
(It's truly unfortunate, that most people are desensitized and
conditioned not to read any of such legalese, when signing up for
services).Once again, you Sir have proclaimed yourself and your
Kingdom the sole ruler, the sole authority, which can do anything at
anytime, "at your sole discretion" to any customer of your company and
to their property. It's nice you don't yet claim you also have
exclusive rights to their wives, sisters, children, real estate, and
their souls.
Question No 1. What is going on?
Question No 2. Don't you care about what people are saying, writing,
screaming about your company?
Question No.3. Do you think Godaddy.com can get away with practicing
toalitarian tyranny and mob-style rule of the Net and survive as a
business enity, in this age of massive information exchange?
Question No 4. You claim that you are an American patriot. How do you
think your tyrannical and mob-style actions are representing American
moral and business values in the eyes of the world?

Looking back at your biography and at the history of your company, it
seems you used to be a very decent man, running a very decent
business, providing friendly, high quality service. What happened?!

Thats an ICANN rule dumbass. ICANN requires you to have VALID info in your
WHOIS info. If you dont and you get reported then YES you lose the domain.
This is NOT GoDaddys fault, its the dumbass that input the wrong info. I
report domains all the time for having an invalid phone number or email
address. GoDaddy is not the only one to remove domains for invalid info.
And this is invalid: Registrant Street2:Domain May Be For Sale
So you may wish to fix your domains WHOIS info. Ill give 24 hours and then
Ill submit a report. And yes eNom does remove domains for invalid info so
you are NOT safe...
OK, so if they call a phone number listed as a Microsoft.com Administrative
contact, and, for some reason, no one answers that call, they can take their
domain name over and demand a ransom from Microsoft Corp. if it wants to get
it back. Yeah, that's what you rightard extremists are trying to impose upon
the rest of the world and that's why the rest of the world is fighting you
back. And you, fucking rightard bastards, are going to lose, just like
everyone of your kind lost it until now and will lose in the future.
And, BTW, in case of Godaddy.com, if they want that domain, they will take
it over "due to incorrect WHOIS records", regardless if you answer that call
or not.
And there will be no recourse, no remedy, since they stated in their TOS
that they can do anything they want and you can do only what they will "deem
