JUDGE & SHERIFF BATTLE OVER PARIS HILTON!! |
Yup.........This is getting FUNNY..............The Judge runs the
Courtroom and the Sheriff runs the Jail............The Judge can
Decree whatever Sentence he wants, but the Sheriff HAS THE POWER to
Determine how long he wants someone kept in His Jail............If
the
Judge can charge the Sheriff with "Contempt of Court", then the
Sheriff can have the Judge ARRESTED for INTERFERING with the
Police............Such as it is in the American Justice System run by
Petty Bureaucrats DRUNK with POWER...........Ain't it a
HOOT?............

Actually, it's not funny at all. Indeed, for you to laugh at the
problems of the criminal justice system is an insult to victims of
crime and in incredibly bad taste. But then again, you find it a big
joke that our soldiers are dying overseas for our country.
Celebrity worship aside, perhaps this situation may shed some light on
the hellhole our nation's jails and prisons have become. County jails
are particularly bad.
In an article on MSNBC, they reported how Arizona locks up sick people
(innocent of any crime and under health quarantine) in conditions
worse than given to serial murderers in supermax prisons. No
necessary medical treatment provided. No exercise or fresh air or
sunlight, critical for health reasons. No chance to appeal, no legal
rights.

In a related article on MSNBC, it discussed what happens to other
people when they are put in "quarantine". It is not an issue normally
discussed.
Neither are the hellholes of county jails. I could care less about
Miss Hilton, but maybe the attention to what actually goes on in the
jail--with its severe overcrowding and lack of services--will bring
some reform. Keep in mind many housed in that jail are merely
awaiting trial (can't make bail) and not convicted of any crime.
Others are in jail for petty crimes.
I don't care if you want to put people in jail. But if you do, do so
under reasonable conditions; don't pack three people into a cell built
for one, and don't use common areas for still more housing.
Given the lousy treatment and lack of services, it's no wonder the
repeat rate is so high.

The judge cant decree anything doofuss. The judge has legal guidelines for
sentencing and cant go out of the range the law permits.

Even the Governor of the state is subject to the decisions of the lowliest
Justice of the Peace. The Governor can appeal, of course, but if the
appellate court agrees with the Justice, the decision will stand. The
law is more important than the man. There have, of course, been
miscarriages of justice, usually when the judge and sheriff are in
collusion. There have also been genuine mistakes made. The sentence
Paris Hilton received was no mistake. She will finally get the spanking
that her parents would never give her.

Clearly a fine reading of the exact statutes is required.
In the justice system, judges are ultimately supreme and
can only be over-ridden by a higher judge or a pardon
issued by a governor or president.
Most likely, this means that the sheriff can release
prisoners to alternate incarceration -unless- the judge
has specifically ordered that not happen - as in Hiltons
case. If the judge doesn't specify then the sheriff has
some personal discretion.
Anyway, -this- case looked as if the sheriff was
paid-off. The appearance of impropriety upsets the
Machiavellian illusion of equal justice for all and
thus won't be tolerated by the powers that be. The
sheriff -will- be spanked and Hilton -will- do her
time in the clink. She may not even get the benifit
of the "special" wing this time.
