Southern Methodist University officials said Monday
they are denying a Dallas lawyer's request to see
SMU's proposal for the George W. Bush Presidential Library.
Gary Vodicka, who is suing SMU over a land issue,
had asked SMU to produce the documents as part of his lawsuit.
He also subpoenaed the other three finalists for the library –
Baylor, Texas Tech and the University of Dallas – for copies
of their proposals.
"The information he is seeking is not relevant to the lawsuit,"
said Brad E. Cheves, SMU's vice president for development and
external affairs.
Mr. Vodicka's suit alleges that SMU used fraud and
intimidation to oust him and other residents of a
condominium complex to make room for the Bush library.
Mr. Cheves said that's not so and that SMU started
buying condo units in the late 1990s, before the
library was an issue, as part of a long-term strategy
to acquire property near campus.
Baylor and UD, both private like SMU, have refused
Mr. Vodicka's request in court filings. Texas Tech,
a public university, agreed to give Mr. Vodicka some
materials but not a full proposal.
Mr. Vodicka said Monday he plans to file a motion in
Dallas County District Court that would compel SMU
to produce a copy of its proposal, plus related documents.
"It's relevant to my lawsuit," he said.

I am sorry to hear that people are being ejected from their homes to
make way for something like the Dubya Library. OTH, it staggers my
imagination on what they would put in such a library.
