The Justice Department has launched a criminal investigation into
whether Democratic Senators ***** Durbin, Jay Rockefeller and Ron Wyden
leaked details about a secret "black ops" CIA satellite program last
December in a move that may have seriously compromised national
security, former Deputy Undersecretary of Defense Jed Babbin said on
Saturday.
"The CIA made a request to the Justice Department to investigate and
possibly bring criminal charges against these three [senators],"
Babbin told WABC Radio host Monica Crowley. "My information is that
investigation is ongoing."
Rockefeller is the vice chairman of the Senate Intelligence Committee
and Durbin is the No. 2-ranking Democrat in the Senate.
Media reports on the satellite leak last December indicated that the
Bush administration was concerned about public comments by Durbin,
Rockefeller and Wyden and that the CIA had requested a Justice
Department probe.
"The formal request for a leaks investigation would target people who
described sensitive details about a new generation of spy satellites
to The Washington Post, which published a page-one story about the
espionage program Saturday [Dec. 11, 2004]," a Justice Department
official told The Associated Press at the time.
But the same official told the AP that Justice "has not decided
whether to investigate."
Former Deputy Undersecretary Babbin's comments on Saturday were the
first indication that such a probe was actually launched and is
ongoing.
"The fact of the matter is that [Durbin, Rockefeller and Wyden]
divulged something that was above and beyond top secret and frankly,
they probably blew the strategy and the hundreds of millions of
dollars that were being spent to pursue it," Babbin told Crowley.
"The acknowledgement of [the "black ops" program's] existence is not
even proper and the acknowledgement of them and the details of them
can very well damage national security," Babbin added.
Asked if he thought the three Senate Democrats should have their
security clearances revoked for the duration of the leak probe, the
former Defense Department official said: "Absolutely and forthwith. I
mean, they should have been revoked at the time of the leak."
"There's really not much doubt about the leak having occurred," Babbin
told Crowley. "It's in the press records, it's in the Congressional
record. We know what they did."
"The only question," he explained, "is how much damage was done by the
leak. And that's part of the criminal investigation right now - to do
a damage assessment, to figure out how much this is going to cost us
strategically and militarily."

When the government classifies its crimes as secret, how exactly are
we supposed to catch the culprits OTHER than by making public such
classified information?
By your logic, President Bush could murder your entire family, declare
the job as classified, and you would be breaking the law if you told
someone what happened. If you called the cops - off to jail you go?

I think we WANT information about crimes comitted by our officials to

to realize that the NYT is one of those left wing

What correct way? It's illegal to tell anyone about the crimes.
You can't tell the cops. You can't tell your congressman. You can't
tell the Attorney General. Without breaking the law.
Because you are revealing classified information.
I would be interested in knowing how you think we could stop this
illegal NSA snooping using legal means.

And it does. The Bush administration tries to hide EVERYTHING

It wants NOTHING to be public - unless it benefits them.

And what about crimes which DO involve national security. They should
be ignored, permitted?

they do involve national security, there are other
avenues to try first rather than putting classified
information on the front page of the NYT.
Who says? You going to call President Bush's Attorney General and tell
him?
That's not a solution. AND it's a crime, I guess. You have no legal
right to tell the Attorney General classified information.
We have
to realize that the NYT is one of those left wing
newspapers more interested in bringing down Bush
than the security of our great nation.
What a joke. They were the official paper for getting the war going.
They told countless lies about Bush's opponent Gore.
In addition, it is President Bush who is bringing down the security of
our great nation, and the NY Times is just letting us know how.
That is what papers are SUPPOSED to do - get the truth out about such
government misbehavior.
Why do we have a first amendment? So the papers can print only what
the government says they can print?
President Bush is a far graver threat to America than Bin Laden is.
Bin Laden only threatens to kill some of us now living here. What
President Bush threatens to do is kill our political system - forever.
Listen to what Bruce Fein says. He is a Republican legal expert. He
was all over TV bashing Clinton back in those days - remember? He was
in the Reagan Justice department.

Do you understand what the President claims? He claims that he has
UNCHECKED power to do WHATEVER HE WANTS so long as it is somehow
related to the vague "war on terror"
President Bush says courts can't review him, congress can't stop him.
He says he has all the powers of a King in this field. LITERALLY.
We rejected the idea of being ruled by a king long ago, and I think I
want the NY Times to blow the whistle on this guy when he tries to
become King George IV.
Although historians point out that the powers related to war which
President Bush claims actually go BEYOND the powers King George III
had at the time of the Revolutionary War.
The cost from Al Qaeda thinking their phones might be tapped - which
surely they already know any way - is worth it to stop this
constitutional terrorist we have as our President.

"There's really not much doubt about the leak having occurred," Babbin
told Crowley. "It's in the press records, it's in the Congressional
record. We know what they did."
"The only question," he explained, "is how much damage was done by the
leak. And that's part of the criminal investigation right now - to do
a damage assessment, to figure out how much this is going to cost us
strategically and militarily."
Rockefeller is also a 5-4 favorite for leaking the NSA wiretaps.
Perhaps this investigation will expand.

Why is this of any consequence? The "leak" wasn't a revelation that the
NSA could listen to conversations anywhere in the world...Orrin Hatch
revealed that several years ago.The issue is illegal (not warrantless)
listening to conversations involving US citizens living within the US.
A caller to C-Span came to the only logical conclusion: the goverment
did not seek a warrant even after the spying had begun (which FISA
allows) because the target and justification would not pass the FISA
court's "laugh test". IOW, Bush was spying on political enemies, not
national enemies.
