Judge Says Mich. Seniors Can Get Ballots
MOUNT CLEMENS, Mich. (AP) -
A Democratic county clerk sent absentee ballot applications to all
registered voters over 60 in her jurisdiction Thursday, after a judge
rejected Republicans' arguments that the unrequested mailings were
illegal.
Four Republicans sued over Macomb County Clerk Carmella Sabaugh's
plans on Monday, arguing that she cannot mail the applications without
being asked and that the mailings could result in voter fraud.
After Circuit Court Judge John Foster denied the plaintiffs' request
to block the mailings, Sabaugh sent 49,000 applications to voters
across the county northeast of Detroit.

Judge OKs Sabaugh's mailing for absentees

Almost 50,000 applications for absentee ballots are headed to
Macomb County seniors after a judge denied Thursday a GOP-backed
request to stop the mass mailing.
Circuit Judge John C. Foster ruled that County Clerk Carmella
Sabaugh, a Democrat running for secretary of state, has the
authority to send out the applications. He refused to issue an
injunction to stop the ballots from being mailed.
Sabaugh's announcement two weeks ago that she would mail them to
all registered voters in the county 60 and older enraged
Republicans, who said Sabaugh was using taxpayer money to increase
her name recognition as she tries to unseat Republican Terri Lynn
Land.
Such mailings are common in many communities, but still
controversial. Then-Detroit Clerk Jackie Currie was told by a
Wayne County circuit judge last year not to conduct such a mass
mailing, but she did so anyway and was held in contempt.
Sabaugh said the lawsuit against her was intended to hold down
voter turnout.
"I cannot understand why the Republican Party would do this,"
Sabaugh said Thursday. "They want to suppress the vote. There
really is not any other reason to prohibit voters from getting this."
Attorney Eric Doster, who sought the injunction, filed an appeal
Thursday afternoon with the Michigan Court of Appeals in Lansing.
A response from Jill Smith, who is representing Sabaugh, is due at
noon today. It was not known if oral arguments would be heard.
Greg Fleming, one of four people who sought the injunction, is
running as a Republican for a state House seat in Eastpointe. He
questioned Sabaugh's timing.
"She's been in there for 14 years and then all of a sudden she has
the good conscience to do this," he said. "My concern is the
potential for fraud. I don't care what side of the aisle you sit on."
Todd Schmitz, Macomb's chief deputy clerk who also works on
Sabaugh's campaign, said she did similar mailings when she was the
clerk in Warren before becoming county clerk in 1992 and had been
looking to do the county-wide mailings over the past couple of
years. He also said every municipality in Oakland County sends out
similar mailings.
Doster argued that Sabaugh has no authority to send out a mass
mailing. Foster countered that just because state law does not
give Sabaugh the specific task of distributing unsolicited
applications, it doesn't mean she is breaking the law if she does so.
"If they go above and beyond, they're violating the law? Do you
really believe this, what you're telling me?" Foster asked with an
incredulous tone after Doster made the argument.
Smith mentioned that special interest groups such as Right to Life
of Michigan -- an anti-abortion group -- and the Republican Party
have sent out unsolicited mailers that include applications for
absentee ballots.
Seniors could play a key role in the Nov.7 gubernatorial election.
In the 2002 contest, about 38% of the ballots cast in the county
came from seniors. Ten county communities send out unsolicited
applications, but more than a dozen don't.
