Democrats are trying any tactic in the book to delay the Roberts nomination.
Just like they did to Miguel Estrada, they are asking for documents from Mr.
Robert's time in the Solicitor General's office. These documents are
internal memos generated from 1989 to 1993 when Roberts worked for the first
President Bush. Democrats are deliberately asking for documents that they
are well aware they cannot have to stall this nomination. Below is an
excerpt from Sean Hannity from "Hannity and Colmes" that describes how seven
former heads of the Solicitor General's office felt about releasing such
documents when this related to Miguel Estrada's nomination.
From Sean Hannity
You know, I've gone back, and I've done a little research here. And when
they tried to do this to Miguel Estrada, we know, for example, that there
were seven former heads of the solicitor general's office, many of them
serving Democratic presidents, and they all said that to do this, that this
request would violate the separation of powers, that it would run roughshod
over established executive-branch privileges, that this is a big mistake,
that presidents will never get the advice that they need.

available with no problem.

And as was made clear in the Ken Star investigation of Clinton the White
House CANNOT assert attorney-client privilege.
