It's not quite as you describe it. First, Libby was questioned in front of
a grand jury about the leak, Libby lied to the grand jury. He was also
questioned by the FBI about what he knew, he lied to the FBI. He then was
called before a grand jury again and lied once again, rather than
correcting what could have been his faulty memory. Thus Fitzgerald was
ethically bound to prosecute Libby, regardless of how much a tangent his
testimony might have been. I suggest that lying to a grand jury called to
investigate a possible crime constitutes perjury and what was Libby
convicted of but perjury or lying to the FBI?
When Libby got his second chance to testify, he either should have taken the
Fifth or corrected the errors he knew about in his prior testimony as Rove
did. Looks like Rove had better legal counsel than Libby!
As for seeking contempt citations against reporters who won't testify, I
don't approve of that practice but it is the law of the land according to
the Supreme Court of the United States and I pointedly note that
conservative Justices voted for the practice too.
