Dear Subscriber,
On Tuesday I will be talking to the grand jury about the IRS and DOJ's
"investigation" of me. In his most recent letter, Floyd Miller (Assistant
U.S. Attorney) suddenly agreed that I will be "permitted" to inform the
grand jury of "any matters which [I] believe are relevant to their
investigation." (In the letter before that, he made it sound like it
would only be me answering their questions, and that I wouldn't be allowed
to give a "speech" to the grand jury.) I have no intention of talking
their ears off anyway, but yeah, I have a few relevant things to bring to
their attention.
I should mention a few technical things, to respond to various e-mails
I've received:
1) There is no judge in grand jury proceedings. It's just the DOJ
attorney, the witness, and the grand jury. In these proceedings, the
GRAND JURY is in charge, NOT the government. They, and they alone, decide
what to consider, and who to hear from. (There is a judge that the grand
jury can consult with if they have legal questions, but he doesn't preside
over their proceedings.)
2) There are no rules of evidence in front of a grand jury. What they
want to hear, they hear, including rumor, hearsay, whatever (though all
too often they only hear what the government WANTS them to hear).
3) Grand jury proceedings are NEVER opened to the public. The only ones
allowed in the room are the witness (me), the government lawyer (Miller),
and the grand jury members. And when the grand jury deliberates, NO ONE
else is allowed in, including government personnel.
4) While I appreciate the offers from people to come do a show of support,
this isn't really a context in which that works. There wouldn't be
anything to see, nowhere to demonstrate, etc. (Plus, I don't want to do
anything to annoy the grand jury.)
The grand jury is a marvelous "invention": a group of regular "Joes" whose
permission the government needs before they can prosecute someone. And
it's informal, and doesn't go by all the maze of legalese rules that apply
at a trial. It should be interesting.
