Top of the fold -- The FMA: Why Amend the Constitution...?
There was much pontification this week among the Beltway chattering =
class, and it centered on the 50-48 Senate vote to support a filibuster =
against a floor vote on the Federal Marriage Amendment. Alas, the FMA -- =
that proposed constitutional amendment purporting to establish the legal =
definition of marriage as it has long been instituted by God and nature, =
not to mention common sense -- had failed to even get off the ground.=20
The FMA states: "Marriage in the United States shall consist only of the =
union of a man and a woman. Neither this Constitution, nor the =
constitution of any State, shall be construed to require that marriage =
or the legal incidents thereof be conferred upon any union other than =
the union of a man and a woman."=20
Despite the amendment's simple language, a floor vote would likely have =
fallen well short of the two-thirds majority needed to send the FMA to =
the states for ratification. But that has not silenced proponents of the =
FMA who characterize the whole issue as a "national crisis."=20
Indeed, there is a national crisis, but it is not confined to the =
definition of marriage. Rather, it represents the larger scope of the =
Leftjudicial assault on our national and state constitutions -- an =
assault that has penetrated so far into the heart of our republic that =
the mere determination of what constitutes an institution as fundamental =
as "marriage" must now be constitutionally defined.=20
Ironically, the judicial mischief undermining marriage, which inspired =
the FMA's proposition, is also its "Achilles' heel." Why amend what's =
left of our much-maligned Constitution when the Leftjudiciary -- that =
cadre of judicial activists bent on amending the Constitution by =
judicial diktat -- would simply twist the FMA by "interpretation" into =
whatever shape they, and their ilk, desired. (The Defense of Marriage =
Act, overwhelmingly passed into law in 1996, has provided no gauntlet =
against judicial activists.)=20
Sadly, our constitutional Republic as envisioned by our Founders -- a =
government "to ... establish Justice" -- has devolved into little more =
than a system of government by judicial decree. Imagine the audacity of =
our Founders -- who expected judges to honor our Constitution; to be =
constitutional constructionists bound by the letter of that venerable =
document and its proper amendments; and to be accountable to the law as =
written, not interpreted as if they had, themselves, written it.=20
To be sure, such interpretative mutilation of the Constitution is in =
clear violation of the original intent of our Founders. This becomes =
painfully clear upon examining the most definitive explication of the =
Constitution itself, The Federalist Papers.=20
The Federalist Papers, authored by Founders James Madison (who drafted =
the Constitution), John Jay and Alexander Hamilton, were and remain =
lucid about the proper role of the judiciary. Indeed, they had to be, =
because the method by which the Constitution of the United States was to =
be interpreted was one of the most pressing obstacles to its =
ratification. The concern among constitutional opponents was that the =
document gave the judiciary the power to interpret the laws according to =
the spirit of the Constitution, which, as they said, would "enable that =
court to mold the laws into whatever shape it may think proper, =
especially as its decisions will not be in any manner subject to the =
revision or correction of the legislature."=20
"This," said The Federalist authors, "was as unprecedented as it was =
dangerous." Continuing, "There is not a syllable in the plan...which =
directly empowers the national courts to construe the laws according to =
the spirit of the Constitution." (Federalist No. 81)=20
But Thomas Jefferson realized that even given the clear restraints on =
judicial activism, the federal bench would eventually devolve into a =
political forum for the expression of group ideology. Jefferson, in =
fact, warned of the potential tyranny of the "despotic branch": "Over =
the Judiciary department, the Constitution [has] deprived [the people] =
of their control. ... The original error [was in] establishing a =
judiciary independent of the nation, and which, from the citadel of the =
law, can turn its guns on those they were meant to defend, and control =
and fashion their proceedings to its own will. ... The opinion which =
gives to the judges the right to decide what laws are constitutional and =
what not, not only for themselves in their own sphere of action but for =
the Legislature and Executive also in their spheres, would make the =
Judiciary a despotic branch. ... It is a misnomer to call a government =
republican in which a branch of the supreme power [the judiciary] is =
independent of the nation. ... It has long, however, been my opinion, =
and I have never shrunk from its expression...that the germ of =
dissolution of our federal government is in the constitution of the =
federal Judiciary; working like gravity by night and by day, gaining a =
little today and a little tomorrow, and advancing its noiseless step =
like a thief, over the field of jurisdiction, until all shall be =
usurped."=20
Indeed, virtually all has been usurped. Jefferson, in his great wisdom, =
knew that human nature being what it is, federal judges would eventually =
abandon the plain language of the Constitution in favor of their own =
interpretations. Thus, the FMA, should it ever pass and be ratified, =
would do little more than bandage a lesion on a body already consumed =
with cancer.=20
In short, the real crisis in America is the undermining of our =
Constitution by the "despotic branch." Accordingly, then, the only =
constitutional amendment we should be considering is one that addresses =
judicial activism. For that reason, please devote your attention to "The =
Enumerated Powers Amendment" (inspired by the "Enumerated Powers Act" =
now before Congress). This Amendment mandates that our Constitution and =
its amendments be construed in the national courts according to its =
"original intent." Significantly, this Amendment calls on the House of =
Representatives to remove from office, by majority vote, any judge not =
in compliance with a strict adherence to the letter of our Constitution. =

From the Bush campaign journal...
"Kerry voted against parental notification for teenage abortions, taking =
control away from parents, taking away their right to know," charges the =
latest Bush campaign radio spot -- which only scratches the surface of =
JFK's ardently pro-abortion voting record. The ad goes on to note that =
while on the campaign trail, Kerry has been absent for two-thirds of the =
votes in the Senate this year, while his record on the remainder "makes =
you wish he never showed up to vote."=20
Well said.=20
Kerry spokesman David Wade sought to brush aside this latest Bush ad, =
saying the incumbent's campaign seeks to use "sloganized wedge issues =
dreamed up by Republicans to divide Americans for the purpose of =
political gain."=20
(Wait a second! Didn't Kerry just pull another flip-flop last week, =
announcing that, in keeping with his Catholic faith, he believes life =
begins at conception? And what's this about using wedge issues to divide =
Americans? Hasn't that been a Demo tactic at least dating back to LBJ's =
Great Society? Hasn't "divide and conquer" been their modus operandi on =
issues ranging from affirmative action, health care, Social Security, =
special rights for homosexuals and other special interest groups, and =
drumming up fears in everyone from the elderly to blue collar workers? =
Can you say, "class warfare"? Note to Mr. Wade: You're in way over your =
head.)=20
To be fair, though, what sort of campaigning is keeping Kerry so busy on =
the road? Too busy, by the senator's own admission, to stay current on =
national security threats and terrorism updates?=20
President Bush had the answer this week, and proffered a retort to the =
likes of Wade as he addressed voters in Michigan, observing, "The other =
day my opponent said, when he was with some entertainers from Hollywood, =
that they were the heart and soul of America," Bush said. "I believe the =
heart and soul of America is found in places right here, in Marquette, =
Michigan."=20
The President also took the occasion to go after John-John's criticism =
of his administration's economic record. He said his opponents "look =
at...progress" and "somehow conclude that the sky is falling," noting =
that the current economy, finally free of the Clinton-Gore recession, =
has introduced 1.5 million jobs since last summer, and nearly 30,000 in =
Michigan since February alone.=20
In other news from the Bush campaign, there were no tit-for-tat, risque =
double entendres directed toward his opponent this week, likely to the =
chagrin of former Kerry interns and ex-wives everywhere.=20
From the JFK DEMO-lition derby...
Kerry-Edwards and company are not only having a hard time finding space =
on the Internet (since The Federalist Patriot booked most of the Kerry =
and Kerry-Edwards URLs long before Kerry announced his veep), but they =
are having a hard time settling on a campaign slogan.=20
Kerry originally campaigned on "Make America work for you!" But we =
reminded him of the real JFK's inaugural admonition, "My fellow =
Americans: ask not what your country can do for you -- ask what you can =
do for your country."=20
Then Kerry started clucking about "return respect for America." Of =
course, some of us never lost our respect for America!=20
Now they are talking about "two Americas," so we reminded John-John that =
they plagiarized this theme from the 1948 convention of the Socialist =
Workers Party, where James Cannon noted: "There are two Americas.... One =
is the America of the imperialists -- of the little clique of =
capitalists, landlords, and militarists who are threatening and =
terrifying the world. This is the America the people of the world hate =
and fear. There is the other America -- the America of the workers and =
farmers and the 'little people'."=20
Further, we reminded the Johns that they and their combined $800 million =
in accumulated inheritances, divorce and litigation settlements, fall =
into the former not the latter America referenced by Cannon.=20
As if it was not already evident that these two are genuine phonies, =
radio talk-jock Don Imus hosted Kerry and Edwards earlier this week, and =
when they started blaming George Bush for the price of a gallon of gas, =
Imus asked them what is the price of a gallon of milk or a six-pack of =
beer. In response, well, let's just say the silence was deafening.=20
Next week, just in time for the Demo convention, the new campaign theme =
will be an old one -- "a chicken in every pot." But we will remind them =
that in the case of Kerry and his ilk, a more fitting slogan would be =
"pot in every chicken!"=20
Speaking of the Demo convention, lending a special degree of credence =
and respectability to the much-anticipated and much-scripted Demo =
convention will be the man best known for plumbing the depths of =
TV-talk-show sleaze. Yes, Jerry Springer will serve not only as an =
accredited correspondent to the convention, but as an Ohio delegate as =
well.=20
If this is a surprising inclusion, there was at least one surprising =
omission as well: Hillary Clinton's name was not on the original roster =
of primetime convention speakers, which includes her husband and =
certified lunatic Al Gore, announced last week. Of course, this was not =
an "omission" but a ploy to draw attention to the upcoming Beantown =
Circus. And most of the pundits bit! Predictably, Kerry announced late =
Thursday that he HAS asked Madam Hillary to speak -- on the opening eve =
of the raucous get-together, no less. She was "honored and delighted to =
have the opportunity."=20
On cross-examination...
"Senator Kerry is rated as the most liberal member of the United States =
Senate. And he chose a fellow lawyer who is the fourth most liberal =
member of the United States Senate. Now, in Massachusetts, that's what =
they call balancing the ticket." --President George W. Bush=20
This week's "Alpha Jackass" award:
"When the Berlin Wall fell, the perpetual Right in America, which always =
needs an enemy, didn't have an enemy anymore, so I had to serve as the =
next best thing." --Bill Clinton=20
Correct us if we're wrong, but weren't the Communists EVERYONE'S enemy? =
Maybe President Clinton's Leftist "vision" for America fell a little to =
the east of the wall that the Reagan Right brought down.
This week's "Braying Jackass" award:
"[T]he rabid, reactionary religious right has rarely looked more =
ridiculous." --Teddy Kennedy, D-Mented, alliteratively opining on the =
failed FMA. (Note to Teddy: Your apparent obliviousness to the fact that =
the overwhelming majority of Americans oppose "homosexual marriage" =
makes you look ridiculous)=20
DEMO-gogue campaign quotes...
"I understand that you've been having trouble getting some speakers.... =
Some people may have better things to do, but there's no place I'd =
rather be right now than right here in Philadelphia with the NAACP." =
--Kerry, shamelessly sucking up to the Democrats' most monolithic voting =
bloc, while poking fun at the President's rejection of an "invitation" =
to do the same=20
It's worth noting here that while a "scheduling conflict" will keep =
President Bush from addressing the ardently anti-Republican NAACP, the =
President will instead address a more relevant audience at the National =
Urban League. It's also worth noting that the once-proud NAACP -- =
ostensibly a non-partisan organization -- has become little more than a =
servile lapdog to the Democrat Party. Indeed, after Candidate Bush =
addressed the NAACP in 2000, the organization showed its gratitude by =
airing perhaps the crudest, most despicable TV ad in presidential =
campaign history. One wonders what the organization's "leaders," =
President Kweisi Mfume and Chairman Julian Bond, have in store for the =
President this time around. Alas, it can't get much worse than Mfume's =
recent remarks, which accused black conservatives of being =
"ventriloquist's dummies," or Bond's bizarre references to Confederate =
swastikas and the President's "Taliban wing" judicial appointees.=20
Also refusing to appear at the NAACP shindig was Education Secretary Rod =
Paige, one of Mfume's "ventriloquist's dummies." "I have a message for =
the NAACP's Julian Bond and Kweisi Mfume, who have accused black =
conservatives of being the 'puppets' of white people, unable to think =
for ourselves," says Dr. Paige. "You do not own, and you are not the =
arbiters of, African-American authenticity."=20

"I will be a President who talks with everyone -- those who agree with =
me and those who don't. I will be a President who truly is a uniter, not =
one who seeks to divide our nation by race, riches or any other label. I =

and want to leave this world a better place for their children. I will =
be a President who, when he is invited into your home, will always say =

American democracy. What better neighbors to visit with first than the =
NAACP." --Kerry -- who had best not show up on our front porch=20
"This is the first time I've appeared anywhere without John Edwards in =
the last four days. I'm feeling this withdrawal." --Kerry, still working =
on the personality thing=20
The BIG lie...
"The Bush administration went to the Supreme Court to keep the details =
of his secret energy task force secret. For months, he withheld =
requested documents from the bipartisan 9/11 commission. For years, he =
has steadfastly rebuffed repeated requests to release his military =
records and prove he actually served. And now Bush is refusing to =
provide Congress the intelligence summary he reviewed when deciding =
whether or not to set this nation on a course for war -- a simplified, =
one-page summary that may be the only thing Bush read and that may have =
excluded any warnings about faulty intelligence. Bush should stop hiding =
behind executive privilege and release the Cliffs Notes version of his =
intelligence briefing. It may explain to this nation why, despite =
repeated warnings from the intelligence community, this President =
stubbornly went forward with his plans for war." --DNC Chairman and =
former Bubba bagman Terry McAuliffe=20
News from the Swamp...
In the Senate, hindsight being what it is, it is increasingly apparent =
that there were significant intelligence failures leading up to the war =
with Iraq. Lack of human intelligence (relying on satellite photos or =
second-hand information from less-than-reliable defectors) and =
unchallenged assumptions (Saddam had deployable weapons in 1998, so he =
must've had deployable weapons in 2003) are among the key failures.=20
Still, inaccurate intelligence estimates do not constitute deception, =
despite what the bleating Left would have us believe. Both President =
Bush and British PM Tony Blair have been exonerated of "misleading" =
their countries to war by their respective intelligence committees, and =
there is certainly no reason to believe otherwise. The SIC concluded =
that no political motivations were involved. "The committee interviewed =
over 200 individuals from the intelligence community. They could find no =
one out of that entire group that indicated they felt pressure directed =
by the administration with respect to the kind of intelligence they =
should produce," said Vice President Cheney. The committee also found =
that the problems in the agencies transcend this administration, =
reaching back many years.=20
Conspicuously missing from the Senate Intelligence Committee's report -- =
a committee chaired for years by none other than Sen. John Kerry -- is =
an evaluation of the committee's own oversight of the intelligence =
community and the evidence for war provided.=20
The committee's findings were unanimous, although vociferous Democrats =
still found ways to aim personal attacks at the President. "I think the =
president wanted to be a wartime president. I don't think he wanted to =
go to war, but I think he wanted to be a wartime president. He saw this =
as something we had to do. Afghanistan was fine and that was =
important...but Iraq is what he wanted, and that's what he got," said =
Sen. Jay Rockefeller, West Virginia Democrat and member of the SIC. He =
further caterwauled, "The committee's report fails to fully explain the =
environment of intense pressure in which the intelligence-community =
officials were asked to render judgments on matters relating to Iraq =
when the most senior officials in the Bush administration had already =
forcefully and repeatedly stated their conclusions publicly." But wait. =
Wasn't Rockefeller part of the unanimous committee finding that Bush and =
the intelligence community were innocent of such charges? Did he even =
bother to read the document he signed, or was he pressured to do so? =
Sadly, it seems Demo doublespeak knows no bounds.=20
Given that we severely underestimated Saddam's capabilities in 1991, =
commentator Jeff Jacoby rightly points out, "[I]f intelligence mistakes =
are inevitable, is it better to worry too much about potential threats =
or to worry too little? Worrying too much -- if that's what happened -- =
resulted in the toppling of one of the planet's most murderous tyrants. =
Worrying too little resulted in 9/11."=20
The facts remain -- Saddam himself was a WMD (as evidenced by the =
uncovered mass graves). In addition, he had large known stockpiles of =
chemical weapon agents (yet to be found), he had substantial confirmed =
quantities of biological agents like anthrax (yet to be found), and he =
was actively engaged in seeking a fissionable core for his nuke program. =
We now know he had ties with al-Qa'ida and other terrorist =
organizations. Time was on Saddam's side -- in the wake of the crushing =
of his regime, we bought some much needed time.=20
In other Senate news, John Edwards and his trial-lawyerin' pals have =
been popping champagne corks and swapping high-fives, as last week's =
bipartisan class-action reform bill (62 senators support it) was killed =
by the Democrat "leadership," who prevented the full Senate from having =
so much as a vote. Despite this latest bit of Demo obstruction, Senate =
Majority Leader Bill Frist says he's determined to press on with =
class-action reform.=20
On the National Security front...
The Cold War era is rich with anecdotes of the Soviets being allowed to =
"steal" proprietary software from American firms. The software stolen -- =
ever the proverbial "Trojan Horse" -- would then cause the Soviets to =
sabotage themselves. Now, deep in the digital age and in the throes of =
the war of terror, can the same strategy apply?=20
A software industry controversy is moving into the public eye: Which is =
more secure, software written in secret, kept secret, and difficult for =
the public to critique or modify; or software available for all to see, =
criticize and modify? Getting this one right is imperative to our =
national security.=20
In the classic business software model, a company develops proprietary =
software and keeps it secret, closely controlling access to the code. In =
the "open source" model, software is widely published for any interested =
person to see, analyze and modify. In a war where the enemy uses our own =
software and electronic communications infrastructure, which system =
should we prefer?=20
One the one hand, keeping the code secret prevents malicious changes or =
even any modifications by the enemy. However, if there is a security =
hole in the software, the only people who can fix it are those with =
access. A hacker may find security holes and keep them secret, so that =
they may be exploited.=20
Open-source software proponents claim that security holes are more =
likely to be found and disclosed by the numerous people who use the such =
software in their private and business pursuits. Once disclosed, those =
holes can be fixed by anyone in the open-source community. However, =
there is no entity with a direct financial interest in finding and =
fixing the holes, and thus it is a matter of faith that any holes will =
be found and fixed before being found and exploited by the enemy.=20
The solution at this point may be proprietary software for some =
applications, open source for others. However, this is a moving target, =
and it is imperative that the decision is based not on cost (open-source =
software tends to be free) or the lobbying skills of industry, but on =
the constitutional directive for national security.=20
On the Homeland Security front...
A stream of new intelligence suggesting plans of a terrorist attack =
designed to disrupt the November elections (not unlike recent =
election-eve attacks in Madrid, Spain) has the DHS working to "ramp up =
security." When one reporter asked Senate Minority Leader Tom Daschle if =
the terror announcement could have been timed to steal the "political =
thunder" from the announcement of John Edwards for the Demo VP slot, =
Daschle replied, "The report is so sobering and so serious that I cannot =
bring myself to believe anyone in this administration would use this for =
political purposes." He went on to say that a recent terror briefing =
contained information suggesting that there is now a greater danger of =
terrorist attack than at any time since 11 September 2001.=20
From warfront with Jihadistan...
Upcoming October elections in Afghanistan are being threatened by =
unrestrained violence perpetuated by private militias. Marshal Muhammad =
Qasim Fahim, the government's defense minister, commands a private army =
of at least 50,000 fighters and yet seeks to be the vice-presidential =
running mate for President Hamid Karzai. However, warlords such as =
Fahim, heavily relied upon in freeing the country from the Taliban, are =
now creating problems for the new government under Karzai. Many of these =
warlords came to power through U.S.-backed efforts to expel the Soviets =
in the 80s and currently have more troops than the government. With an =
unstable economy, many are finding jobs as professional fighters in =
these private militias. Karzai is, understandably, pleading for a larger =
peacekeeping role for NATO, an organization that does indeed have a =
place in the post-Cold War world. In any case, the situation in =
Afghanistan will be a milestone test for NATO as it renews itself with =
new members and new tasks.=20
Regarding the redistribution of your income...
The conservative watchdog group Citizens Against Government Waste has =
awarded Alaska Sen. Ted Stevens its "Whole Hog Award," for the second =
year in a row, for filching the most per capita federal dollars for his =
state: more than $800 per person, some $524 million in all. That's a =
mind-boggling 26 times as much pork as the national average, $31 per =
person. Predictably, Sen. Stevens swears there's no pork in the dollars =
he's obtained for "Alaska's future," including the $2 million designated =
for "recreation" in North Pole, Alaska, population 1570.=20
Stevens, a Republican, isn't up for re-election until 2008, meaning =
we'll have at least four more years of pork heading to the frozen north. =
From the "Non Compos Mentis" Files...
"There is a Right-wing conspiracy, it controls the administration, both =
houses of Congress, much of the judiciary, and a major portion of the =
news media. ... Their idea of equal rights is the American flag and the =
Confederate swastika flying side by side. They've written a new =
constitution for Iraq and ignore the Constitution here at home. They =
draw their most rabid supporters from the Taliban wing of American =
politics. Now they want to write bigotry back into the Constitution. ... =
They preach racial neutrality and they practice racial division. ... We =
have a President who talks like a populist and governs for the =
privileged. We were promised compassionate conservatism; instead, we got =
crummy capitalism." --NAACP Chairman Julian Bond (How on earth could =
President Bush turn down such a charming guy?)=20
We might note, though, that the reference here to the debate over the =
display of the Confederate flag at the South Carolina capitol building =
was resolved without the NAACP, with most of the state's black =
legislators coming to the table to reach an amicable resolution in the =
Assembly. Despite that resolution -- a resolution struck without any =
"help" from divisive lobbies or the federal courts -- the NAACP =
continues to agitate the situation, ignoring the will of the people's =
elected representatives.=20
From the "Village Academic Curriculum" File...
From the "Not-So-Ivory-Towers" File: Ivy League rivals Yale and Harvard =
are in sync on one issue -- passivism on the homosexual front and =
intolerance to any opposing views. At Yale, activists posted fliers =
satirizing Gay Pride Month with slogans like "Gay Avarice Week," "Gay =

From the states, in Minnesota, a single judge has determined that the =
lives of Minnesotans are not worth defending. ... Or at least that's the =
upshot of the ruling from Ramsey County District Court Judge John Finley =
that the state's two-year-old concealed carry law is unconstitutional, =
because it was enacted with an unrelated provision. (Minnesota law =
restricts legislation to a single topic.) At least 20,000 and perhaps =
more than 30,000 Minnesotans have obtained licenses for concealed =
pistols, and the state's attorney general ought to move hastily for a =
stay of Finley's decision so these law-abiding citizens are not =
entrapped by an ex post facto law change.=20

The International Court of "Justice" ruled 14-1 last Friday in favor of =
the Palestinians that Israel's security fence is illegal, according to =
international "law." (And just how, you ask, did the non-state of =
"Palestine" sue a nation such as Israel before the ICJ? The UN General =
Assembly brought the case for them.) Despite the wall's effect at =
sharply curbing terrorism, which has killed nearly 1,000 Israelis since =
2000, the court got it totally backwards. "Instead of placing =
Palestinian terrorists and those who send them on trial...the...court =
placed the Jewish state in the dock, on the charge that Israel is =
harming the Palestinians' quality of life," said Benjamin Netanyahu, =
former Israeli Prime Minister, in an op-ed for The New York Times. He =
added, "...saving lives is more important than preserving the quality of =
life. Quality of life is always amenable to improvement. Death is =
permanent. The Palestinians complain that their children are late to =
school because of the fence. But too many of our children never get to =
school -- they are blown to pieces by terrorists who pass into Israel =
where there is still no fence." In light of the fact that the court's =
decision mocks Israel's attempts to combat terrorism (a word mentioned =
only twice in a 60-page opinion by the court) and that Israel neither =
brought the case nor consented to be judged (also required by =
international law), Israel has vowed to ignore the decision. In =
addition, the U.S. has promised to veto any Security Council attempts to =
enforce the ruling. Again, fellow Patriots, we pose the question: Why on =
earth is the U.S. still a member of the UN?=20
