WASHINGTON - As convicted sex offenders go, they seem to pose little
danger.
One is 100 years old. Another can barely walk and is in the late
stages of Alzheimer's disease. Another is dying of heart disease in a
nursing home.
Yet under a new Georgia law, thousands of registered sex offenders,
even the old and feeble, could be pushed from their homes and
hospices.
As states around the country have sought in recent years to control
the whereabouts of convicted sex offenders, Georgia's law stands out
as one of the toughest, a testament to the daunting public fears
regarding children's safety.
The roughly 10,000 sex offenders living in Georgia have been forbidden
to live within 1,000 feet of a school, playground, church or school
bus stop. Taken together, the prohibitions place nearly all the homes
in some counties off-limits -- amounting, in a practical sense, to
banishment.
Since the law's enactment in July, however, a federal judge, human
rights advocates and even some of the sheriff's departments that are
supposed to enforce the measure have suggested that the zeal for
safety may have gone too far.
The residency law applies not only to sexual predators but to all
people registered for sexual crimes, including men and women convicted
of having underage consensual sex while in high school.

There is a trial going on here in Vancouver of ex-school teacher, Tom
Ellison, who had sex with a dozen 15 year old female students. The
news showed video of the guy back when the alleged offenses occurred.
He was knock dead handsome back in the 1970s.
The prosecution is trying to make it sound as if he twisted the arms
of these girls to force them to have sex. I simply don't believe it.
This guy would have been beating them off with sticks. Even today he
is a very sexy man.
Legally he had no business having sex with his 15 year old students.
(The age of consent is 14). However, I think it silly to equate what
he did to rape.
It is a form of crying wolf.
Further, it is wrong to try someone by the strict standards of our era
for a crime committed in the swinging 70s.

If one commits a crime, any crime, society has penalties to force upon
the violator. Once that sentence is fulfilled, that person should be
free to pick up the pieces of their life and rejoin society.
Otherwise, should all sexual offenders be sentenced to life? Using
backdoor methods, this is essentially the intent by hardliners.

It would seem so and smacks in the face of the Constitutional cruel
and unusual punishment clause which of course is suppose to prohibit
such punishments. Don't get me wrong, I'm not supporting sex
offenders, far from it, but fairness is fairness. It makes absolutely
no sense when rapists and murders get "life" sentences then get out
scott free in as little as a dozen years while some dope who may do
nothing more then be caught with "dirty" pictures on their computer
and he gets branded a 'sex offender' with life long watching and
worse. Our founding fathers must be spinning in their graves if they
known how fucked up on criminal justice system has become.

Well, somebody managed to convince "the people" that these laws were
necessary. My youngest is a probation officer here in GA, and she has
told me numerous times, there are two areas where the judicial system
has basically taken the bill of rights and thrown them out the window:
DUI and "sex crimes." MADD conducted an extremely successful campaign
over the years to demonize DUI to the point that is about to be treated
much like assault and battery. To be sure, DUI laws needed to be
toughened, but the extent to which the judiciary and various state
legislatures have gone is simply ridiculous. Those to have taken on
the so-called "sex offenders" campaign have turned it into a crusade,
much like MADD did with DUI.
But the lawmakers have only done what the public has demanded. And the
public has demanded it because they were either convinced or coerced
into believing it was "the right thing to do." I think it's obvious
where the blame ultimately lies. One of those "road paved with good
intentions" things, kind of like the "zero tolerance" garbage in
schools.
Don't faint Adam, but I'm total agreement with you on this one. Those
who commit rape, child molestation, and other crimes such as this
should be punished, and severely. But if society thinks they should be
punished for life, then lock them the hell up for life. This crap of
keeping them under the heel of Big Brother for the rest of their lives,
continuing to punish them even though they have "paid their debt to
society", is exactly that, crap. This is nothing more than yet another
way of controlling another segment of the population.

The problems with the new restrictions on sex ofenders are masive. However
one is overlooked: They protect no one. Laws do not prevent anything. A
clue: The murderers of Jessica Lundsford and Carli Brusha were not on any
local registry. What both were at the time they committed their crimes was
high on drugs.
The concept that making some 35 year old guy who was caught with his 15 year
old girlfriend at 18 and is married to her register as a sex offender
"protects" children, or anyone else, is ludicrous.
Facty is, there are girls younger than you'd belive who are having sex and
the same for boys. We, the public, can't get our minds wrapped around the
concept that kids have and enjoy sex. Kinsey was hounded because his second
study on female sexuallity told us our mothers, daughters, wives enjoyed sex
and that sometimes they had sessions with dildoes, vibrators and Coke
bottles. He was goping to do a study on sexual perversions in society but
died before he could.

The problem is all so-called "sex offenders" are now lumped together
into one all encompassing category and regardless what they've done,
actually rape a kid or just download some naked pictures or anything
inbetween society thinks they all should be locked up for life and
treated the same which legally or morally makes no sense. Just like
any "crime", the punishment should be tailored to fit whatever
criminal activity they've been convicted of, not revert back to a
mentality where society with the coaching of the church burned people
to death they labeled as witches who in reality did nothing wrong.
It further seems a bunch of do-gooders, like the goofy religious
wackos have decided what is morally wrong. They did that before with
getting away with banning the legal consumption of booze. That was a
horrible and failed experiment in attempted moral oversight that was
doomed to fail.
I seriously doubt sex crimes against children has changed in how
common it is over the past century. It simply is more talked about
because of easy access pedos have via the Internet and sleaze tv
networks like NBC trying to make a buck off hyping the ***** out of it
for ratings on low budget shows like Dateline.
The bigger fear is coming to grips with the goverment making excuses
why they should be able to control the Internet. It has nothing to do
with kiddie porn or pedos using chat rooms, rather it is politicans
desperate to get their hands on the Internet and tax the ***** out of
it. Already some idiots in the Bush administration are proposing that
people that make a living or a nice side income off sites like EBay
will have to file papers so the feds can track sales and collect
incomes taxes.
Never, never, never let your guard down when it comes to the
government regardless if its the Dems or Reps trying to get into your
pants, not for sex, but to steal your wallet one way or another. That
is what all politicans regardless of stripe lust after; your money.

It's so damn hypocritical. If a speeder loses control and hits
another car and kills three kids, nobody gives two shits.

Some curbs on sex offenders called inhumane
Thousands in Georgia, even the old and feeble, banished from their
homes

(snip)

If having underage consensual sex in high school 50 years ago makes one
a sex offender, then, 75 percent of the population needs to be locked
up and the other 25 percent are lying.
